A detailed review of these items was not completed at this step in process. Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: CR 41 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to the CR 41 right-of-way for future build-out. CR 24 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot • ht-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld unty Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access Permit Application Form: The applicant has supplied this form, also identifying that an 18" reinforced concrete pipe (RCP) shall be placed at the entrance as a part of the tracking pad with 300' of asphalt pavement at the entrance with turning radii and a stop sign. Pictures at the proposed entrance have been supplied as a part of the application. Our Traffic Engineer will evaluate the Access Permit Application and accompanying documents. Off-street truck and vehicle parking and circulation appear to be adequate. REQUIREMENTS: Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. Off-street parking spaces including the access drive shall be surfaced with recycled asphalt gravel and shall be graded to prevent drainage problems. A concrete drain pan around the shop/office area will be installed and used for draining that area. Traffic Study: The applicant has submitted a traffic narrative for review and it appears to be acceptable. 1. No parking or staging of commercial vehicles on the county road is allowed. 2. The applicant has indicated that this site will produce 10 round trips per day or 20 trips per day. 9 3. The access will have 45' radius to accommodate the larger trucks entering and existing the site. The applicant has not provided the water quality calculations needed to determine the size of the water ip quality feature. Please contact Clay Kimmi for assistance in determining the size of the water quality feature that will be needed. 2. Please delineate the location of the water quality feature on the plat and construction drawings. Please label the water quality feature as a "No Build/Storage Area" on the plat. 3. Please add the following development standards to the resolution. a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. b. Weld County will not maintain on-site drainage related areas or medians. This must be addressed by the homeowner's association or land owner. c. The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on site. d. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. Grading Permit: Please place the following language in the resolution under "Prior to the Release of Building Permits". 1. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. ood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR11-0013 SHARP COLORADO DATE: October 6, 2011 Environmental Health Services has reviewed this proposal for a truck and trailer repair and maintenance shop. The property is currently vacant. A commercial well has been applied for through the State Division of Water Resources. An engineer designed commercial sewage disposal system is required. The waste handling plan indicates a container will be kept on the north side of the shop for office waste. Tires will be kept in a fenced enclosure and picked up by a commercial recycling company. Oil will be kept in drums and picked up by an oil recycling company. The waste plan shall include the name, address and phone number of the companies that will be picking up the waste. The waste plan shall also include the time isframe for waste removal so that tires and waste oil are not accumulating on the property. The applicant is planning to install a floor drain in the shop which will drain into a watertight vault and will be pumped by a commercial business. The contact information for the company contracted to pump the vault shall be included in the waste handling plan. The dust abatement plan states that the entrance will be paved and recycled asphalt or concrete will be used on the driveway and parking areas. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4) Documentation that floor drain wastes from the maintenance facility will be captured in a watertight vault and hauled off for proper disposal. Include the business name, address, and phone number for the company that will be contracted to service the vault. We recommend that the following requirement be incorporated into the permit as a condition that must be met one month prior to construction activities: 1. The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, to cover stormwater discharges from construction sites (5 CCR-1002- 61). Alternately, the applicant can provide evidence from CDPH&E that they are not subject to the CDPS requirements. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of a Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11. Floor drain wastes shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 12.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Additionally, please note the following: 1. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office S 3 of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. Water Division 1, Water District 2 Dear Mr. Parko: We have reviewed the above referenced request for use by special review for a transportation headquarters on a 34.6-acre site. The submitted material does not appear to qualify as a"subdivision" as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. Steve Sharp Transportation is proposing to construct a headquarters facility consisting of an office with three employees and an attached maintenance facility with two mechanics. An additional five employees will have access to the site for pickup and drop off of equipment. The proposed water supply for the property is referenced as a"domestic well". Records available in this office show that well permit no. 75579-F was issued for this property on October 5, 2011. This permit authorizes the appropriation of up to 7.9 acre-feet per year from the nontributary Laramie-Fox Hills aquifer for commercial use. So long as the well with permit no. 75579-F is used in accordance with its permitted conditions, this office has no objections to the proposed transportation facility.
