RESOLUTION RE: APPROVAL OF SECOND AMENDED RECORDED EXEMPTION #3466 - CAROL L. KUIPERS LIVING TRUST WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the request for Second Amended Recorded Exemption#3466 was submitted by the Carol L. Kuipers Living Trust, P.O. Box 185, Fort Lupton, Colorado 80621, do Todd Hodges Design, LLC, 1269 North Cleveland Avenue, Loveland, Colorado 80537, for property which is located on the following described real estate, to-wit: Lot C of Recorded Exemption #3466; being part of the N1/2 of Section 12, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Second Amended Recorded Exemption#3466, does not come within the purview of the definition of the terms "subdivision" and "subdivided land," and WHEREAS,this request is to divide the property into parcels estimated to be approximately 120 acres and 60 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,exempt from the definition of the terms "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that the application of Carol L. Kuipers Living Trust for Second Amended Recorded Exemption#3466 be, and hereby is, approved subject to the following conditions: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. The applicant has proposed a well as the source of adequate water for Lot C. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic Use Only,"etcetera. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. 4. Items to be included on the plat: A. The plat shall be titled: 2nd Amended Recorded Exemption No. 1311-12-2 2ndAMRE-3466. B. The proposed future alignment of County Road 24 connects to County Road 22, as shown in Alternative 3A, Figure 7, Page 12 of the Weld County Road 24 Corridor Study, dated November, 2008. Please show and delineate the approximate future alignment on the plat. The future right-of-way for this alignment is 140 feet. Structures must be set back from the future right-of-way, per Section 23-1-90 of the Weld County Code. C. Lot C of 2nd AMRE-3466 shall utilize the existing accesses to the property. If, in the future, the proposed new alignment for County Road 24 is constructed, then the accesses will be reviewed and new accesses may be granted. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert they shall contact the Weld County Department of Public Works to adequately size the culvert. E. County Road 23 is designated on the Weld County Road Classification Plan as a collector road, which requires eighty (80) feet of right-of-way at full buildout. There is presently sixty (60) feet of right-of-way. An additional ten (10) feet shall be delineated on the plat as future County Road 23 right-of-way. All setbacks shall be measured from the edge of future right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. 5. The following notes shall be placed on the plat: A. All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code,the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F,H, I, M, and R in Section 302.1 of the 2006 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 2011-0563 RE3466 B. Any future structures or uses on the site must obtain the appropriate zoning and building permits. C. WARNING: LOTS MAY NOT BE ABLE TO OBTAIN BUILDING PERMITS DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Lot C may not be able to obtain building permits to construct structures. All construction or improvements occurring in the floodplain, as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Maps #080266-0860C and #080266- 0866C, dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3,of the Weld County Code, all applicable Colorado Water Conservation Board floodplain regulations, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. D. Flood Hazard Development Permits showing the location of the floodway and the impacts of the project on the 100-year water surface elevation will be required for development activities located within the FEMA mapped South Platte River Floodplain. E. The installation of any septic system within the 100-year floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. F. Prior to the release of building permits,the applicant shall submit a recorded deed describing the lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the lot designation and Amended Recorded Exemption number. G. Prior to the release of building permits,the applicant shall submit evidence to the Department of Planning Services that Lot C has an adequate water supply of sufficient quality, quantity, and dependability. H. Prior to the release of building permits,the applicant shall submit evidence of approval from the Fort Lupton Fire Protection District to the Weld County Department of Building Inspection. Potential purchasers shall be made aware that Lot C may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. J. Potential purchasers shall be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically thereafter. K. Potential purchasers shall be made aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non-buildable if the lot owner is unable to obtain a 2011-0563 RE3466 well permit. The Colorado Division of Water Resources issues all well permits. L. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. M. Recorded Exemptions on adjacent properties may raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. N. Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Agricultural Exempt Building, per the requirements of Sections 29-1-20 and 29-3-20.B.13 of the Weld County Code, do not need building permits; however, a Certificate of Compliance must be filed with the Department of Planning Services and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. O. Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers for permits, pursuant to Section 404 of the Clean Water Act. P. Effective January 1, 2003, building permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Fee Impact Program. Q. Effective August 1, 2005, building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee Programs. R. Potential purchasers are hereby notified that a Confined Animal Feeding Operation (SUP-209 Dairy) is located directly west of the intersection of County Roads 22 and 23. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens; and odors from animal confinement, silage, and manure. S. The future alignment of County Road 24 is a conceptual alignment and may be adjusted at the time of final design to accommodate site or construction constraints. 2011-0563 RE3466 T. Prior to the release of building permits on Lot C,the lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400) feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. U. Lot C of 2nd AMRE-3466 is less than 120 acres and therefore is not eligible for a 3-lot or 4-lot Recorded Exemption, per Sections 24-8-20.C.2 and 24-8-20.C.3 of the Weld County Code. V. The Weld County Right to Farm Statement, as it appears in Section 22-2-20.J.2 of the Weld County Code, shall be placed on the plat. 6. The applicant shall submit two(2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 7. In accordance with Weld County Code Ordinance#2005-7, approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date of the Board of County Commissioners Resolution a $50.00 recording continuance charge may be added for each additional three (3) month period. 8. Weld County, Colorado PARCEL NUMBER:1311 12 200039 PARCEL SIZE: +/- 120 acres (before) +/-60 acres (after) ZONE DISTRICT: Agricultural WATER SOURCE: Proposed Well SEWER SOURCE: Proposed Septic system The Department of Planning Services' staff has reviewed this request and recommends that this request be denied for the following reasons: It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with the following criteria as listed in Section 24-8-20 of the Weld County Code: A) In 2003 when the applicant first applied for RE-3466 the Weld County Code stated, "The three-lot recorded exemption application shall include the total contiguous land ownership equal to no less than 160 acres or is a parcel otherwise recognized as a complete quarter section. Two (2) of the proposed parcels shall be less than 35 acres in size and the third parcel must be a least 120 aces in size." Currently Section 24-8-20.C.2 of the Weld County Code states, "A three-lot recorded exemption application may be submitted when contiguous land ownership equals a minimum of one hundred twenty-two (122) acres. Remaining contiguous property must be included unless the remaining parcel equals at least eighty (80) acres; is a parcel otherwise recognized as a complete half of a quarter section; is a lot of an existing recorded exemption; or is a parcel created prior to the initiation of subdivision regulations. Two (2)of the proposed parcels shall be less than thirty-five (35) acres in size, and the third parcel must be at least one hundred twenty (120) acres in size." 2011-0563 The Weld County Code allows a three lot recorded exemption when the third parcel is at least 120 aces in size. The applicant is proposing to reduce Lot C to 60 acres in size. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 22) Lot C of god AMRE-3466 is less than 120 acres and therefore is not eligible for a 3-lot or 4-lot Recorded Exemption per Section 24-8-20.C.2 and 24-8-20.C.3 of the Weld County Code. 23) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved"out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 6. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. ID • Summary of Kuipers Trust/Bennett Transaction, Intent, and Goals The subject property was originally owned by Carole L. Kuipers and since her passing is held by the Carole L. Kuipers Living Trust. Kuipers divided the property and sold Lot "B" to Tom & Stephanie Bennett, together with 2 shares of Meadow Island #1 Irrigation Company shares. The Bennetts intended to someday construct a home and develop a small lake by leasing the gravel mining rights. Over time it has become evident that the best way to accomplish their mutual goals would be a sale of the water rights to City of Aurora. To that end, the parties have structured a deal and placed under contract their cumulative shares of Meadow Island #1 with City of Aurora. Kuipers holds 17 shares, Bennetts hold 2 shares. In keeping with their original goals and to balance the transaction between the parties, Kuipers will receive all proceeds from the water sale in order to obtain the necessary dry-up acres from the Bennett parcel and will exchange approximately 60 acres to Bennett. The proposed Amended Recorded Exemptions submitted by Todd Hodges Design will re-configure the lots between these 2 neighbors to accomplish their mutual goals. Bennetts want the additional land to continue the existing farming operation and their future intended gravel operation and Kuipers wants the proceeds from the water sale and be left with a remaining legal lot. This change essentially amounts to an internal lot line change between 2 neighbors to accomplish their mutual goals. No new lots or new accesses are created by the change. More importantly, the reconfiguration much better accommodates the ongoing farming operation as well as. the anticipated gravel project. In addition, these land owners have now been burdened with a future planned route of the extension of WCR 24. The final selected route was not what these owners wanted, but now are subject to that extension as set forth in a Weld County Commissioners Resolution. Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: WCR 23 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. There is a proposed future alignment of WCR 24 connecting to WCR 22 that runs through this property. WCR 24 is an arterial road, which requires a 140-foot right-of-way at full build out. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right- of-way line. Lot C of 2n°AmRE-3466 and Lot B of AmRE-4439 are located within the FEMA mapped Zone A 100-Year Floodplain and possibly the floodway. Weld County Code prohibits the construction of buildings within the floodway. A Flood Hazard Development Permit (FHDP) is not required for agricultural activities. However, at such time as the owner proposes to construct any type of building, place fill, or conduct mining operations within the FEMA designated floodplain, a FHDP will be required showing the impact of the proposed activity on the floodplain and that the proposed activity is not located within the floodway (Planning Policy No. 2010-07). Additionally, the FHDP application must show that the development activity is in compliance with all floodplain regulations in effect at the time of application. REQUIREMENTS: 1. Lots B & C shall share an access. The existing access to Lot C must be permanently closed and photographic evidence of the closure must be submitted to the Public Works Department. After the existing access is closed, the applicant may open a new shared access for Lot B of AmRE-4439 and Lot C of 2n°AmRE-3466. If, in the future, the proposed new alignment for WCR 24 is constructed then the accesses will be reviewed and new accesses may be granted. 2. The proposed future alignment of WCR 24 connects to WCR 22 as shown in Alternative 3A, Figure 7, Page 12 of the Weld County Road 24 Corridor Study dated November 2008. Please show and reserve the approximate future alignment on the plat. The future Right-Of-Way for this alignment is 140 feet. Structures must be set back per Weld County Code 23-1-90 from the future Right-Of-Way. 3. Please contact Public Works to discuss the possibility of adjusting the proposed lot lines to follow the future alignment of WCR 24. 4. Add the following note to the Plat: a. The future alignment of WCR 24 is a conceptual alignment and may be adjusted at the time of final design to accommodate site or construction constraints. 5. Building envelopes for each Lot will need to be shown on the plat and a Flood Hazard Development Permit will need to be submitted in accordance with Planning Policy No. 2010-07 for the building envelopes if they are shown in the floodplain.
