Loretta Pineda Director 907 Poplar, Ste. 210 Casper, Wyoming 82601 Re: Peters Ranch Pit, File No. M-2011-022, Receipt of 110 Construction Materials Reclamation Permit Application Package—Second Incompleteness Letter Dear Ms. Magee: On March 24,the Division of Reclamation, Mining and Safety(Division) received the 110 Construction Materials Reclamation Permit Application package for the Peters Ranch Pit, File No. M-2011-022. Preliminary review of the supplemental information received on May 19, 2011, determined the following items must be received before the Division can consider the application submitted and technical review can begin: Application Form: 1. The Applicant name listed on Page 7 in the Applicant/Operator section and in the notary section of the application form must match the Applicant/Operator name listed on Page 1, Item #1. Please revise Page 7 of the application form to indicate "Basic Energy Services, L.P." as the Applicant. An edited copy of Page 7 is attached for reference. Exhibit A—Location Map(Rule 6.3.1): Rule 6.3.1 requires a map showing information sufficient to determine the location of the affected land on the ground and existing and proposed roads or access routes to be used in connection with the mining operation. Names of all immediately adjacent surface owners of record shall also be shown. The operation location map shall be a standard 1:24,000 scale U.S. Geological Survey map. The location of the proposed operation shall be shown and labeled with the mine site name. 2. Please provide the information required by Rule 6.3.1 on a standard 1:24,000 scale U.S. Geological Survey map for the Peters Ranch Pit 110 permit. Three (3) copies of the Hereford NW Quadrangle survey map are attached for your use. ,xhibit E—Map (6.3.51 3. Rule 6.2.1(2) requires maps be signed by a registered land surveyor, professional engineer, or other qualified person. The new Reclamation Plan map submitted to the Division May 19, 2011 was not signed. Please resubmit a signed copy of the map. Please revise the metes and bounds survey description on the Site Plan maps labeled T-1.0 to indicate the proposed permit boundary of 9.99 acres. Exhibit I - Proof of Filing with County Clerk(Rule 6.3.9): 5. Please provide an affidavit or receipt indicating the date on which the revised application information was placed with the local County Clerk and Recorder. Your application will not be considered filed until the information listed above is received and found sufficient to begin our review. A decision date will be established 30 days from the date of receipt of all of the requested information. Additionally, if you have already published notice you will need to republish notice, after the Division considers the application submitted. Republication must occur once within ten (10) days of the submittal date. We will notify you when you should initiate republication of your notice. The final date for receiving comments is ten (10) days after the date of publication or the next regular business day. You have sixty (60) days from the above date to submit all necessary documents that the Office needs for an application to be considered filed. If, at the end of the sixty day period, the application has not been determined to be filed with the Office,the Office shall deny the application and terminate the application file. The response due date is July 25, 2011. This letter shall not be construed to mean that there are no other technical deficiencies in your application. The Division will review your application to determine whether it is adequate to meet the requirements of the Act after submittal of all required items. Sincere Peter S. To the best of my knowledge,all significant,valuable and permanent man-made structure(s)in existence at the time this application is filed, and located within 200 feet of the proposed affected area have been identified in this application (Section 34-32.5-115(4)(e),C.R.S.). (NOTE: For 110 operations,the affected area includes all lands delineated by the permit boundary.) 3. No mining operation will be located on lands where such operations are prohibited by law(Section 34-32.5-115(4)(1), C.R.S.). 4. As the applicant/operator,I do not have any mining/exploration operations in the State of Colorado currently in violation of the provisions of the Colorado Land Reclamation Act for the Extraction of Construction Materials(Section 34-32.5-120,C.R.S.). 5. I understand that statements in the application are being made under penalty of perjury and that false statements made herein are punishable as a Class 1 misdemeanor pursuant to Section 18-8-503,C.R.S. 1984. This form has been approved by the Mined Land Reclamation Board pursuant to section 34-32.5-110,C.R.S.,of the Colorado Land Reclamation Act for the Extraction of Construction Materials. Any alteration or modification of this form shall result in voiding any permit issued on the altered or modified form and subject the operator to cease and desist orders and civil penalties for operating without a permit pursuant to section 34-32.5-123,C.R.S.
