RE: ACTION OF THE BOARD CONCERNING BCV #1000072 AGAINST BRET
PETERSEN AND GARY BURKE FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Bret Petersen and Gary Burke, BCV #1000072, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of July, 2011, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Bret Petersen, property owner, and Mark Macklin, tenant, were present at
said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 12, 2011, to allow adequate time for the necessary permit
applications to be submitted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that BCV #1000072 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Bret Petersen and Gary Burke to remedy the violation
of the Weld County Code, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the identified
parties, with an instruction for delay of action upon such referral until August 12, 2011, to allow
adequate time for the necessary permit applications to be submitted.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on July 12, 2011, at 10:00 a.m., to consider the

permit(s) issued, and all inspections completed

Remove all changes, additions, alterations, or repairs and schedule an inspection
to verify the structure is no longer a medical marijuana grow facility.

It has been determined that the property located at 13451 County Road 64 is currently in violation of the following

Residential Lease Agreement
This is an agreement for the leas' of a residential home between Bret Petersen(hereinafter referred to as
the"landlord") and ( 21{ ‘1 c{U a--
individually and jointly(hereinafter referred to as "Tenant"). The paragraphs,which are included in this
Lease,represent the full agreement between the parties unless additional writings between the parties are
signed. The parties acknowledge that the original of this Residential Iaace Agreement shall be held by the
Landlord with each Tenant to receive a copy of this Lease from the Landlord at the time the tenant initially
occupies the premises described herein

S. Securitypeposit. Prior to possession of the premises,the Tenant shall pay a total security deposit of

the Tenant's obligations described in this Lease.Upon the Tenant's default,the Landlord may,but shall both be
obligated to apply all or any portion of the security deposit held by the Landlord to satisfy any of the Tenant's
obligations under this Lease.No Tenant shall have the right to apply the security deposit in payment of the last month's
rent. The balance of any security deposit held by the Landlord shall be refunded to each tenant within sixty (60)days
from the date possession of the premises is delivered to the Landlord;together with a statement showing any charges
made against such deposits by the Landlord The Tenant is hereby notified that the Landlord will deduct from the
security deposit those items which are allowed by Colorado law which include,by way of example but not by way of
limitation,nonpayment of rent,any utility charges,repair work necessary to restore the premises to the same condition it
- was on the date the premises were rented to the Tenant(normal wear and tear excepted),costs of removing Tenant's
personal property,trash or other items,as well as the cost of releasing the property in the event the Tenant moves out
prior to the termination of the Lease.For purposes of this Lease,the termination of the Tenant's possession shall not
occur until the Tenant has completely removed his or her person from the premises as well as all personal property the
Tenant has placed on the premises and has returned all keys to the premises in the Tenant's possession to the Landlord.
6.Assignment and Subletting Each and every Tenant agrees that he/she shall not assign this Lease or sublet any
portion of the premises without the prior written consent of the Landlord. 'the Tenant shall not have any guest on the
premises for a period longer than 48 consecutive hours.Failure of the Tenant to observe this paragraph shall he deemed
an event of default and shall authorize the Landlord to take those actions identified in Paragraph 13 of this Agreement.
7. Pets. No pets shall be brought on the premises any time during the term of this Lease.If the Landlord decides this
will be made negotiable a letter in writing with a description of the pet and/or pets will need to be approved prior to the
pet and/or pets being brought onto the premises.
8 Use. The premises shall be used as a residence only with no more than two(2)persons per room to occupy each room
under the terms of this T ruse•Each Tenant agrees to use the premises for no other purpose without the prior written
consent of the Landlord.Each Tenant further agrees to comply with all statues,ordinances stud requirements of the City
of Greeley,the State of Colorado and federal authorities now in force or which may hereinafter.by adopted pertaining to
the use of the premises.
v. Apartment and house Rules: In the event the premises are a portion of a building containing more than one
apartment or sleeping unit,each%t am agrees to abide by those house rules which are delivered in writing by

any Tenant prematurely abandons or vacates the premises for any reason,including a failure to make a rent payment
when due,the Landlord may consider any property left on the premises to be abandoned and may discard the same in
any manner allowed by Colorado law.In the event the Landlord reasonably believes such abandoned property has no
value,the Landlord may,after inventorying such property,discard it All personal property on the premises owned by
the Tenant who is in default under any terms and conditions of this Lease is hereby subjebted to a lien in favor of the
Landlord for the payment of all sums die hereunder.If the J andlord is required to give the Tenant any notice regarding
abandoned property,said notice shall be given to the forwarding/permanent address of the Tenant which the Tenant has
identified to the Landlord at the time of original possession of this Lease.In the event of a default by Tenant,the
Landlord may elect to:(1)continue the lease in effect and enforce all the Landlord's rights hereunder,including the
right to recover the rent as it becomes due;or(2)at any time,terminate all of each Tenant's rights hereunder and
recover from the Tenant all damages the Landlord may incur by reason of the breach of this lease,either jointly or
collectively,including the cost of recovering the premises and including the remaining rent for the term of the Lease
from each Tenant individually and jointly subject to a reduction for any amount the Landlord is able to receive after the •
re-renting of the property.
14.Attorney's Fees and Enforcement Expenses:In the event the Landlord prevails in any legal action brought by
either party to enforce the terms or conditions of this Lease,the Landlord shall be entitled to all costs incurred in
connection with such action,including reasonable attorney's fees.
15. Waivers and Time.No failure of the Landlord to enforce any term or condition of this Lease shall be deemed a
waiver,now shall acceptance of a partial payment of rent be deemed a waiver of the Landlord's right to the full amount
of rent due.It is agreed between the parties that time is of the essence in this Lease Agreement.
16. Additional Terms and Conditions.
a) If it is decided that no pets are allowed and a pet shows up at the residence,the Landlord has the
authority to enter the residence and remove the pet to the Humane Society.
b) Plumbing clogs due to improper disposal of feminine hygiene products will be charged to the Tenant.
c) It is the responsibility of the Tenant to get renter insurance to cover damage to any personal property at the
residence
d) Upon completion of the Lease,the Tenant agrees to have the cost of carpet cleaning deducted from the
security deposit
