HomeMy WebLinkAbout20110107.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000084 AGAINST MOSSBERG FAMILY FARM/ASH LANE DAIRY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mossberg Family Farm/Ash Lane Dairy, ZCV #1000084, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of January, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Jan Sherrod-Mossberg, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 11, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by submitting a Certificate of Occupancy, along with a one page letter stating the intent of the mobile home to Staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000084 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Mossberg Family Farm/Ash Lane Dairy to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until February 11, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by submitting a Certificate of Occupancy, along with a one page letter stating the intent of the mobile home to Staff. He explained to her that they would NOT be having their brother move into the mobile home. Instead he would be leaving the property. Mr. Mossberg also indicated they haven't actually even looked in the mobile home yet to see how much damage was done or if it is feasible to fix it. He said they probably do need another helper on the property and would move whoever that was in there (possibly his son). We have not had an employee at the Mobile home so far this current year of 2010. The owners have decided to remove this Trailer after the end of this harvest season; if we have not found an employee to move In and occupy the trailer.
