Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 21) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved"out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 6. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. 7. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty(60)days from the date the Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 8. Condition of approval 3A in the resolution for AmRE-4439 states that the applicant shall address the requirements and concerns of the Fort Lupton Fire Protection District, as stated in the referral response dated December 28, 2010. The referral dated December 28, 2010 was marked that the Fire District has reviewed the request and finds no conflicts with their interests. Two comments were made concerning driveway access and address numbers for a residence. The property is vacant at this time and the property owner has no plans on building in the near future. The property owners have reviewed the comments and will take them under advisement should they decide to build a residence in the future. Please find attached the tax certificates that adequately address conditions of approval 3B for AmRE-4439 and 3A for 2nd AmRE-3466. Should you need any additional information please contact me at your earliest convenience. It was a pleasure to work with you towards closure of this project. Signed,dorlf/ATodd A. Hodges. A A. Box 758 Greeley, Colorado 80632 RE: AmRE-4439&AmRE-3466 Public Works referral dated December 21, 2010 Dear Mr. Bauer: This letter is a follow up concerning our meeting on January 10,2011 and our phone conversation on January 26, 2011 discussing the Public Works referral dated December 21,2010. Based on our discussions it is our understanding that we are in agreement with the following: 1. The existing access points to Lot C of AmRE-3466 will remain open based on the existing Agricultural and Oil&Gas use of the access points. The applicants understand that if the CR 24 extension occurs then access will be reviewed again at that time. 2. Due to the fact that the potential future extension of CR 24 has not been finalized it is not necessary to adjust the lot lines based on the proposed roadway. The applicants would like to move forward with the original proposed lot layout provided in the applications. The applicants agree to show a dashed line showing the potential future location of CR 24 extension on the plat. 3. The applicants understand that any future proposed mining and/or construction of buildings will require the appropriate permits therefore a flood hazard development permit study or location of building envelopes on the plats will not be required at this time. The requested notes on the plat concerning building permits and flood hazard development permits address any future mining and/or construction of buildings on these properties. If I have misrepresented our discussion and conclusions please contact me to discuss further. Thank you for your time concerning this project. Signed,grcAd/dTodd A. The properties are both located in Section 12, Township 02 North, Range 67 West of the 6th P.M., in Weld County, Colorado. This proposal is consistent with the surrounding uses, which include rural residential, oil/gas and agricultural uses. Uses on each lot will be consistent with past current uses. This proposal is consistent with application standards found in the most current Procedural Guide and the County Code. I. Domestic and Irrigation Water Supply statements: A. Domestic water is proposed from a well. A permit will be obtained at the time of a proposed building. B. Irrigation Water is not affected by this proposal. II. Sewage Disposal statement: Any future septic construction shall be permitted through the Weld County Department of Environmental Health and Environment. III. Current Property Use: The properties are currently in agricultural uses. There are oil/gas facilities on the properties. Both Lots B and C will have the ability to have residential and agricultural uses. No building improvements exist on either lot. Access exists to both parcels(see attached RE-3466 and RE-4439 plats). W. Description of lots: The future property uses will be residential, those uses allowed by the existing agricultural zone district and potential gravel mining. The proposed configuration of Lots B and C better accommodate the existing and future uses on each property by consolidating the productive agricultural uses and the future mining resources. This proposed amendment also better accommodates the potential future extension of CR 24 through these properties to CR 22.5 (see attached map for location of extension). The proposed northern access on CR 23 is to be shared between Amended Lots B and C and will accommodate agricultural uses, future mining access and the potential extension of CR 24. The property owners agree to work with the County concerning the location of the CR 24 extension. Amended Lot B is proposed to be 123 acres in size and Amended Lot C is proposed to be 60 acres in size. V. Unique Site Characteristics: There is an abandoned Railroad ROW that is shown on the RE plats. Lot C RE-3466 has a drainage area that is delineated on the RE plats. VI.Building Envelope Designation: The designation of building envelopes is not applicable to this application. VII. Current Land Use Permits Associated with the Property: Currently,no special land use permits are associated with either of the lots. 1 So 4,41 Summary of Kuipers Trust/ Bennett Transaction, Intent, and Goals The subject property was originally owned by Carole L. Kuipers and since her passing is held by the Carole L. Kuipers Living Trust. Kuipers divided the property and sold Lot "B" to Tom & Stephanie Bennett, together with 2 shares of Meadow Island #1 Irrigation Company shares. The Bennetts intended to someday construct a home and develop a small lake by leasing the gravel mining rights. Over time it has become evident that the best way to accomplish their mutual goals would be a sale of the water rights to City of Aurora. To that end, the parties have structured a deal and placed under contract their cumulative shares of Meadow Island #1 with City of Aurora. Kuipers holds 17 shares, Bennetts hold 2 shares. In keeping with their original goals and to balance the transaction between the parties, Kuipers will receive all proceeds from the water sale in order to obtain the necessary dry-up acres from the Bennett parcel and will exchange approximately 60 acres to Bennett. The proposed Amended Recorded Exemptions submitted by Todd Hodges Design will re-configure the lots between these 2 neighbors to accomplish their mutual goals. Bennetts want the additional land to continue the existing farming operation and their future intended gravel operation and Kuipers wants the proceeds from the water sale and be left with a remaining legal lot. This change essentially amounts to an internal lot line change between 2 neighbors to accomplish their mutual goals. No new lots or new accesses are created by the change. More importantly, the reconfiguration much better accommodates the ongoing farming operation as well as the anticipated gravel project. In addition, these land owners have now been burdened with a future planned route of the extension of WCR 24. The final selected route was not what these owners wanted, but now are subject to that extension as set forth in a Weld County Commissioners Resolution. The proposed re-configuration will better accommodate the proposed route with less disruption for both landowners and provides for a potential haul road route for the gravel operation. The sale of the water shares to City of Aurora includes an agreement to lease back the water for a minimum of 5 years with an option to extend for an additional 5 years, Conceivably, the land could continue to be operated as an irrigated farm for up to 10 years. Weld County Planning Department GREELEY OFFICE MEMORANDUM flVn'n RECEIVED TO: Michelle Martin, Planning Services DATE: December 21, 2010 W`DC FROM: Heidi Hansen, P.E., Public Works Department 4.14 COLORADO SUBJECT: AmRE-4439, Thomas Bennett The Weld County Public Works Department has reviewed this proposal. Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: WCR 24 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. There is a proposed future alignment of WCR 24 connecting to WCR 22 that runs through this property. Lot C of 2ndAmRE-3466 and Lot B of AmRE-4439 are located within the FEMA mapped Zone A 100-Year Floodplain and possibly the floodway. Weld County Code prohibits the construction of buildings within the floodway. A Flood Hazard Development Permit (FHDP) is not required for agricultural activities. However, at such time as the owner proposes to construct any type of building, place fill, or conduct mining operations within the FEMA designated floodplain, a FHDP will be required showing the impact of the proposed activity on the floodplain and that the proposed activity is not located within the floodway (Planning Policy No. 2010-07). Additionally, the FHDP application must show that the development activity is in compliance with all floodplain regulations in effect at the time of application. REQUIREMENTS: 1. Lots B & C shall share an access. The existing access to Lot C must be permanently closed and photographic evidence of the closure must be submitted to the Public Works Department. After the existing access is closed, the applicant may open a new shared access for Lot B of AmRE-4439 and Lot C of 2n°AmRE-3466. If, in the future, the proposed new alignment for WCR 24 is constructed then the accesses will be reviewed and new accesses may be granted. 2. The proposed future alignment of WCR 24 connects to WCR 22 as shown in Alternative 3A, Figure 7, Page 12 of the Weld County Road 24 Corridor Study dated November 2008. Please show the approximate future alignment on the plat. The future Right-Of-Way for this alignment is 140 feet. Structures should be constructed with consideration of the future Right-Of-Way. 3. Please contact Public Works to discuss the possibility of adjusting the proposed lot lines to follow the future alignment of WCR 24. 4. Add the following note to the Plat: a. The future alignment of WCR 24 is a conceptual alignment and may be adjusted at the time of final design to accommodate site or construction constraints. 5. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. Page I oft M.\PLANNING-DEVELOPMENT REVIE \RE-Recorded Exemption\AmRE-4439.docx • • 6. The applicant should be aware of the new Colorado State Floodplain Regulations that will be effective as of January 14, 2011. The new regulations expand the extents of the floodway and may affect all or some of the proposed lots. Building envelopes for each Lot will need to be shown on the plat and a Flood Hazard Development Permit will need to be submitted in accordance with Planning Policy No. 2010-07 for the building envelopes if they are shown in the floodplain. A floodplain study will be required to verify that the proposed building envelopes are not in the floodway. Please show building envelopes for Lot B of AmRE-4439 and Lot C of AmRE-3466 on the Plat. If the building envelopes are shown in the floodplain additional requirements will apply. 7. Add the following notes to the Plat: a. WARNING: LOTS MAY NOT BE ABLE TO OBTAIN BUILDING PERMITS DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Lots A and B may not be able to obtain building permits to construct structures. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map #080266-0860C dated 9/28/82 and Map #080266-0866C dated 9/28/82, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code, all applicable Colorado Water Conservation Board floodplain regulations, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. b. Flood hazard development permits showing the location of the floodway and the impacts of the project on the 100-year water surface elevation will be required for development activities located within the FEMA mapped South Platte River Floodplain. c. The installation of any septic system within the 100-year floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. pc: AmRE-4439 Page 2 oft M:\PLANNING—DEVELOPMENT REVIEW\RE-Recorded Exemption\AmRE-4439.docx Memorandum TO: Michelle Martin, W.C. Planning DATE: December 16, 2010 • FROM: Lauren Light, W.C. Department of Public COLORADO Health and Environment CASE NO.: AMRE-4439 NAME: Bennett Environmental Health Services has reviewed this proposal to relocate the lot line between Lot B of RE-4439 and Lot C of RE-3466. Lot B will consist of 123 acres and Lot C will consist of 60 acres. Both lots are currently vacant. Individual wells will provide water and individual sewage disposal systems will be installed when a residence is built on either parcel. Both parcels are encumbered by the flood plain. The following conditions are recommended to be part of any approval: 1. A Weld County Septic Permit is required for any proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Please note, the lot owners shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. 2. The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S. flood plain regulations. In accordance with the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the floodway. Please contact Weld County Public Works to verify flood plain vs. floodway. Additionally, please note the following: 1. This application is proposing wells as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. • • • • nevoiliki . & rhs6 411,44.‘ C.- ':‘ ,, ••• ' .4-. ....• arespr-.4 ..- • slictIvria • . ^ 4 N...; me 'z; it ', .
