HomeMy WebLinkAbout20112427 HEARING CERTIFICATION DOCKET NO. 2011-42 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT #355 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS PROCESSING FACILITY) AND A FIFTY (50) FOOT TALL TELECOMMUNICATION ANTENNA TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT — KERR-MCGEE GATHERING, LLC A public hearing was conducted on August 3, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Kim Ogle Health Department representative, Trevor Jiricek Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated June 24, 2011, and duly published June 29, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Amended Use by Special Review (USR) Permit #355 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (natural gas processing facility) and a fifty (50) foot tall Telecommunication Antenna Tower in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ogle provided a brief description of the location of the 27.1-acre site and stated the original USR Permit was granted to Panhandle Eastern Pipeline Company, in 1978, for Natural Gas Processing Facilities. He explained the proposed expansion will include a 50-foot antenna tower to enhance safety of the facility due to the recent increases in drilling activity. He further stated the Planning Commission also recommended approval of the 12-inch gas pipeline associated with this amendment. Mr. Ogle indicated the surrounding uses include agricultural production, with numerous oil and gas facilities and several USR's in the vicinity, and there are eleven (11) property owners within 500 feet of the property. He stated ten (10) referral agencies reviewed this proposal; six (6) responded indicating no concerns or supplied comments which have been addressed in the Conditions of Approval or Development Standards; the Town of Gilcrest did not return a response; and staff received no correspondence from surrounding property owners. Mr. Ogle stated the applicant is also in the Recorded Exemption process to increase the site boundary to about 22 acres and he reviewed the site drawing and an aerial vicinity map for the record. He explained the existing compressor site will be expanded toward the east, and he displayed photographs of the site and surrounding area. In response to Chair Kirkmeyer, Mr. Ogle stated there is an access agreement in place with the Platte Valley Canal. Heidi Hansen, Department of Public Works, stated traffic from the site will access County Road 35, which is a local gravel road with 60 feet of right-of-way. She clarified this is proposed as an unmanned facility which will be visited once per day and staff has no concerns with the application. Trevor Jiricek, Department of Public Health and Environment, stated since this is an unmanned site, no water or sewer services are required, although, they will be required if staff is added in the future, as required by Development Standards #9 and #10. He stated the applicant has addressed the Dust and Waste Management Plans, and the applicant will need to amend the emissions permit currently held with the State. In response to Commissioner Rademacher, Mr. Jiricek reiterated Development Standard #9 will only be enforced for the addition of water and sewer services if the applicant chooses to man the site with one full-time employee. Vince Harris, Baseline Corporation, represented the applicant and displayed a PowerPoint presentation, marked Exhibit D, and explained the applicant intends to add up to six compressors, and remove two existing units once the new ones are running. He explained the Planning Commission approved a nine-mile gas line leading south from this facility, the building on the left includes a compressor, and the application also includes upgrades to the company telecommunications system with a 50-foot tall antenna tower. Mr. Harris indicated the location of the future gas line on the displayed vicinity map, as well as the designated areas for placement of new site equipment and traffic circulation on the site plan. He stated the applicant has complied with the Code requirements and the Colorado Oil and Gas Conservation Commission regulations. Jay Allin, Senior Engineer with Anadarko Petroleum, was present to answer questions. In response to Commissioner Rademacher, Mr. Allin stated the new compressors and engine will be housed inside a structure, and the communications tower will be for the sole use of the company. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Harris stated he and the applicant have reviewed, and agree with, the Conditions of Approval and Development Standards, as proposed. Commissioner Conway moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Amended Use by Special Review Permit #355 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (natural gas processing facility) and a fifty (50) foot tall Telecommunication Antenna Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
