RE: ACTION OF THE BOARD CONCERNING ZCV #1000084 AGAINST MOSSBERG
FAMILY FARM/ASH LANE DAIRY FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mossberg Family Farm/Ash Lane Dairy, ZCV #1000084, is allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of January, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jan Sherrod-Mossberg, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until February 11, 2011, to allow adequate time for the property
owner(s) to bring the subject property into compliance by submitting a Certificate of Occupancy,
along with a one page letter stating the intent of the mobile home to Staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000084 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Mossberg Family Farm/Ash Lane Dairy to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until
February 11, 2011, to allow adequate time for the property owner(s) to bring the subject
property into compliance by submitting a Certificate of Occupancy, along with a one page letter
stating the intent of the mobile home to Staff.

23-4-170 Temporary accessory farm use.
23-4-170.A.1 The MOBILE HOME will be occupied by persons principally employed at or principally engaged in
the operation of the USE where the MOBILE HOME is located. ACCESSORY farm USE of the MOBILE HOME
shall be established and revalidated on an annual basis as follows:
Evidence shall be submitted by the applicant or property owner on the anniversary of the permits issuance for
review and acceptance by the Department of Planning Services verifying that the MOBILE HOME occupant is
principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of
tax records (W-2 forms), employment agreements or other documentation as determined suitable by the
Department of Planning Services. Failure to submit the required documentation may result in cessation of the
allowance of the MOBILE HOME for TEMPORARY ACCESSORY farm USE.
VIOLATION REMEDY:
At the previous Violation Hearing, the Board of County Commissioner's referred your violation case back to staff
to work with you; however, as of the date of this letter, your property remains in violation. I did conduct an

however, the mobile home was still present. Please contact Wendi Inloes Planning Coordinator to determine
how to bring this property into compliance. Hopefully by scheduling this hearing out until January, this will allow
enough for you to advise us of your intent to correct this situation. If the mobile home has been removed prior
to January 10, 2011, the above referenced Violation Hearing,will be cancelled.

06/28/2010 Phone call Mr. Mossberg called. He said he received a letter. I walked him
through the violation case. He said his brother runs the dairy and is
responsible for renewing any permits. He said he would give him a
call today and pass along the information. I explained that my next
letter a (30 day letter)would be going out in the next day or so if the
information had not been submitted prior. He said he would pass the
information along.

ZONING VIOLATION CASE SUMMARY
10/12/2010 Office visit Jerry Mossberg came to the Greeley Planning Office, he met with
Wendi Inloes. He explained to her that they would NOT be having
their brother move into the mobile home. Instead he would be leaving
the property. Mr. Mossberg also indicated they haven't actually even
looked in the mobile home yet to see how much damage was done
or if it is feasible to fix it. He said they probably do need another
helper on the property and would move whoever that was in there
(possibly his son). He really didn't know when he would get to this,
but he was going "push"to get on it.

Inspection Result Comment Upon a visual inspection of the property, the following items were noted: the
single wide mobile home is still present in addition to the principle stick built
dwelling unit. I also noted a camper/trailer extended and occupied on the
property. See pictures dated 10/08/10.

Inspection Result Comment Upon a visual inspection of the property, the following items were noted: the
RV-Camper/Trailer had been removed from the property. The mobile home is
still sitting on the property and appears still vacant. No pictures were taken
