RE: ACTION OF THE BOARD CONCERNING ZCV #1100075 AGAINST LORENZO RIOS
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Lorenzo Rios, ZCV #1100075, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of September, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the
matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1100075 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 13th day of September, A.D., 2011.

VIOLATION REMEDY:
As we have discussed on multiple occasions, the presence of a COMMERCIAL VEHICLE(such as but not
limited to a dump truck), requires a Zoning Permit for a Commercial Vehicle (ZPCV), which I have previously
mailed to you. If you have questions, I recommend you speak to one our On-Call Planners. They are available
for Walk-In's Monday-Friday from 7:30-4:30. To better assist them in providing prompt and accurate
information, please make sure you bring this letter with you. Otherwise, you can call them at(970) 353-6100,
Ext. 3540,just ask for the Planner On-Call.
RECOMMENDATION:
The Department of Planning Services recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

Inspection Result Comment Upon a visual inspection of the property, the following items were noted: the pile
of road base(asphalt) has been moved out closer to CR 4-appears they could
be intending on laying out on their dirt road. I also noted a dump truck still on
the property. No pictures were taken during this inspection.

Building, 1150 O Street, Greeley. Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.

business day before or as soon as possible to the above mentioned violation hearing date.

ZONING PERMIT COMMERCIAL VEHICLE (ZPCV) SUBMITTAL CHECKLIST
APPLICATION REQUIREMENTS:
One original application form plus two copies
One original drawing plus two copies. A scaled drawing of the property (1"=50') needs to show where the
proposed commercial vehicle will be parked on the property. Include distances between the property lot lines
and proposed accessory structure and all other existing structures on the property; access to the property
(indicate whether it is existing or proposed); County, State, or Federal road rights-of-way; amount of road
frontages; location and measurements of any easements; and any proposed structures to be located on the
property.
One original Weld County Road Access Permit Application Form plus one copy
One original questionnaire plus two copies
One copy of deed or legal instrument identifying applicant's interest in the property. Copy of recorded
instruments may be obtained from Weld County Clerk and Recorder's Office or a title or abstract company.
One copy of affidavit and certified list of the names, addresses and the corresponding Parcel Identification
Number assigned by the Weld County Assessor of the owners' of property(the surface estate)within 500 feet
of property being considered. This list shall be compiled from the records of the Weld County Assessor, the
Weld County Website, www.co.weld.co.us, or a person qualified to do the task, and shall be current as of a
date no more than thirty days prior to the date the application is submitted to the Department of Planning
Services.
Application fee$75.00
$37.50 investigation fee. If there is an associated violation which has been presented to the Board of County
Commissioners through the Violation Hearing process, the investigation fee shall be fifty percent of the fee
established by separate action by the Board of County Commissioners for land-use applications shall be
assessed. The payment of such investigation fee shall not relieve any persons from fully complying with the
requirements of the Weld County Code, nor from any other penalties.
One each of the application and scaled drawing shall be collated into two complete application packets and
bound with binder clips or paper clips only. The original copies shall be placed in one packet (includes
additional items below if applicable). Applications bound in any other fashion than binder or paper clip will be
returned to the applicant without review. Additional required information shall be kept separate to be collated by
Planning Staff. The Department of Planning Services may request additional information, application packets
and/or fees that will aid in the review of the Zoning Permit application.

Please be advised that a complaint has been received by the Department of Planning Services'staff that uses

As we previously discussed, please see the following summary of the complaint:
The accumulation of rock, asphalt and miscellaneous debris. If your intention is to utilize the rock
and asphalt on the property, it shall be utilized. The Miscellaneous debris shall be removed.
Additionally, the storage of COMMERCIAL VEHICLES is not an allowed use on a property when
situated within a subdivision, such as Jo Ann Subdivision. Over the phone we discussed the
Zoning Permit for a Home Occupation, I believe this is the application which best qualifies you.
If this application completed and submitted within this 10 day extension, no Violation Case will be
initiated; otherwise, if this Pre-Application Request is not submitted to this office within 1O days
from the date of the above letter, this case will proceed accordingly..

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews
are required prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public
Health and Environment. Pre-application reviews are held Thursday and Friday of any given week in
the Greeley office. To be on the pre-submittal agenda, the request and required checklist items must
be received one week prior to the review date, and shall include at a minimum, a description of the

brief narrative and a map delineating the property location, in addition to the other items listed.
