RE: ACTION OF THE BOARD CONCERNING ZCV #1100053 AGAINST ABELARDO AND
NANCY VEGA FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Abelardo and Nancy Vega, ZCV #1100053, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of June, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Nancy Vega, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until July 14, 2011, to allow time for the property owner to remove the
remaining debris from the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1100053 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Abelardo and Nancy Vega to remedy the violation of
the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until July 14, 2011, to allow time for the
property owner to remove the remaining debris from the property.

As I indicate in my initial letter, my records indicate a building was constructed in the last couple of years.
Furthermore, it appears this building was constructed within the flood plain, please speak with Public Works to
determine if a Flood Hazard Development Permit is required. Additionally, I noted an area showing visible
burning (I will forward this aspect to Phil Brewer with the Air Quality Control Division). I also noted an area of
waste, trash and miscellaneous debris. These items shall be removed. Lastly, it has been brought to my

OTHER CASE HISTORY:
04/25/2011 Office visit Jorge Vega came to the Greeley Planning Office on a completely
unrelated violation. I explained this property was scheduled for a
Violation Hearing on May 10, 2011. He said the renters (who run the
auto sales)were supposed to submit all necessary applications. He
said haven't they. I said no. He then said, well I'm really not too
involved with this property. I said can you pass the word along about
the hearing. He said he would.
05/10/2011 Hearing notes Nancy Vega attended the Violation Hearing for another property they
own. I advised her of this case and asked her to call the office.
05/31/2011 Phone call Nancy Vega called (302-9363). We discussed the violation again. I
also directed her to call Clay Kimmi with Public Works. We
discussed the Violation Hearing for June 14, 2011. She called back
later and left a voice mail stating she had more questions. I left a
voice mail for her asking her to call when she was available.

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews •
are required prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public
Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in
the Greeley office. To be on the pre-submittal agenda, the request and required checklist items must

Bethany,
I responded to a call today from a lady named == `- She called about a loud party at
the large barn located at the intersection of Fern Ave and Last 12S_.street. i aealt with the loud party issue, but she feels
they are operating a business, and renting the facility for parties, etc. She had questions about zoning permits and if
they have to have any other licenses for renting the facility out. I found out that the facility is called La Aguilar, and is
owned by Abel Vega or his Dad. Ironically I later took an assault call that occurred at 1711 East 16th Street which is yet
another barn that is owned by the same family. It appears they are renting both facilities out on the weekends for very
large parties. I am not sure what you can do with this on your end, but I know my original Reporting Party would like to
talk to you or someone from your office about this.
Let me know what kind of issues if any you would have on your end. I would like to be better educated when people call
about these facilities.
