Dear Kim Ogle,
I am writing to express my concern regarding proposal USR—1778 and urge the representatives and public officials to
deny this proposal. I am not able to attend the meeting tomorrow, but would like to express my strong objection to the
proposal to develop a hunting/boating/camping area next to the Poudre Learning Center. I use and enjoy the Poudre
Trail on a regular basis—it is one of the only continuous bike/walking trails in the Greeley area. It provides recreation
opportunities for all citizens. One of the spectacular aspects of this trail is all of the wildlife that can be viewed. If
motorized boats, loud music, and hunting are allowed along the trail, it will drive many of the species from this wildlife
corridor and spoil the enjoyment of this trail for everyone. Secondly, the proposed site adjoins the Poudre Learning
Center which is an amazing learning resource for students. Again, if the neighboring property features porto-potties,
motor boats, etc., many aspects of this unique property will be spoiled. For example, the nesting bald eagles would
likely be driven from the area. It would be difficult to hold classes outside nor would there be any wildlife to observe.
Schools have invested in that property as a resource and to spoil it by allowing a private citizen to create a campgroun is
not fair to the school districts nor to the students that this facility serves. Finally, I am a concerned tax payer who lives in
the neighborhood. We purchased our property specifically because of the tranquil nature of the area and with the
knowledge that we were surrounded by open space. We've already have substantial amounts of gas and oil drilling that
has encroached on this wonderful neighborhood. Please do not allow the addition of hunters, motor boats, and loud
arties to be added to this mix. I have personally had the experience of running along the Poudre Trail and having a
Woose fall from the sky about 100 yards from me as some hunter was shooting toward the trail from his private
property. I do not want to think about the consequences of opening up a hunting area adjacent to a trail that is heavily
used by families, bikers,joggers, walkers, birders, etc. I do not believe that this type of facility is appropriate for the
surrounding area. I believe there must be a balance.The owner is able to enjoy the land and I've routinely seen vehicles
camped there and motorboats on the lake. In consideration of the surrounding neighborhood and recognition of the
importance of that wildlife corridor, please do not allow one individual to spoil this area for so many others.

Please do what you can to protect the animals and plants ,especially the bald eagles who have been nesting at the
Poudre Learning site for many years. I would have liked to attend this hearing in person along with my 25 little 2nd grade
friends who have enjoyed several field trips to the Poudre Learning Center but was unable to get a bus. We all appreciate
having the opportunity to observe wildlife so close to our neighborhood.

Dear Kim Ogle
As someone who brings people to Weld County to show them the wildlife, and birds in particular, it is with great concern
that I read about the proposed commercial hunting, water skiing and camping facility on the property northwest of
Greeley.
The value of wildlife in this area is immense and has positive impacts on many local businesses.
I urge you to carefully consider the impacts to the Bald Eagles, as well as to the general public's enjoyment of this area,
and urge the utmost care in considering as to whether this is the most appropriate site for such a development.

opposition to the proposed zoning change that would allow a commercial hunting, boating and
camping facility to be located adjacent to an active Bald Eagle nest site on the Poudre River as well
as adjacent to an outdoor environmental education facility that is visited by approximately 14,000
school children annually.
Please make this letter available to the Weld County Planning commission members as well as the
Weld County commissioners.

I wish to express some deep concern regarding a change in zoning to the Siebring Reservoir area that would
accommodate a proposed commercial hunting, water skiing and camping facility north of County Road 62.25 (F
Street)and east of County Road 25 (95th Avenue) in Weld County, referred to as USR-1778. My concerns and
objections are enumerated below.
I am the current president of the Fort Collins Audubon Society but our activities occur in both Larimer and
Weld Counties. As such many of our members and guests that participate in our field trips or bird
independently use the Poudre River Trail in the area of the proposed zoning change. Of particular concern is the
• impact of the proposed use on a pair of bald eagles that have been nesting for numerous years in the vicinity of
Siebring Reservoir, and have successfully fledged over 20 young in that time.
Currently there are only three successful bald eagle nest sites along the Poudre River, from its canyon mouth,
northwest of Fort Collins,to its confluence with the South Platte River. This nest site would be the eastern most
of those three sites. Bald eagles that utilize rivers require long reaches of river to ensure an adequate food
supply(fish) for both themselves and their young. Their territory can't intrude into the territory of other pairs of
eagles without disputes occurring. And their territories must also be relatively free of human-caused
disturbances-otherwise the eagles will abandon their territory and, if the disturbance occurs at the wrong time
of the year,they will abandon their eggs or young. A hunting, water skiing and camping facility would
conceivably generate disturbances sufficient to cause this pair of eagles to abandon their territory.
Not only would the proposed use of the area be incompatible with the bald eagles but it would also be
incompatible with the current use of the property to the east, specifically the Poudre Learning Center. This
facility serves as an outdoor environmental education classroom for six school districts, and accommodates
approximately 14,000 school children annually. An adjacent commercial hunting,water skiing and camping
facility would not be compatible with this education facility.

RE: Siebring Reservoir proposal
We are opposed to the proposal for a commercial hunting, water skiing and camping
facility at Siebring Reservoir.
We have hiked on the Poudre River Trail and spent time at the Poudre Learning Center.
This proposed commercial development would endanger the wildlife along the trail and
spoil the area for those of us who like to bird, hike and bike. The other important issue
is the eagle nest at the reservoir. The kind of activity the commercial development
would bring to the area would almost certainly ruin the area for the nesting eagles.
This area, so close to population, guarantees free access and programs for adults and
for school children that allows them to observe and learn about wildlife and our
environment.
Please vote against Proposal USR 1778.

My name is Randy Post. I am in management with State Farm Insurance, but in a past life I was a marine
biologist for 15 years with an environmental consulting firm in San Diego. But more importantly, my family
has been volunteering for years with the Poudre Learning Center, removing old barbed wire fences, planting
trees, and taking numerous groups of Greeley schoolchildren on nature walks around the grounds. I am also
an Assistant Scoutmaster with Boy Scout Troop 247, and a number of our scouts have done Eagle projects to
benefit the learning center. In fact, my son will be doing his Eagle project there this summer to create a small
amphitheater setting next to the lake made of log benches where future instructors will be able to address
eager young minds as they awaken their knowledge about the natural world. Hopefully, this helps you to
know where I am coming from. I would like to make 2 simple points against the proposed zoning change to
the Siebring Reservoir.
1. A significant number of people have invested considerable time, energy, and money over the years to
help make the Poudre Learning Center a reality, and I believe that these proposed changes will negatively
impact the capacity for the learning center grounds to remain in a natural state.
2. A couple of years ago I read a book titled, Last Child in the Woods. In it, the Colorado author pulled
together scientific evidence to demonstrate the existence of a medical diagnosis referred to as Nature Deficit
isorder. He makes a strong case for the fact that our children need a connection with the natural world for
heir own health. And yet, numerous surveys have shown that a significant percentage of our children have
never been to the mountains, or camping, or even hiking along a wooded trail. The Poudre Learning Center
may be the last place these kids have to experience nature and gain an appreciation for it. And my fear is that
the noise generated by the proposed zoning change will not only chase away the significant wildlife in the
area, but also result in chasing away our children from the Poudre Learning Center.

• Background (Preamble): 1 — ( 1
The Weld County Planning Commission will review a proposal on May 3, 2011 for a commercial hunting, water skiing
and camping facility on property northwest of Greeley. The proposal then goes before the Weld County Commissioners
for approval.
The lake property where these activities will take place is located west of and adjacent to the Poudre Learning Center.
The Poudre River Trail runs along the southern boundary of the property parallel to County Road 62.25/F Street. A
bald eagle nest is located on the northern boundary of the property.
Concerns have been voiced by the Colorado Division of Wildlife, U.S. Department of the Interior Fish and Wildlife
Service, the City of Greeley and other local agencies and include the following:
1. Bald Eagle and Wildlife Habitat Impact-A pair of bald eagles is currently nesting adjacent to the lakes. It is believed
two eaglets have recently hatched. The Bald Eagles have been nesting in this area since 1992 and have produced
approximately 20 eaglets during this time period. This nest is one of only two known active nests along the Poudre
River in the Northern Colorado area. The Bald Eagle is protected under the Migratory Bird Treaty Act of 1918 and the
Bald and Golden Eagle Protection Act. In addition to the Bald Eagles there is an abundance of other wildlife currently
inhabiting the area. Sightings include coyotes, deer, turkeys, mink, racoons, and numerous bird species.
Increased human activity and the noise generated by boat motors, loud music and additional hunting activity could
adversely affect the eagles and other wildlife in the area. This disturbance clearly has the potential of causing the
eagles and other wildlife to leave the area altogether.
• 2. Poudre River Trail Impact-The Poudre River Trail, south of and contiguous to the property in question, is enjoyed by
many as a peaceful place to walk or bike and observe nature and wildlife in a quiet setting. Increased noise from this
facility, as well as the danger of stray bullets from hunters,will negatively affect the trail in this area.
3. Poudre Learning Center Impact-The Poudre Learning Center(PLC)was built with funds raised by Greeley and
Windsor Rotary Clubs,other local organizations, and many individuals. Since 2005,tens of thousands of students have
visited the PLC, -giving local children from Greeley-Evans,Windsor-Severance, Johnstown-Milliken, and Eaton school
districts the opportunity to experience the outdoors in a natural environment, observe wildlife, and learn about the
importance of the Cache la Poudre River in a unique setting with hands-on activities. The PLC also serves as a
community meeting place for various groups and is headquarters to the Cache La Poudre National Heritage Area.
The proposed facility will have a significant impact on the PLC. The tranquil, educational setting of the PLC would clearly
be negatively affected. Wildlife, once observed by students, could very likely be scared off by this increased activity.
Increased wave action caused by motor boats will erode the east shore of Siebring Reservoir and potentially damage
the north-south road on the PLC property. Early, late, and weekend users of the PLC and the Poudre Trail would be
impacted by motor-boat noise and fear of stray shot from hunters'guns.
The PLC,the Poudre Trail, the bald eagles and other wildlife in this area must be protected from the negative impacts of
this proposal. This proposal is not consistent with surrounding land uses and must not be allowed.

Personally, I see no reason to destroy the habitats of animals that are native to this region. I believe that commercial
hunting and boating should be restricted to mountain ranges or places where the native animals aren't trying to
repopulate their species. I find that being able to save the eagle population or any other would be able to incite further
places to do the same actions. If the native animals can find this area as a new home,who are we as humans to
encroach upon their land.

This is a local educational area. By allowing boating (unsupervised)students will be at risk. Damage to the local

The City of Greeley is the owner of the property known as the Poudre Learning Center (PLC) which is the
eastern neighbor to the area that is the subject of USR 1778 application on which is proposed
Recreational Facility.
The PLC has, among other things, a connection to the Poudre River Trail and has an indoor center for
school classes, laboratory instructions and gatherings; a parking facility to support the PLC; wetland
habitat and ecosystems learning centers via outdoor classrooms; and a system of barrier free education
pathways for exploring the site.
The PLC consists of approximately 65 acres of developed and undeveloped real estate. All 65 acres are
used both for building improvements and outdoor classroom areas.
The PLC's concerns are that USR 1778 application, if granted, will create risks to one of only three bald
eagle nests along the entire run of the Cache la Poudre River and will irreparably damage the surrounding
environment. These impacts and risks include, but are not limited to, the following:
a) destruction of wildlife habitat, key wildlife nurseries and wildlife viewing opportunities, impact
to key bald eagle nesting location;
b) degradation of Sebring Reservoir's East Lake's eastern shore line which is owned by the City of
Greeley and operated as the PLC
c) Introduction of aquatic nuisance species to the Sebring Reservoir Augmentation System would
completely shut down the operation.
d) The proposed RV operation is directly incompatible with the existing and future uses of the
existing Poudre Learning Center property.
e) Should this application be awarded a permit and expected to follow through on his own
application commitments when for the past two years he has unashamedly operated his
"recreational facility" in violation without a permit?
With nearly 14,000 number of visitors annually (not including school district maintenance and
educational personnel) - many of whom will use the areas from sunrise to sunset are in close proximity to
the proposed RV facility. The proposed operation is directly incompatible with the existing and future
uses of the Learning Center property.
DESTRUCTION OF WILDLIFE
Loss of habitat for waterfowl, wildlife, and fish - is home to a variety of animal life, including raccoons, deer,
coyotes, eagles, herons, owls, and an incredible variety of migrating birds. The Poudre River and the Siebring
Reservoir provide major flyway habitats for all types of waterfowl and fishing opportunities.
In his continued violation of Weld County regulations, the applicant has place over 28 colored water skiing
buoys over the weekend (April 30th to May 1'2011). The buoys are colored green, red and yellow; both yellow
and red are alarm colors for the eagles.

• DEGRADATION OF SEBRING RESERVOIR'S
Increase in sewage potentially causing water pollution. Who will monitor the pollution?
Sewage Disposal- RVs, campsites. (According to the map in the application, most of the 50 sites are in located in
the 100 flood plain areas- it will be impossible to keep all sewage out of the reservoir and river.
And what assurances and checks does the County have to make sure that this facility would keep all sewage out
of the Sebring Reservoir and Poudre River? Fuel leakage from boats and direct human waste, (urine, feces,
trash into Sebring Reservoir at the boat ramps, all have been observed by the CCWCD and PLC Staff members.
Did the applicant get the required permits for building the existing docks, RVs, and piers?
We are also concerned about the leakage of human waste from the holding tanks of boats in the marina and
recreational vehicles in the campground.This especially concerns us with the large number of school age
children in both the reservoir and river and we are worried that this leakage will spread disease causing bacteria
that will cause harm to the students we are assigned to protect.
The more boats,the more filling of gas tanks will occur on the lakes the more chance of an accidental spill and
further destruction of the water life in the area. The increase in boating traffic would no doubt increase the
potential for petroleum products to become introduced to the water. Boaters,jet-skiers, speed-boat skiers, and
fishermen, pollute the quiet environment of the area with their litter, their gasoline secretions. Not only is it
taking homes away from the wildlife,the excess gas and oil that will go into the river will ruin the fish
population.
• The extra boating traffic will leave wakes that will wreak havoc with the banks, shoreline and surrounding slurry
wall.The erosion will be much worse than it is now. This year repairs totally over$40,000 were made by
CCWCD to the eastern shoreline (owned by the City of Greeley and leased to the PLC) of the Sebring Reservoirs'
east shore line caused by the severe erosion by the water skiing boats making sharp turn in such a small area.
The boating caused erosion came dangerously close to damaging the bentonite slurry, which is the key structure
to providing water storage capabilities of the reservoir. Potential for erosion of the soil as trees are cut and
sites developed. If rip rap had to be used to control erosion, it would be unsightly and not in keeping with the
present shorelines.The design of the lake shore slope is too steep for waterskiing to occur safely.

The PLC has over 14,000 students visit the site each year. Many of these student visitors have voiced ,
alarm by the proposed use of such a valuable wildlife habitat. This is an excerpt from a flyer written by
a Greeley HS Student.
The eagles by the Poudre Learning Center are in danger of losing their home...and their habitat. The
area around the Poudre Learning Center had been rehabilitated to its natural look before farming and
rock quarries took over. Now, two bald eagles make their nest there, raising one or two babies a year.
But that's something that could be about to change. The private land owners around the center want
to turn the lakes the eagles depend on into a recreational area. Boats, fishing, and hunting will be
allowed. The food, prairie dogs, that the eagles depend on will be hunted and forced away. Noise will
scare the birds. And the stench from the port-a-potties they would install? Horrible. These birds are
an important part to the fragile eco-system. Please sign the petition to save the Poudre Learning
center and the eagles that nest there! Over 400 concerned citizens have signed our petition in less
than 48 hours.
In the last week, the city has experienced a similar situation with the heron rookery near 59th Ave.
Because of a lack of planning and understanding of our urban ecosystem, we have lost another
valuable asset in our community. The Weld County Planning Commission has the opportunity to make
the right decision to protect this gemstone of great natural and economic value. The county has been
a founding member in the development of the Poudre River Trail. Through the county and their
partners' incredible and persistent efforts, the trail is completed. A trail head is located at the PLC,
which is near to the very center of the trail with Signature Bluff located a half mile to the east and
Shark tooth in view to the west. Use of the trail by area residence has increase each year. But now we •
are seeing users come from literally around the world to stop to hike through a short grass prairie and
a wonderful riparian area filled with wide range of wildlife. We see birders come from the Denver
area just to see the nesting and forging Bald eagles. This location is now on the list of"must sees"
right along with the Pawnee Buttes and Rocky Mountain National Park.
SECURITY CONCERNS
The applicant did not have any method or offer any comments on the security of the proposed RV Park which
will allow virtually large number of strangers easy access to our site during evening hours.
Potential for prairie fires caused by careless campers- people would be spending the evening hours around
camp fires.This leaves us with an uneasy feeling as to the safety of the PLC.
We have yet to experience ANY vandalism at the PLC in our 7 years of existence; will this continue with the new
influx of boater, hunters and campers?
Now the County is being asked to allow someone build a "RV and Tent town" community with no security
whatever in among all these mobile residences?
Will the County Sherriff's office patrol the area? Anytime you have a recreational area like that it attracts not
only positive but also negative attention such things as alcohol, drugs and the crimes that go with them. Is
County Law Enforcement willing to put on the extra help to take care of this problem?

• AQUATIC NUISANCE SPECIES
Aquatic hitchhikers can spread in many ways such as on aquatic plants fragments, mud on the vehicles, on
boats and other recreational equipment, and in water.There are a few simple actions you can take to prevent
them from spreading, but who will enforce these measures?
MANAGEMENT PLAN
The applicant's management plan states that only one boat will be allowed on the each section of the reservoir
at a time.That equals 3 high powered boats screaming their loud music and loud engines under the eagles' nest
and habitats at the same time.
The historic use of boats on the reservoir has been by the Hall Family, the previous owners of the property and
the donors of the PLC site to the area school districts. The Halls use was very private and for family only. There
was no overnight camping and all activity was only on the west side of the reservoir. The majority of the use
was one boat that was used primarily during the months of July and August.
The eagles were at the site first and have been nesting at this same spot for the last 18 years producing over 20
eaglets.
CONCLUSION
The Weld County Commissioners have operated on "Faith and Trust" that the landowner, leasee and members
will follow through on their agreements and management plan, But in this case we have evidence to the
contrary during the applicant previous years he has been in violation at this site.The applicant has displayed
• blatant disregard for the county's rules and regulations and respect for this recovering ecosystem. It's time we
started protecting the environment in which live in a serious thoughtful way.
The Poudre Learning Center is a place that the citizens of Northern Colorado built and in which they have a
great deal of pride & ownership, but the pair of bald eagles nesting on the shores of Siebring Reservoir are the
crown jewels in this showcase for Northern Colorado and the birthplace for over 20 eaglets.
As the Founding Director of the PLC and a 26 year resident of Greeley and Weld County, I am requesting that
you not approve USR 1778 application.
WE would all appreciate your support in protecting this incredible asset for the place we all call HOME.

EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT made and entered into this 13th
day of MARCH , 1991, by and between MALL-IRWIN
CONSTRUCTION CO., a Colorado Corporation, P. O. Box 659,
Greeley, CO 80632, hereafter referred to as "Grantor, " and the
CENTRAL COLORADO WATER CONSERVANCY DISTRICT, 3209 West 28th
Street, Greeley, CO 80631, hereafter referred to as "Grantee."
WITNESSETH:
WHEREAS, Grantor owns the property described on "Exhibit
A," hereafter known as "the Property."
WHEREAS, Grantor has sold 48 shares of the W. R. Jones
Ditch, changed in Case No. 88-CW-127, Water Division No. 1,
the Lucky Lakes George Decree therein, and the right to store
water in the gravel pit lakes upon the property to Grantee;
and
WHEREAS, Grantor has agreed to provide Grantee the
easements necessary for operation and use of the lakes.
NOW, THEREFORE, in consideration of the mutual covenants
• and promises of the parties hereto, it is agreed as follows:
STORAGE EASEMENT
A. Grantor hereby conveys to Grantee an easement for
storage and detention of water in the gravel pit lakes upon
the property hereafter collectively known as "Lucky Lakes
George, " in the locations designated on the Herbst Special
Review Permit Plan, recorded in Book 1253 , at Reception No.
02202413, in the office of the Weld County Clerk and Recorder,
together with an easement for such pumps as Grantee deems
necessary.
B. The exact dimensions of the high water line of the
lakes and the locations of such pumps shall be surveyed at
Grantee's cost within six (6) months of the time the excava-
tion of all the lakes is completed and the lakes are all
filled to capacity. The boundary of the Storage Easement
shall be a line fifteen (15) feet above the high water line
surveyed but, in no event, shall the Storage Easement ever
extend beyond the bentonite slurry wall to be built by Grantor
under an Agreement with Grantee dated May 15, 1990.
C. This Storage Easement is personal to Grantee; i.e. ,
Grantee shall not be permitted to allow other persons or
• entities to use such Storage Easement without Grantor's
consent.

• D. During excavation, mining and reclamation, Grantor
shall be responsible for maintenance of the Storage Easement.
Upon completion of each lake, Grantee shall assume exclusive
responsibility for maintenance of that portion of the storage
Easement and shall , at all times, maintain Lucky Lakes George
in a good and safe condition and comply with all federal ,
state and local laws, rules and regulations with regard to
same.
E. The Storage Easement conveyed by this Agreement
shall be for use of the property and detention of water and
does not convey the right to change the appearance of the
property. It is anticipated that Grantee may find it neces-
sary to alter the appearance of the shoreline to prevent
erosion. No such alterations shall be made without the
express written consent of the Grantor which shall not be
unreasonably withheld. In determining whether Grantor is
being unreasonable, it should be understood that Grantor
anticipates developing properties around Lucky Lakes George
into residential or commercial uses. Accordingly, aesthetics
will be important to Grantor and the appearance of such
erosion-preventing materials will be considered. Poured and
placed concrete and/or rock used as rip rap are hereby
specifically authorized to prevent such erosion so long as
placed in an aesthetically harmonious fashion. Broken
• concrete or other salvage materials shall not be used as rip
rap for prevention of erosion around the lakes.
II
DITCH, INLET AND OUTLET EASEMENTS
A. Grantor hereby conveys to Grantee an easement for
a ditch from the W. R. Jones Ditch to the Cache la Poudre
River along the west side of the property, east of Weld County
Road 25, fifteen feet (15 ' ) in width for the purpose of
delivering water directly to the Cache la Poudre River.
Grantee shall have the right to install such regulation or
measuring devices as needed. This easement shall be con-
structed and surveyed within one (1) year of the date of this
Easement Agreement at Grantee ' s cost.
B. Grantor hereby conveys to Grantee an easement for
an inlet to Lucky Lakes George; i.e, the storage facility
described in Section I , above, which shall be no wider than
fifty feet (50 ' ) and shall be in a location that directly
connects Lucky Lakes George to the W. R. Jones Ditch.
C. Grantor further hereby conveys to Grantee an
easement for three outlets from Lucky Lakes George to the
Cache la Poudre River in locations to be selected by Grantee,
each of which shall be no wider than fifty feet (50 ' ) .

D. The above-described inlet and outlets shall be built
within one (1) year of the date of completion of the excava-
tion of the lakes and shall be surveyed within six (6) months
after actual construction of such inlets and outlets. All
property not included within the exact legal description of
such inlets and outlets shall be released back to Grantor and
no longer be a part of this Easement Agreement.
E. Operation and maintenance of the ditch, inlet and
outlets described above shall be the responsibility of
Grantee. All Ditch, Inlet and Outlet Easements shall be
maintained according to federal , state and local regulations.
F. This Easement is personal to Grantee; i.e. , Grantee
shall not be permitted to allow other persons or entities to
use the Easement without Grantor 's consent.
III
INGRESS AND EGRESS EASEMENTS
A. Grantor hereby conveys to Grantee for purposes only
of operation, installation, maintenance, repair, and replace-
ment of all or a portion of the lakes or associated facili-
• ties, easements for ingress and egress to Lucky Lakes George
in the locations specifically described as follows:
(1) A road twenty feet (20 ' ) in width along the Cache
la Poudre River between the Jones Ditch and the Cache la
Poudre River.
(2) A road twenty feet (20 ' ) in width along the entire
length of the eastern border of the Property.
(3) A road twenty feet (20 ' ) in width around the
perimeter of Lucky Lakes George, the centerline of which
shall be constructed by Grantee over the bentonite slurry
wall to be constructed by Grantor pursuant to an Agree-
ment for same, dated May 15, 1990.
B. The exact location of roads described above shall
be agreed between Grantor and Grantee and shall be installed
and maintained by Grantee. The above-described roads shall
be built within one (1) year after completion of the bentonite
slurry wall and the surveys completed within six (6) months
after actual construction of such roads. All property not
included within the exact legal description of such roads
shall be released back to Grantor and no longer be a part of
this Easement Agreement.

• C. The access easements conveyed by this Agreement are
nonexclusive; i.e. , Grantor may use such roads or may license
or grant easements to other individuals to use such roads.
D. Grantee, for its own use only, may use such road
easements for the purpose of installing utilities necessary
to operate the storage facility; e.g. , electric lines to
Grantee's pumps. All such utilities shall be buried at least
thirty-six inches (36") under such roads .
E. Grantee shall not permit the use of such roads by
other persons or entities and shall not use such roads itself
except for the exclusive purposes described in Paragraph IIIA,
above.
IV
GENERAL CONSIDERATIONS APPLICABLE TO ALL EASEMENTS
CONVEYED BY THIS AGREEMENT
A. Grantor hereby retains the right to all recreational
uses of the land and water surface including hunting, fishing,
swimming and boating and retains the right to all other uses
of the land and water surface not inconsistent with the
Easement granted to Grantee. In no event, however, shall
• Grantee be required to maintain and raise or lower the water
level in any of the lakes to accommodate Grantor' s uses. Each
party shall be liable for its own acts and negligence.
Grantee does not, in any manner, waive any of its rights under
the Governmental Immunity Act.
B. All easements conveyed by this Agreement shall
terminate when the Storage Easement is not used to store W.
R. Jones Ditch Water or to store water, decreed to Lucky Lakes
George per the Decree in Weld County District Court Case
Number 88-CW-127, for ten (10) consecutive years.
C. The Easements granted by this Agreement are personal
to the Grantee and shall not be conveyed or assigned to any
other person or entity without Grantor ' s written approval ,
which shall not be unreasonably withheld.
D. This Easement Agreement represents the complete
agreement of the parties and no oral modification shall be
effective. Any amendments or additions to the Easement
Agreement shall be made in writing and shall be signed by the
parties hereto.
E. Grantee shall not install any fences on the Property
or within any easements described herein without the express
written consent of Grantor.

• F. The Easements conveyed by this Easement Agreement
are expressly conditioned upon the bentonite slurry wall being
actually built by Grantor pursuant to the Agreement with
Grantee for construction of same dated May 15, 1990. If such
bentonite slurry wall is not constructed, such Easements shall
not be effective.
G. This Agreement is binding upon the parties, their
successors and assigns.
IN WITNESS WHEREOF, Grantor has caused this Easement
Agreement to be executed by an officer of the company and the
Grantee has caused this Easement Agreement to be executed by
its President and attested by its Secretary.

The Weld RE-4 Windsor Severance School District recently submitted a letter of impact for the
recorded exemption USR-1778. This recommendation is based on District policies and impacts on
school buildings, anticipated new student enrollment and the ability to accommodate new student
enrollment.
On behalf of the students of Weld Re-4 Schools, this letter is being submitted regarding specific details
of USR-1778 that impacts the Poudre Learning Center (PLC) adjacent to the proposed site development
plan. This learning center is the result of a cooperative effort by the Greeley, Eaton, Johnstown-
. Milliken, and Windsor-Severance School Districts to provide the environment for students to achieve
core content standards mastery through authentic learning. Thousands of students receive instruction at
the Poudre Learning Center.
The proposed facility would have a significant impact on the safety and well-being of students with
commercial hunting in the adjacent area. For obvious safety reasons, students would not be able to
attend the PLC during hunting seasons which then impacts the availability of time to access the center
for students.
In addition, with the proposed water skiing aspect, the overall environment and habitat for wildlife will
be impacted at the PLC. The noise factor from the boats as well as erosion of the Siebring Reservoir
caused by increased wave action along with potential damage to the north-south road on the PLC
property will complicate learning activities. Observing wildlife and learning about the outdoors in a
natural environment will be negatively impacted for students.
Please give this proposal serious deliberation regarding the safety concerns as well as negative
educational implications for the thousands of children who attend the Poudre Learning Center.

Recreational use of the property we called the Herbst property occurred during the time
Hall-Irwin Corporation owned the property. This included boating,fishing, picnicking,
hiking,nature photography and bird watching. These uses occurred before and after the
bald eagles began using the property as a nesting site,until the sale of the property in
2007.
