SUBJECT: USR-1787, Dietzler Water Resources Corporation
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
CRs 95 is local gravel roads and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
CR 122 is collector roads and requires an 80-foot right-of-way at full build out. There is presently a 60-foot

tROVEMENTS AGREEMENT:
is Use by Special Review will be subject to a designated haul route and any intersection improvements such
as adequate turning radiuses, dust control if needed, on-site improvements or upgrades necessary to
accommodate this type of use.
TRAFFIC STUDY:
The applicant has provided a Traffic Impact Study for the Dietzler loading facility prepared by Fox Higgins.
After reviewing the submitted traffic study and visiting the project site I have prepared the following comments:
1. Please submit a revised copy of the Traffic Study that is signed, stamped, and dated by a registered
professional engineer licensed in the State of Colorado.
2. The applicant is proposing approximately 320 round trips per day to the facility.
3. Public Works staff has identified the haul route for this facility to travel 2 miles north on WCR 95 to
WCR 122 traveling 3 miles west to the paved portion of WCR 122.
4. An annual road inspection will be performed in the spring to establish the condition of the haul route
and surrounding roadways to determine if any road damage was caused by the operation of the loading
facility.
5. The applicant will be responsible excavate, repair, or patch any damage on the roadways to mitigate for
heavy truck traffic volumes created by the loading facility. The type and method of repair will be
• determined by the Department Public Works.

6. If road damage is beyond repair, the applicant will pay their proportional share for the reconstruction to
restore the road.
0 7. Roadways Improvements may be triggered due to heavy truck traffic associated with the facility:
a. Full Depth Mag-Chloride will be required when the traffic volumes reach 200 vpd.
b. CTB (Concrete Treated Base) with a Chip Seal or RAP is required when the traffic volumes
reach 300 vpd.
c. Pavement is required when the traffic volumes reach 500 vpd.
8. Turn lanes will be triggered once traffic volumes meet the following warrants:
a. 25vph turning right into the facility during a peak hour.
b. 10vph turning left into the facility during a peak hour.
c. 50 vph turning right out of the facility during a peak hour.
9. A stop sign will be required to be installed at the facility access onto WCR 95.
10. The access will have 60' radius to accommodate the larger trucks entering and existing the site.
11. No parking or staging of commercial vehicles on the county road is allowed. Use on-site parking area.
PRELIMINARY DRAINAGE:
The applicant has provided a preliminary drainage report and plan for the Dietzler Water Resources project.
The preliminary drainage report was not signed, stamped, and dated by a registered professional engineer
licensed in the State of Colorado
1. Please address the redline comments on the drainage report and drawings that were returned to the
applicant's engineer. Future drainage report submittals must be stamped, signed, and dated by a
• registered professional engineer licensed in the State of Colorado.
2. Please ensure that the Final Drainage Report addresses all items in the Preliminary and Final Drainage
Report Checklists.
3. Please provide design calculations for all swales and channels that will be constructed on the site.
4. Please show the detention pond in a drainage easement on the final plat and label the volume and
release rate.
5. Please include a map delineating the off-site drainage basins that drain onto the site.
6. The preliminary drainage report appears to be utilizing rainfall amounts for the town of Firestone. It is
not appropriate to utilize Firestone rainfall for a proposed site that is over 60 miles northeast of the
town. Please utilize the appropriate rainfall amounts shown in the NOAA atlas.
Grading Permit: Prior to recording of the final plat, the applicant needs to submit a grading permit showing:
proposed grading, erosion control placement, typical details for all BMPs to be utilized, and a Construction
Stormwater permit from the Colorado Department of Public Health and Environment. The permit must be
stamped by a registered professional engineer licensed in the State of Colorado. Please note that the grading
permit will not be released until the applicant has signed the improvements agreement, posted collateral, and
submitted the final plat for recording.

USR-1787 Dietzler Water Resources
The Department recommends the following conditions be adopted as prior to recording the plat
conditions in the draft resolution:
An individual sewage disposal system is required for the proposed facility and shall be installed
according to the Weld County Individual Sewage Disposal Regulations. The septic system is
required to be designed by a Colorado Registered Professional Engineer and in accordance with the
Weld County Individual Sewage Disposal Regulations (Department of Public Health &
Environment).
• If applicable, the applicant shall obtain stormwater discharge permit coverage from the Colorado
Department of Public Health & Environment, Water Quality Control Division for construction
activities. Written evidence of such shall be provided to the Departments of Planning Services and
Public Health and Environment. (Department of Public Health & Environment)
A fugitive particulate emissions control plan (dust control plan) shall be submitted and approved by
the Weld County Dept. of Public Health & Environment. Written evidence of such shall be provided
to the Department of Planning Services. (Department of Public Health & Environment)
The Department recommends that the following conditions be adopted as development standards in
the draft resolution:
The fresh water storage and loading system shall be operated in a manner to minimize spills. Fresh
water spills should be captured in above ground containment areas for reuse or allowed to infiltrate.
There shall be no discharge from this process to surface waters or to the facility's stormwater
management system in accordance with the Rules and Regulations of the Colorado Water Quality
Control Commission, and the Environmental Protection Agency. (Department of Public Health &
Environment)
No permanent disposal of wastes shall be permitted at this site. Any liquid or solid wastes shall be
stored and removed for final disposal in a manner that protects against surface and groundwater
contamination. Waste materials shall be handled, stored, and disposed in a manner that controls
• fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions.
The applicant shall operate in accordance with the approved Waste Handling Plan. (Department of
Public Health & Environment).

Fugitive dust shall be controlled on this site. The facility shall comply with their approved fugitive

• This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone
as delineated in Section 14-9-30 of the Weld County Code. (Department of Public Health &

Adequate drinking water, hand washing, and toilet facilities shall be provided for employees and
patrons of the facility at all times. (Department of Public Health & Environment)
This facility shall comply with the laws, standards, rules and regulations of the Water Quality
Control Commission, Air Quality Control Commission, Hazardous Materials and Solid Waste
Division, and any other applicable agency. (Department of Public Health &Environment).

1. Submit drawings and specifications for the diesel storage tank.
2. A building permit will be required for any new construction, alteration, or addition
to any building on the property.
3. We would recommend that a code analysis be done on the project by a design
professional with experience in this area.
4. Building permits are required for buildings, structures and change of use for
buildings which required permits before the beginning of construction or the
proposed change of use.
5. Buildings, structures and use shall conform to the requirements of the various
codes adopted at the time of acceptance of the permit application. Currently the
following codes have been adopted by Weld County: 2006 IBC; IMC; IPC; IECC;
2008 National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of
the Weld County Code.

Comments: The Town of Grover is gravely concerned about this project and its close proximity to the Town of Grover. First and
foremost we are concerned about the huge amount of water that will be coming out of the facility and the effect that
will have on the water table in the area.We are also immensely concerned about the huge amount of truck traffic it
will bring to an area that is already being over-run with this type of traffic.Weld County Road 390 is already in a state
of deterioration and we cannot imagine what 300 trucks per day going in an out of this site will do to this road, not to
mention adding to the dust problem that is already out of control.We should also note that Dietzler Water Resources
has not contacted the Town of Grover to discuss any of these issues as of this date. Lastly,would like it noted that we
will not allow any truck traffic through Grover on our main street(Chatoga Avenue)all trucks should follow the
designated truck route using road 122/Wilson Avenue on the north side of Grover.

Dear Ms. Ogle:
• This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information
and provide informal comments. The comments do not address the adequacy of the water supply
plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable
water supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
According to the submitted information, the proposal is for a groundwater load out facility
within the Agricultural Zone District. The proposed facility would supply groundwater to oil and gas
companies, additionally the facility would have the ability to supply groundwater for municipal,
industrial, and irrigation uses. According to our records, well permit nos. 74874-F and 74877-F are
located on the subject 80-acre parcel. Well permit no. 56473-F is also located on the parcel and is
approved for withdrawal from the alluvium for watering of livestock. Per the submittal, the applicant
currently utilizes the property for ranching operations. Permit no. 56473-F does not appear to be a
source of water for the proposed project.
The approved well locations for well permit nos. 74876-F and 74878-F are in the SW1/4 of
the NW1/4 of Section 29, T10N, R60W of the 6th P.M. Furthermore, this office has received
construction reports for well permit no. 74876-F in the Laramie-Fox Hills aquifer and for well permit
no. 74877-F (located on the 80-acre parcel) in the Upper Laramie aquifer. According to the
submittal, new wells will be constructed pursuant to well permit no. 74874-F (located on the 80-
acre parcel) in the Laramie-Fox Hills aquifer and pursuant to well permit no. 74878-F in the Upper
Laramie aquifer.

The approved uses for all four well permit nos. 74874-F, 74876-F, 74877-F, and 74878-F
are limited to irrigation, industrial and commercial, livestock, fish rearing, recreation, and pond
filling on 3840 acres of overlying land, in portions of Sections 17, 18, 19, 20, 28, 29, and 30, T1ON,
R6OW and portions of Section 13 and 24, T1ON, R61W of the 6`h P.M.; and additionally in all of
Weld County for industrial and commercial use via truck hauling. The proposed uses to supply
groundwater to oil and gas companies, industrial, and irrigation are consistent with approved uses,
however, municipal use is not an approved use.
Any new well permit applications will be evaluated pursuant to the applicable statutes and
rules at the time they are submitted.
