Shapley and Nancy E. Shapley, Co- Trustees of the Dewain L. Shapley Trust dated February 18, 2004, with a mailing address of 70589 County Road 112, Stoneham, Colorado, 80754, hereinafter collectively referred to as "LESSOR", and Verizon Wireless (VAW) LLC d/b/a Verizon Wireless, with offices located at 180 Washington Valley Road, Bedminster, New Jersey 07921, hereinafter referred to as "LESSEE". LESSOR and LESSEE are at times collectively referred to hereinafter as the "Parties" or individually as a "Party". 1. LESSOR and LESSEE entered into a Option And Land Lease Agreement (the "Agreement") on , 201_ for an initial term of five (5) years, commencing on the Commencement Date. The Option And Land Lease Agreement shall • automatically be extended for four (4) additional five (5) year terms unless the LESSEE terminates it at the end of the then current term by giving the LESSOR written notice of the intent to terminate at least six (6)months prior to the end of the then current term. LESSOR leased to LESSEE a portion of that certain real property which is described in Exhibit "A" attached hereto and made part hereof, located at 7 589 County Road 112, Stoneham, Weld County, Colorado, 80754, (such real property is hereinafter sometimes referred to as the "Property") consisting of a 35 foot by 60 foot parcel containing 2 100 square feet (the "Land Space"), together with the non-exclusive right (the "Right of Way") for ingress and egress, seven (7) days a week twenty-four (24) hours a day, on foot or motor vehicle, including trucks over or along a fifteen foot (15') wide access right of way, and for the installation and maintenance of utility wires, poles, cables, conduits, and pipes over, under,or along a ten(10)foot wide and a five(5)foot wide utility right-of-way, both extending from the nearest public right-of-way,Colorado State Highway 71 to the Land Space, said Land Space and Right of Way(hereinafter collectively referred to as the "Premises") being substantially as described herein in Exhibit "B"attached hereto and made a part hereof. LESSEE shall have the right to modify Exhibit"B"based upon the final as built conditions of the Premises, which shall be reflected in an Exhibit"C" attached to the Agreement upon written acknowledgment by the Parties and such acknowledged Exhibit "C"shall replace and supersede Exhibit"B." 3.
