HomeMy WebLinkAbout20110614 RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000143 AGAINST JOE ANTHONY GUTIERREZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Joe Anthony Gutierrez, ZCV #1000143, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of March, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Joe Anthony Gutierrez, property owner, was not present or represented at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 8, 2011, to allow adequate time for the property owner to license all expired vehicles and restore all tires on the vehicles or install proper screening. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000143 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Joe Anthony Gutierrez to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until April 8, 2011, to allow adequate time for the property owner to license all expired vehicles and restore all tires on the vehicles or install proper screening. He said he is currently in North Dakota working. He said his grandmother lives on the property. He said all of the vehicles but the farm truck belong to his cousin who is in the county jail. He said he would try to get a hold of his cousin's girlfriend and see if they can get them removed. He said the farm truck use to belong to his grandpa who was restoring it, but he passed away. He said he really doesn't want to get rid of it. I explained that screening or restoration were the other available options. He said he would see what he could do about taking care of it. 01/10/2011 Phone call Annette Gutierrez (515-5140)called. She said they got license plates on the remaining vehicle, removed a derelict vehicle and installed fencing. She said the property is in compliance. I explained that the earliest I could make it out to inspect is probably the middle to the end of this week. She said okay.
