HomeMy WebLinkAbout20112889.tiff RESOLUTION RE: APPROVE SERVICE PLAN FOR WELD COUNTY FEDERAL MINERAL LEASE ACT DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Service Plan for the Weld County Federal Mineral Lease Act District, which has been recommended for approval by the District's Board of Directors, and WHEREAS, after review, the Board deems it advisable to approve said Service Plan, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Service Plan for the Weld County Federal Mineral Lease Act District be, and hereby is, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 31st day of October, A.D., 2011. Lon %Atty / ( cv�(b 9� Douglas ademacher Date of signature: //_S.// CC Qrt\ k\ It _ tl 2011-2889 SD0136 RECOMMENDED SERVICE PLAN FOR WELD COUNTY FEDERAL MINERAL LEASE ACT DISTRICT Pursuant to the terms of Resolution Number 2011-2263, the Weld County Federal Mineral Lease Act District (the "District") was established on August 17, 2011, nunc-pro-tunc, June 29, 2011, by the Board of County Commissioners of Weld County (the "BOCC"). The current Board of Directors for the District (the "District Board") was appointed by and through Resolution Number 2011-2658, on October 12, 2011. Having met on October 26, 2011, the District Board hereby proposes the following Service Plan to the BOCC: a. The District Board proposes to distribute, on an annual basis, all of the funding that the District receives from DOLA, except such funds as expended or reserved for administrative expenses, as permitted by C.R.S. § 30-20-1307 (l)(b), to areas within the unincorporated areas of Weld County that are socially or economically impacted by the development, processing, or energy conversion of fuels and minerals leased under the Federal "Mineral Lands Leasing Act" of February 25, 1920, as amended ("the Leasing Act"). The term, "impact," as referred to herein, shall mean the impact caused by development, processing, or energy conversion of fuels and minerals leased under the Leasing Act. In doing so, the District Board may review any reports or studies made, or may seek any additional reports or studies it deems necessary, regarding the distribution of funding in the District. b. After the annual receipt of Federal Mineral lease funds, the District Board shall solicit projects to fund from eligible entities which fit the above criteria. c. The District Board may cooperate or contract with any individuals or entities, and any governmental entity, and any other district formed under the Act, through the intergovernmental agreement ("IGA") process authorized by C.R.S. § 29-1-201 et seq., and the Colorado Constitution to provide any function or service, including without limitation, administrative or treasury functions lawfully authorized to each of the cooperating or contracting districts, including the sharing of costs, as long as the cooperation or contracts are authorized by each district with the approval of each district's board of directors. Any such contract shall set forth fully the purposes, powers, rights, obligations, and responsibilities, financial or otherwise, of the contracting parties. Where other provisions of law provide requirements for special types of intergovernmental contracting or cooperation, those special provisions shall control. d. The District Board shall, as required by C.R.S. § 30-20-1305(2)(b), annually cause the completion of an audit of all of the funding the District receives, with a copy going to the State Treasurer. e. The Boundaries of the District are the unincorporated areas of Weld County. The Service Area of the District shall be the Boundaries of the District. Signed this 26th day of October, 2011.
