RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL
REVIEW PERMIT #1351 FOR A USE SIMILAR TO A JUNKYARD/SALVAGE YARD
(POLICE IMPOUND LOT) IN THE A (AGRICULTURAL) ZONE DISTRICT - JAMES
WRENFROW/SATURN TOWING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on September 1, 2010, a Show Cause Hearing was conducted to consider
revocation of Use by Special Review Permit#1351 for a Use Similar to a Junkyard/Salvage Yard
(police impound lot) in the A(Agricultural)Zone District, issued to James Wrenfrow/Saturn Towing,
and
WHEREAS, James Wrenfrow, 1672 County Road 11, Erie, Colorado 80516, is the current
owner of the facility located on property being further described as follows:
Part of the S1/2 NW1/4 of Section 25, Township 1
North, Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing of September 1, 2010, the Board deemed it advisable to
continue the matter to September 8, 2010,to allow adequate time to meet publication requirements,
and
WHEREAS,at said hearing of September 8, 2010, after hearing all testimony presented,the
Board deemed it advisable to continue the matter to December 8, 2010, at 10:00 a.m., to allow
adequate time for clarification of the ownership of the property, and then again to January 12,2011,
in order to allow adequate time for staff to make an additional attempt to provide notice to the
property owner, and
WHEREAS, at said hearing on January 12, 2011, the Planning staff advised the Board that
they have received no communications from the property owner,the site remains out of compliance
with established Conditions of Approval and Development Standards, and recommended Use by
Special Review Permit#1351 be revoked, and
WHEREAS, after hearing all testimony provided, the Board deemed it advisable to revoke
Use by Special Review Permit#1351 for a Use Similar to a Junkyard/Salvage Yard(police impound
lot) in the A (Agricultural) Zone District.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that there is adequate cause concerning Use by Special Review Permit#1351,
issued to James Wrenfrow/Saturn Towing, and said permit be, and hereby is, revoked.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 12th day of January, A.D., 2011.

Notice is hereby given that the property listed above, is not in compliance with USR-1354
(Special Use Permit). All conditions of the original permit must be in compliance pursuant
Chapter 23,Article 11(2),Division 4, Section 23-2-270 of the Weld County Code.A probable
cause hearing has been scheduled for August 9, 2010 at 9:00 A.M.
The purpose of this public hearing will be to review case number USR-1351,for compliance
with the Development Standards, as approved by the Board of County Commissioners on
November 26,2001,to determine if probable cause exists to hold a hearing on revocation of
the permits.
Inspection by representatives of this office has determined that you appear to be operating an
illegal household trash disposal site which is not stated as a use permitted under USR 1351
and, therefore, not in compliance with the following Development Standard(s):
•The special review permit is for a use similar to a junkyard/salvage yard(police
impound lot) in the "A" Agricultural Zone District as submitted in the
application materials on file in the Department of Planning Services and subject
to the Development Standards stated herein.

SERVICE,TEAMWORK,INTEGRITY,QUALITY
• If it is determined at the public hearing that there is probable cause that you are not in
compliance with USR-1351, the Board of County Commissioners will schedule a Show
Cause public hearing to consider revocation of the Use by Special Review permit.

Nuisance Condition from Illegal Household Trash Disposal &Notice of Hearing
Dear Mr. Wrenfrow:.
In response to a complaint,your property, located at 1672 Weld County Road I I Weld County, Colorado was
investigated by Troy Swain,an Environmental Health Specialist of this Department on July 21,2010. The
inspection revealed that household trash from your trash hauling routes was being disposed of on your
property. The exposed trash had a strong foul odor and was attracting flies and birds. Trash deposited on this
site allows the attraction, breeding and the emergence of birds, insects,rodents and other disease vectors.
• Conditions observed during the Department's investigation constitute a nuisance and a human health hazard.
The above described conditions constitute a"nuisance"according to the Colorado Revised Statutes. In
accordance with Section 25-1-518 of the Colorado Revised Statutes,you are ordered to abate these conditions
by properly disposing of the trash. Colorado Revised Statute Section 25-1-5 t8 provides the following:
The county or district board of health shall examine all nuisances,Sources of
filth,and causes of sickness,which, in its opinion, may be injurious to the
health of the inhabitants, within its ...,county...,and it shall destroy,remove,
or prevent the same as the case may require.
At a public meeting of the Weld County Board of Commissioners on Monday July 26,2010 at 9:00 A.\1,this
Department will request the Weld County Board of Health to issue an order to abate the above identified
nuisance conditions on your property. Any actions taken to have the nuisance abated and the costs of this
abatement may be assessed against you and the property. Your cresence is requested for this meeting, which
will be held on the first floor of the Centennial Center at 915 10' Street,Greeley,Colorado. If you have any
