WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 12th day of October, 1977 , the Preliminary Plan of Zabka Farms Subdivision was submitted to the Board of County Commissioners for approval in accordance with the Subdivision Regulations of Weld County, and WHEREAS, the Board of County Commissioners heard all of the testimony and the statements of those present, and WHEREAS , the Board of County Commissioners had evidence presented in support of the approval of said Preliminary Plan, and no evidence was presented in opposition to the approval of the Preliminary Plan for the following described real estate, to-wit: Part of the East Half (E') of the Southeast Quarter (SEY) of Section 32, Tagnship 6 North, Range 65 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows: Commencing at the Southeast Corner (SE Cor) of said Section 32, Township 6 North, Range 65 West; Thence North 00°07'40" West, along the East line of said section 32, 665.16 feet to the True Point of Beginning; Thence South 89°53'20" West, 433.15 feet; Thence North 63°22'00" West, 206.68 feet to the East right-of-way Line of U.S. Highway No. 85; Thence Northerly along said East right-of-way line of U.S. Highway No. 85, the following courses and distances; North 06°45'30" West, a distance of 288.00 feet; North 07°26'06" West, a distance of 205.21 feet; Thence along the arc of a curve to the left, having a radius of 3,025 feet, the chord of this arc bears north 09°56'04" West, a distance 124.17 feet; Thence leaving the Highway right-of-way line South 83°19'20" East, a distance of 703.13 feet to the East line of said Section 32; Thence South 00°07'40" East along the East line of Section 32, a distance of 621.84 feet; Said described parcel of land contains 9.653 acres, more or less, and is subject to any rights-of-way or other easements as recorded by instruments of record or as nag existing on said described parcel of land. The recommendation of approval also requested that a 20- foot right-of-way dedication to County Road 41 include the entire frontage of the Zabka property. REFERRAL FROM COUNTY: ZABKA SUBDIVISION LOCATION: County Road 41 (1st Avenue) , North of B Street Developer: Duane Zabka Represented By : Martin Bird This proposal has been reviewed by ART at a previous meeting in January. Mr. Zabka proposes to split three 18 , 000 square foot lots , each having 120 feet of frontage on County Road 21 (1st Avenue) , off of a 9. 6 acre parcel which is located on top of the bluffs just to the east of the U. S. 85 right-of-way. The property is zoned estate and is presently improved with a house and barn. The remaining portion, the fourth lot , is approximately 8 acres and will remain the Zabka residence . However, between the divided lots and the Zabka home there is a 60 foot strip which, at some future date , could be dedicated as right -of-way thereby providing access to the rear. County Road 41 is designated in the Comprehensive Plan as an arterial and the plan shows a 20 foot dedication along the entire Zabka development , At the time of the previous ART review it was requested that common access be provided to the three lots since separate curb cuts on an arterial could cause traffic friction. This has been provided. Fire Chief Forbes noted that this property is in an area on the fringe of both the Eaton and the Western Hills fire •districts and is on a two inch water line . He said that this could present some problems in fire protection to the property owner. Wally Jacobson, Highway Department , noted that as the property more fully develops and as adjoining property develops there should be planning for storm water retention so that water does not run over the natural drainage to the west and onto U. S . 85 . Ed Powers , Planning Department, noted that this is an area that the Comprehensive Plan designates as agricultural and it is outside the 2010 growth ring. However , it is currently zoned estate. Max Karner recommended that a culvert be considered under the access driveway to the three lots . Staff, in general , noted that use of septic tanks on 18 , 000 square foot lots seems surprising . However , this has been approved by the County Health Department . • / ADMINISTRATIVE REVIEW TEAM • • January 12, 1977 III. LAND DIVISION IN COUNTY LOCATION: E! , SE', Section 32 (Co. Rd. 41 extension of 1st Avenue, North of "B" Street) Jay Freese was present, representing the developer of Zabka Estates, a 9.653 acre parcel. The parcel is located on top of the bluffs, just • east of the U.S. 85 right-of-way. The current land use is for a residence, barn, animal shelter, and pastures. The proposal creates three 18,000 square foot lots with 120 feet of frontage on 1st Avenue in addition to the remaining fourth lot which also fronts on 1st Avenue. The fourth lot would be approximately 8 acres. While the Comprehensive Plan designates the area agriculture, it also contemplates industry to the northwest, west, and south of the proposal. First Avenue is designated to be an arterial which would require a 20- foot dedication. A U.S. 85 interchange is considered for "B" Street in addition to the interchange at North 8th Avenue. Ed Powers noted concern for residential lots fronting on an arterial street which creates a "friction" between traffic flow and ingress/egress movement. Common driveways were sug- gested as a solution. Mr. Patrick of the Highway Department noted that the development would pose no high'Way related problems since U.S. 85 has con- 'trolled access. Subsoil conditions have been adequately described in the report prepared by Nelson, Haley, Patterson and Quirk, Inc. Because unusual foundation conditions can be encountered residence excavations, we recommend that a qualified engineering geologist or soils engineer inspect all foundation excavations and, if necessary, formulate a proper foundation design. As noted in the letter by Jeff Burwell, the subdivision area generally has slight limitations for septic tanks and leach fields; however, an onsite investigation is recommended because inclusions may occur within the general soil unit. We concur with this recommendation and feel that percolation tests should be conducted prior to the approval of the application. If the above recommendations and the recommendations contained in the Nelson, Haley, Patterson & Quirk report are followed, we have no objection to the approval of this application.
