C__�0+vENlr +l° �� , i 1 UN/ON r• • �pi Al (:•{ S • • o To • • 1 •I t' ! - _ _ -1- -- _ _ • RESOLUTION AUTHORIZING CHAIRMAN TO SIGN PERMIT FOR PIPE LINE: WHEREAS, Oliver Wells Works has applied for a permit to lay a pipe line in the borrow pit along the north edge of the NWW: Section 22, Township 6 North, Range 65 West, and WHEREAS, the terms and conditions of said permit will keep and save harmless the County of Weld from any claims or demands for injury or damages resulting from the installation, maintenance or operation of said pipe line. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado that the Chairman of the Board be and he is hereby authorized to sign said agreement with Oliver Well Works according to the terms of the permit, a copy of which is hereto attached and made a part of this resolution. HZ ? i 1 \1fir G I .r H kcillms‘ c9 1 • a , T rr //) PERMIT FOR PIPE LINE Permission is hereby granted to Oliver Well Works, Inc. of Greeley, Colorado, Melvin Bickling of Route 1, Box 206, Greeley, Colorado and John Bickling of Route 1, Box 178, Eaton, Colorado, to cross under the inter— section of State Highway 255 and F.A.S. State Highway 392 in a southeasterly direction, which intersection is located at the southeast corner of the SE4 of Section 16, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, and from the point on the southeasterly corner of said intersection where the hereinafter described pipe comes through, thence east in the borrow pit along the north edge of the NW4 of Section 22, Township 6 North, Range 65 West of the 6th P.M., a distance of about 2950 feet, and to install in said excavations or tunnels a 12 inch Black Welded l4 Gauge Steel Pipe for the purpose of carrying water from an irrigation well to be located on a 40 acre tract in the SE of Section 16, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, on property belonging to the said Melvin Bickling and John Bickling to a point on the north edge of the NE4 of Section 22, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, which property also belongs to the said Melvin Bickling and John Bidding, a distance of about 2950 feet. This permit is granted upon the express conditions that: 1. The pipe line shall be placed in the borrow pit along the north edge of the NW4 of Section 22, Township 6 North, Range 65 West of the 6th P.M. as far from the traveled roadway as possible. 2. Ample provision for traffic during construction shall be made and that the ground surrounding said pipe line shall be left in the same condition as prior to the installation of said pipe line. All necessary safety measures will be taken to warn of dangerous highway conditions during installation. 3. Melvin Bickling and John Bickling will be responsible for the main- tenance of the pipe line and any damage caused by the installation of said line or its operation. 4. Melvin Bickling and John Bickling agree that if alterations or expansions of the adjacent highways require moving of the line necessary or convenient, the said Melvin Bickling and John Bickling will move said line at their own expense upon receipt of written notice from the Board of County Commissioners or Colorado State Highway Department to do so. 5. Crossing under the above described intersection will be accomplished without damage to the roadway by jacking, boring, or driving said pipe line under said roadway and there will be no water used for this operation nor will an open trench be excavated through said intersection. 6. Melvin Bickling and John Bickling will upon receipt of written notice from the Board of County Commissioners of Colorado State Highway Department, in the event non-maintenance makes the pipe line detrimental to the highway, remove the same. If said owners do not comply with the written notice the county may remove said pipe line and bill the owners for the expense thereof. T. Melvin Bickling and John Bidding by their signatures to this permit, hereby bind their respective heirs, executors, administrators and assigns to the performance of the conditions above stated. 8. The County reserves the right to change the line, their width, or course of the existing highways under which and along which said pipe line will be laid. 9. Said pipe line will be buried at least four feet (4 ft.) from the surface of the ground under which it is laid. /d0/ . - S. — 2 — 10. The signature of the authorized representative of Oliver Well Works, Inc. shall evidence the acceptance of the conditions above imposed on said company in the construction of said pipe line. 11. Melvin Bickling and John Bickling hereby assume responsibility and will be liable for any damages occasioned to County of Weld and will keep and save harmless the County of Weld from any claims or demands for injury or damages resulting from the installation, maintenance or operation of said pipe line.
