Dear Sirs:
Thank you for taking time to personally visit our property on December 7'h. I greatly appreciated your coming to our
farm and observing firsthand the non-historic flood damage. I believe our"sit around the kitchen table"meeting was
positive and constructive in its tone of"getting this matter resolved justly."
To reiterate our conversation December 7,2011, I appreciate Mr. Johnson's offer that the State of Colorado will cover the
cost of the pumping mechanism and its installation. Thank you. This will help defer some of the costs attached to draining
the non-historic rising of the water. It is my understanding that after said installation, we are to thereon personally assume
the cost of electricity and all that goes with the actual pumping of the water. While I'm appreciative of your defraying the
cost of the mechanism and its installation, I'm sure you'll understand the frustration and anger I have facing the un-
certainty of unknown pumping expenses for an unknown period of time(quite possibly years)- just because of an
unavoidable disaster not of my making.
While State cannot presently participate in compensating me for property damage and devaluation already incurred and
attributed to this man-made disaster, it is my hope that after State has fully investigated the extent of this non-historic
rising of water levels along the South Platte River.that it will include us in its just compensation of damaged parties.
I look forward to receiving Mr. Johnson's letter stating my right to pump the flooding water off our property. When I first
contacted Jason Smith two years ago,this type of letter would have been helpful in at least diminishing the extent of
property damage. I do appreciate and accept Mr. Smith's apology for his neglect,but with some regret.
Most importantly, please go to Governor Hickenlooper posthaste. and stress to him the urgency of remedy needs regards
this entire non-historic flooding along the South Platte. As per our discussion,please urge our Governor to declare a State
of Emergency and open up the wells. We are confident this will reliably decrease the flooding and bring damages into
check while bringing the water table back into balance. This will allow studies and subsequent remedies the necessary
time to implement without un-necessarily harming Ag land and other properties.
Once again,thank you for your"boots on the ground" cooperation and sincere interest in resolving this.
