SUBJECT: USR-1776, Beverly Ensley do Viaero Wireless
A Use by Special Review permit for a Telecummunication Antenna Tower (195 foot cellular
tower).
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The WCR 98 Section Line is 60-feet of unmaintained County right-of-way. In order to utilize this right-of-
way for access to the site, the applicant must enter into a non-exclusive license agreement with the
County. This agreement allows the applicant to utilize the County right-of-way with the understanding that
their use is not exclusive and that the County will not be responsible for maintenance of the access.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Utilize the existing access to the site.
2. The applicant must enter into a non-exclusive license agreement with the County to utilize the
WCR 98 section line right-of-way for access.
3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
4. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a 195 foot wireless
communications tower. As no employees will be located at the site, permanent water
and sewer is not required. Portable toilets and hand washing units can be utilized
during construction of the tower. Bottled water is sufficient for drinking provisions during
construction.
The application indicates that a 1000 gallon propane tank will be utilized to power the
back-up generator and will be buried on the property. The applicant shall comply with
the provisions of the Colorado Department of Labor and Employment, Oil and Public
Safety Division's Underground Storage Tank Regulations.II We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.

5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Bottled water shall be utilized for drinking during construction of the project.
7. Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during construction of the facility.
8. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
9. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
10.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Chapter 29 of the Weld County Code.

The FAA reviews planning and construction proposals through the submittal
of FAA Form 7460-1, Notice of Proposed Construction or Alteration. If any
portion of the proposal is located within 20,000 feet of a public use
runway (and breaks a 100:1 plane coming off the nearest point of the
nearest runway) ; or, is more than 200 feet above ground level at any
location, the FAA requires the project's proponent to file a Form 7460-1.
If the proposal does not meet any of the criteria above, it may still be
necessary to file a Form 7460-1 if the structure requires an FCC license.
