RE: ACTION OF THE BOARD CONCERNING ZCV #1100011 AGAINST ROBER DEVOE
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Robert Devoe, ZCV #1100011, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of June, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the
matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1100011 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of June, A.D., 2011.

VIOLATION REMEDY:
As we have previously discussed over the phone, the storage of COMMERCIAL VEHICLES and/or operation of a
commercial trucking operation requires a Use by Special Review(USR) permit. My records indicate that you
met with Chris Gathman, Planner on April 8, 2011. During that meeting, Chris explained the Use by Special
Review(USR)application. To avoid the above scheduled Violation Hearing for June, I would recommend the
USR application be assembled and 4 packets be submitted to the Department of Planning Services by May 27,
2011. Planning Department Staff will review your packets and respond within 7 working days outlining any
missing paperwork or necessary corrections. The remaining packets and any other requirements as outlined in
Staffs follow up 7 Day Completeness Review memorandum and fees shall be submitted prior to the hearing in
order to cancel the Violation Hearing. If you are unable to meet this timeline, I recommend you or a
representative attend the June 14th Violation Hearing to request additional time from the Board of County
Commissioners.

My superiors contacted me this moming regarding a few changes to
the narrative.
1. My initial count included all vehicles Devoe Contracting owns
(including personal and WY vehicles), the new narrative expresses
the true number of vehicles that operate strictly in Colorado from the
Kersey location.
2. All employees are dispatched from the Kersey yard and return
only for maintenance or necessary pickups or maintenance.
I apologize for the inaccuracy of the previous narrative and have
attached an accurate description. If you can respond and confirm
that you have indeed received the corrected narrative I would be very

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews
are required prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public
Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in
the Greeley office. To be on the pre-submittal agenda, the request and required checklist items must
