Colorado, pursuant to Colorado statute and the Weld County Home

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 13th day of April, 1977,
at the hour of 2 : 00 o' clock p.m. , for the purpose of hearing the

application of Park Land Associates for rezoning from E-Estate
District to A-Agricultural District, the following described
real estate, to-wit:
SEE EXHIBIT "A" ATTACHED
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the change of
zone, and evidence was presented in opposition to the change of
zone upon the aforementioned tract of land, and
WHEREAS , Section 8. 3 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to grant a change
of zone upon the showing by the petitioner of certain facts, and
WHEREAS, the Board of County Commissioners of Weld County
heard all the testimony and statements of those present, has
studied the request of the petitioner and the recommendations of
the Weld County Planning Commission and all of the exhibits and
evidence presented in this matter, and having been fully informed
and satisfied that the request for rezoning complies with the
conditions set out in Section 8. 3 of the Weld County Zoning Res-
olution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of Park Land
Associates (A Trust) 3953 Fuller Court, Boulder, Colorado 80303,
for a change of zone from E-Estate District to A-Agricultural
District on the tract of land as set forth on Exhibit "A" which

point, be, and hereby is granted.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 25th day
of April, A.D. , 1977.

Commissioners for the following reasons :
Section 8.3 of the Weld County Zoning Resolution sets forth the
criteria for reviewing a request for rezoning:
"Requests for rezoning of tracts within Weld County should
be supported by detailed and substantial evidence that such
rezoning is necessary. Recent findings and oral statements
by the petitioners should show very clearly that either the
original zoning was faulty or that changing conditions in
the area now justify a new classification. Without the pre-
sentation of such supporting documentation, the County
Planning Commission should not recommend a change in zoning . . .
There must be definite proof that the area requested for
change has unique characteristics which distinguish it from
surrounding lands and thus, make its rezoning essential . "

The Weld County Planning Commission feels that the applicant
has not met its burden of proof in this request for rezoning.
The applicant has not clearly demonstrated that the rezoning
is essential due to unique characteristics of the area in
question which distinguish it from surrounding lands. The appli-
cant has not demonstrated that the original zoning of this
ground, which is "E" , Estate District , was faulty, nor that
there has been any change of conditions in the area which justify
a new classification of part of an "E" Estate District to "A"
Agriculural District . The Planning Commission feels that such
a change would constitute "spot zoning" and thus be improper,
because it would be granted merely to relieve a particular
property from restrictions of zoning rather than to consider the
general public welfare, as required by the Weld County Zoning
Resolution. Clark v. City of Boulder, 362 P2d 160, 146 Colo. 526
(1961) . The applicant has not shown to the satisfaction of the
Planning Commission that this change of zone for the purpose of
constructing a private airfield is in the best interest, safety
and welfare of the inhabitants of Weld County.

Y Percy Hiatt that the following resolution be intro-
duced for passage by the Weld County Planning Commission :
Be it therefore resolved to recommend denial to the County Commissioners
on Pt. of the Nz of Section 8, TIN, R68W of the 6th P.M. , Weld County,
Colorado for an Agricultural Planned Unit Development for Park Land
Associates for the following reasons :
Section 6. 6. 5 of the Weld County Zoning Resolution, which sets out the
review procedure for unit development plans, provides:
" . . . .before a building permit is granted for a structure which is
a part of a unit development plan, a general plan for the entire
unit development shall be approved by the County Planning Commission
and the Board of County Commissioners who shall be guided in their
review by the ( 1 ) intent of this Zoning Resolution, (2) by the
unique conditions of the land involved, (3) and by the county wide
need for such developments. "
It is the conclusion of the Planning Commission that approval of the
proposed agricultural unit development plan would be contrary to the
intent of the Weld County Zoning Resolution. The initial section of
the Weld County Zoning Resolution, entitled "Purpose", subsection (1) ,
provides that one of the purposes for which zoning was enacted in Weld
County is to protect property values by preventing the placement of
conflicting land uses in the same area. For reasons more fully set out

in its recommendations on the application for a special use
permit, the Weld County Planning Commission finds that the
proposed airport use would conflict with existing agricultural
and residential uses, and thus would lower property values in
the area, contrary to the intent of the Weld County Zoning
Resolution.
The Planning Commission also finds that the applicant has
failed to show any unique condition of the subject property
which justifies approval of the agricultural unit development
plan in this particular site. Some evidence has come before
the Commission which indicates that one unique condition of
the land, the existence of irrigation ditches traversing the
property is inconsistent with the proposed airport use because

Section 3.3.E of the Weld County Zoning Resolution sets out the

with the surrounding area, harmony with the character of the
neighborhood and existing agricultural uses, need for the pro-
posed use, its effect upon the immediate area, its effect on

accompany the application for a special use permit, pro-
vide adequate protection of the health, safety and wel-
fare of the inhabitants of the area and the County. . . .
Description of proposed operation in sufficient detail to
indicate effects of operation in producing air and water
pollution, odor, noise, glare, fire or other safety hazards
and traffic congestion. . . .
Method for supplying water in such a manner as to be ade-
quate in quantity, quality and dependability for the pro-
posed use.
The Planning Commission finds that the proposed airport use is in-
compatible with the existing surrounding residential and agricultural
uses due to the noise which would be generated by aircraft using the
facility. The Commission concludes that the establishment of such a
use would create a public nuisance which would adversely affect the
adjacent Koch dairy farm and would adversely affect residents in the
nearby subdivision of Scott ' s Acres, and possibly those in Westview
Estates and Carmacar Ranchettes. The Planning Commission has receive
letters from surrounding property owners and residents expressing con
cern over these potential negative impacts. For the same reason,
the proposed use could also have an adverse impact on future develop-
ment in the area.
In addition, the applicant has not shown whether it possesses a
sufficient water supply for the maintenance of the proposed turf-
aggregate runway. The applicant has not addressed the question of
maintaining the runway. Ample evidence has been presented of the
limited amount of water available for irrigation within the pro-
posed development. The Planning Commission feels that an inade-
quately maintained runway could be subject to soil erosion, which
could create an adverse impact on the existing agricultural uses
in the area; irrigation ditches.

duced for passage by the Weld County Planning Commission :
Be it therefore resolved to recommend denial to the County Commissioners
on Pt. of Ni of Section 8, T1N, R68W of the 6th P.M. , Weld County, Color
for an Estate Planned Unit Development for Park Land Associates, % Doris
McFeeters, 3953 Fuller Court, Boulder, CO for the following reasons:
Section 6.6. 5 of the Weld County Zoning Resolution, which sets out the
review procedure for unit development plans, provides:
". . . .before a building permit is granted for a structure which is
a part of a unit development plan, a general plan for the entire
unit development shall be approved by the County Planning Commissior
and the Board of County Commissioners who shall be guided in their
review by the (1) intent of this Zoning Resolution, (2) by the unigr
conditions of the land involved, (3) and by the county wide need for
such developments.
The Planning Commission finds that approval of the proposed estate unit
development would be contrary to the intent of the Weld County Zoning
Resolution. The initial section of the Zoning Resolution, entitled
"Purpose", subsection (1) , provides that one of the purposes for which
zoning was adopted in Weld County is to protect property values. For
reasons more fully set out in its recommendations on the application for
approval of the preliminary plan, the Planning Commission feels that the

Re: Park Land Estates
Dear Mrs. Norton:
I have finally had an opportunity to review all of the newest Resolutions
which were adopted by the Planning Commission in connection with the
above matter. I must say the Resolutions certainly are a far cry from
that which you suggested might be included during one of our earlier
telephone conversations. The matter has now reached a proportion which
is out of my control , and the only thing left for us to do is to proceed
to the Commissioners and seek relief at that level . In addition I re-
ceived just recently a copy of another Planning Commission Resolution
which was apparently adopted subsequent to the Resolutions which turn
down the request for the plat. This latter Resolution deals specifically
with the matter of minerals being present on the property owned by Park
Land Estates. I find this newest Resolution to be offensive especially
since it was adopted without giving any prior notice to us.
All in all the matter has proceeded to the point where it will now be
necessary for me to study the possibility of commencing immediate liti-
gation. We of course will proceed to have the Commissioners hear the
matter in hope that their decisions will override the decisions of the
Planning Commission. You can obviously understand our very deep concern
about the matter, especially in light of the fact that the property was
zoned by the County Commissioners, and now everyone is doing everything
in their power to prevent the plat from being approved.
Quite honestly, I am sorry the Planning Commission arrived at the con-
clusions which are expressed in these Resolutions. The entire processes

for this plat were predicated upon a request by the Commissioners in the
first instance, and now we find that all the monies which have been spent
to comply with the requests have been spent for naught.
I have requested that my client proceed to file the forms for a hearing
before the Commissioners, and at the same time, pleadings with respect
to the lawsuit are being prepared. The matter will probably be brought
to the attention of the Federal District Court pursuant to certain
Federal statutes which we believe protect my client, and which we also
believe have been violated by your client. Let us hope the Commissioners
will take a more practical approach to the matter. By practical I mean
grant approval for the plat primarily because if the Commissioners did
not want to grant the plat, the rezoning should not have been granted
in the first instance.
I will of course be happy to visit with you and your client at any time
relative to any of these matters.
