M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast Corner (NE Cor) of said Section 16, and considering the North Line of said Section 16 as bearing South 90°00'00" West, with all other bearings contained herein being relative thereto: Thence South 90°00'00" West along the North line of said Section 16, 1301 . 28 feet; Thence South 00°57'47" East, 51. 53 feet to a point on the South right-of-way line of Colorado State Highway No. 14, being the True Point of Beginning. Said described parcel contains 16. 355 acres more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to expand said dairy farm operation on the above described premises, and WHEREAS, the said requested expansion of an existing dairy farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 E (3) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners, that the application of Hiroshi Tateyama, Ault, Colorado, for PL0617 760132 expansion of an existing dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect expansion of said dairy operation and shall have up to one year from date hereof to begin expansion of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. The dairy operation on the hereon described 16.335 acre parcel located in part of the NE4 of Section 16, T7N, R65W of the 6th P.M. , Weld County, Colorado shall be limited to the facilities as shown on the Special Use Permit plans. Said facilities are designed to handle approximately a total of 500 head of dairy cows. 2. The Special Use Permit area shall be maintained in such manner as to prevent the growth of noxious weeds, fugitive dust, and erosion. 3. Water shall be supplied by the North Weld County Water District and a livestock/domestic well which has been approved by the State Engineer. 4. All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health Regulations . 5. Access shall be limited to the two proposed points as shown on the Special Use Permit Plan. Designated accesses are subject to approval from the State Highway Department. 6. Construction shall begin within one year of approval of the SUP permit application by the Board of County Commissioners. 7. The Special Use Permit shall be limited and governed by the development standards stated hereon. Since 1948 we have been in the dairy business, starting with a 20 to 30 cow herd. At the present time we have approximately 130 head of milking cows in the herd. With the present facilities we are at our limit. We would like to expand our dairy operation to accommodate about 250 to 280 head. Although our place when fully developed has a capacity of 500 head, we doubt that we would ever develope into an operation that large, but in case we ever would, we will make lagoons for animal waste for maximum use. Maximum employment would be about 4 persons. Traffic congestion would be hard to determine due to the seasonal change, but under normal conditions mould not be more that 15 times per day. We would take every precaution and use every techinical control device that would be reasonable, economical and feasible to our operation. We would appreciate your consideration in this matter. Developers should be responsible for providing these noise abate- ment measures that may be required to meet minimum environmental standards. As a general rule for meeting noise standards, residential improvements should generally be setback a minimum of 200 feet to 250 feet from center line of highway and business improvements should be setback a minimum of 150 feet to 200 feet from centerline, unless some other type of noise abatement measures (walls, earth berms, noise in- sulated walls and windows, etc.) are constructed on the property. The farmstead as shown on the plat is approximately 90 feet from center line. As new driveways are shown on the plat, Driveway Permits will be necessary.
