O,' ,u 785C7 RecordedaP o'clock M OEC RESOLUTION a -1 WHEREAS, a public hearing was held on May 12, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing a petition of Douglas Sears (Westridge-Fifth) 818 12th Street, Greeley, Colorado, requesting a change of zone from "A" Agricultural District to "E" Estates District, Planned Unit Development, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of petitioner and studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Douglas Sears (Westridge-Fifth) 818 12th Street, Greeley, Colorado, for change of zone from "A" Agricultural District to "E" Estates District, Planned Unit Development, said area being more particularly described as follows: That portion of the Southwest Quarter of Section 16, Township 5 North, Range 66 West of the 6th Principal Meridian, County of Weld, State of Colorado, more particularly described as follows: Considering the South line of said Southwest Quarter as bearing West and also the West line of said Southwest Quarter as bear- ing North 0°03'02" West with all bearings contained herein relative thereto. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning regulations of Weld County, Colorado. 3. That said change of zone herein granted is conditional only for a period of twelve (12) months from date hereof, on condition that developer proceed with due diligence to begin development of the area rezoned and submit plans for such development for the approval of the Weld County Planning Commission and subsequent recording of said plans in the office of the County Clerk and Recorder of Weld County, Colorado; and that major construction shall commence thereon within said twelve (12) month period; otherwise, the County may take action to rezone the property to its present classification. Exhibit "A" WESTRIDGE FIFTH FILING SUBSURFACE WATER INVESTIGATION Purpose The purpose of this report is to determine the degree to which the proposed underdrain storm system designed for will affect the lowering and stablizing of subsurface ground water on the Westrige Fifth Filing. Upon initiation of procedures to subdivide this tract of land, initial soils investigations were undertaken. The results of the soils investigations have been previously - submitted to the Weld County Planning Staff for review. That ground water report indicated a high ground water level in various parts of the proposed subdivision. It, also, indicated that the types of soils would allow ground water to flow through them. Based on these two determinations, a subsurface drainage system was designed to collect the subsurface ground water and transmit it to a retention pond at the low point in the subdivision located in the North- west corner of the tract. 1 Upon review of this subsurface drainage system by the County Engineer and the County Health Department, there was concern expressed for the effectiveness of this underdrain system. Therefore, this investigation was undertaken to deter- mine the effectiveness of the ground water system to substantially lower and stablized ground water system. Procedure The procedure used to determine the degree to which ground water would be transmitted through the subsurface soils is as follows: 1 . Two observation holes were dug for recording of the level of the ground water in the holes. (See Exhibit 1 ) A "T" trench was dug to a depth sufficiently below the bottom of the two observation holes such that upon pumping the ground water in the "T" trench there would be a positive gradiant between the observation holes and the "T" trench. The intent of this was to allow the ground water in the observation holes to pass through the soils between the observation holes and the "T" trench. This would allow observation of the effective change in level of the water in the observation holes. 2. The holes and the trench were dug on Friday, January 10, 1975. The ground water was allowed to stablize to a static elevation over the weekend. Stakes were driven into the side of the bank of the holes from which the water level elevation could be measured. The water level was recorded on January 13, and recordings were continued for four days and the ground water level was observed as indicated in the tabulation shown below. It was assumed that stop- ping the pumps possibly led to the retarding of the lowering of the ground water level and the measurements were discontinued for a time. 3. It was arranged through Hall-Irwin Construction Company to have continu- ous pumping for 30-36 hours. This was arranged on February 19. The initial water reading was taken and recordings were observed periodically as shown on the tabulation shown below. It is our conclusion that the subsurface drain- age system, as designed for this project, will significantly effect the existing ground water level in this tract to the extent that septic tank installations can be installed in compliance with Weld County regulations. The intent of the under- ground drainage system, as designed for this subdivision, is to provide a means for the subsurface water to be transmitted through the soils to the retention pond as noted above. This system, in order to be effective, should have two requirements: 1 . That each lot have its own system of underground drainage and footing drains connected to a point on the drainage system designed for this project. 2. That regular observation of effectiveness and periodic maintenance of the system be carries on by the effected lot owners. * NOTE: Elevations shown for water level observation are relative elevations. This recommendation is based on the following points : 1 . The Greeley Comprehensive Plan indicates that a greenbelt of undetermined width should be provided along the draw which runs generally north and south through the property . 2 . 4 question as to the suitability of the soils in this area for residential development as been raised . The developer should submit a soils study in order to ensure that no problems will exist in the future . 3 . Since there is a possibility of a high water table in this -area, surface drainage and subsurface drainage becomes a critical question . I have been informed that there is possibly an alternative proposed by the develop- er for the subsurface drainage of the area. We recommend that no action be taken until the engineering information for this subsurface drainage is provided , reviewed , and determined to be acceptable . One point is that a cul de sac comes off of the major aterial in the area. The length of the cul de sac is such that one would not be able to determine that it dead ends. It would be much more desirable to have this street tie in as an access street to Westridge Fifth Filing. In addition the half street on the north side of the subdivision could possibly cause some serious problems to the residents if the street is not fully developed prior to occupancy of the dwelling units. 5. The Greeley Water and Sewer Department has indicated that there is sufficient number of taps available to serve nine (9) of the lots within the subdivision . By this letter I wish to advise you that the mattersof the Company Ditch are all but re- solved and should not be a matter of concern . It is myunderstanding that you do not wish to take a planning step that may in some way adversely affect that rights and duties as -related to the Company Ditch .
