PERMIT #1781 FOR A RESIDENTIAL THERAPEUTIC CENTER IN THE
A (AGRICULTURAL) ZONE DISTRICT - THE GENESIS PROJECT OF NORTHERN
COLORADO
A public hearing was conducted on August 3, 2011, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 17, 2011, and duly published June 22,
2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of The
Genesis Project of Northern Colorado for a Site Specific Development Plan and Use by Special
Review Permit #1781 for a Residential Therapeutic Center in the A (Agricultural) Zone District.
Bruce Barker, County Attorney, made this a matter of record. Commissioner Garcia disclosed
that he previously provided counsel to the applicant six (6) years ago regarding its
organizational structure; however, he has provided no further advice since that time and feels
that he can provide a partial decision in this matter. Commissioner Conway stated he has been
a financial supporter of The Genesis Project; however, his contributions had nothing to do with
this particular project and he believes he can make a fair and impartial decision. Commissioner
Long stated the same.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal,
entered the favorable recommendation of the Planning Commission into the record as written,
and provided a brief description of the location of the five-acre site. He stated the applicant is
proposing to construct one single family dwelling, similar to surrounding properties, which will
house the faith-based, non-profit organization that provides various educational and life skill
services to young women with children. Mr. Ogle stated the property is not located within an
Intergovernmental Agreement Area, or a three-mile referral area of any municipality, the
surrounding properties are primarily rural residential with outbuildings and livestock, and there
are six (6) residences within the vicinity. He further stated staff received four referral responses
with comments, one letter of opposition, and one telephone inquiry. He confirmed the applicant
did conduct a neighborhood meeting, which one (1) neighbor attended; however, it was not the
neighbor expressing opposition. He noted there are several letters of support in the file, as well

as a letter from Bill Bennett, dated July 25, 2011, expressing concerns regarding public safety,
medical issues, and traffic. Mr. Ogle stated, prior to the Planning Commission hearing, the
applicant submitted a letter of intent to serve from the North Weld County Water District, and he
displayed photographs of the site and surrounding area. In response to Commissioner
Rademacher, Mr. Ogle stated the dairy to the south of the site is permitted under an old Special
Use Permit. Responding to Commissioner Conway, Mr. Ogle indicated the location of
Mr. Bennett's residence.
Heidi Hansen, Department of Public Works, stated the site is accessed from County Road 49,
which is a local gravel road, with 60 feet of right-of-way. She stated the average daily traffic
count is 176 vehicles, the applicant will continue to use the existing access, and she identified
the location of an existing low point which will be utilized for a water quality control feature.
Trevor Jiricek, Department of Public Health and Environment, stated the home will be served by
an engineer-designed septic system, water will be provided by the North Weld County Water
District, and staff is requesting minor Dust Abatement and Waste Handling plans. In response
to Chair Kirkmeyer, Mr. Jiricek stated Condition of Approval #1.E is standard language and staff
will require a Waste Handling Plan that addresses basic trash removal, and he is agreeable to
deleting the second sentence and the sub-paragraphs. Responding to Commissioner Conway,
Mr. Jiricek confirmed Condition of Approval #1.D is intended to address a plan for minor dust
abatement of the internal drive.
Karla Grieser, President of The Genesis Project, stated this is not a home for juvenile
delinquents or gang members strung out on drugs or alcohol, rather, she emphasized the clients
are young women with the exceptional challenge of raising their children as a single parent,
while working to provide housing and child care on a very limited income. She stated they need
unconditional love and a helping hand to move forward successfully.
Ray Sears, Architech, stated in his 40 years of experience he has seldom had the opportunity to
work with clients that live what they believe and propose a project that is also fulfilling on a
personal level. He displayed a PowerPoint presentation, marked Exhibit G, reviewed the
proposed site plan, and stated the primary septic system will be engineer designed, with a
designated secondary septic envelope. Mr. Sears stated the trash enclosure will be surrounded
with a six-foot fence, and he indicated the location of the water quality control feature, which is
designed to address excess stormwater if the driveway is paved in the future. He also indicated
the placement of the existing barn structure, and stated the site will have emergency lighting, in
addition to the standard exterior lighting, which will be directed at a 45-degree angle around the
house and garage for security. Mr. Sears displayed a rendering of the front elevation of the
residence, which will have a country estate look, constructed with low maintenance materials,
and a three-car garage. He also reviewed the interior floor plan, displayed photographs of the
site and surrounding properties, and commented the property is situated in a beautiful
surrounding that will be beneficial to the residents.
Mary Jane Kuhn, County resident, stated eleven years ago her daughter became a young
parent and today their friends make up a bulk of the Genesis Project. She stated she and her

family are very thankful for The Genesis Project Shelter that came to the aid of her daughter,
and she stated the proposed Northern Colorado Project is by far the best she has seen.
Ms. Kuhn stated her granddaughter is now 11 years old and this organization has been a
blessing to their family.
Ken Buck, 19th Judicial District Attorney, stated he is actively engaged with The Genesis
Project, and was an active Board member until three (3) years ago. He stated the organization
has a very important mission and is an asset to law enforcement agencies and the overall
community. Mr. Buck stated The Genesis Project homes help young single mothers and their
children by creating a loving atmosphere, and he asked the Board to consider waiving the fees
because the benefits of this project will pay for itself in reduced costs in law enforcement.
Chair Kirkmeyer invited Bill Jerke, previous Weld County Commissioner, to speak; however, he
indicated his written comments, marked Exhibit F, adequately expressed his sentiments and he
had nothing further to add. There being no further comments, Chair Kirkmeyer closed the public
testimony portion of the hearing.
Ms. Grieser requested the Board waive the impact fees. Chair Kirkmeyer explained the
appropriate process is to make a written request of the Planning Services Director. In response
to Commissioner Conway, Ms. Grieser confirmed they previously requested waiver of the
application fee which was denied by the Board. Chair Kirkmeyer summarized the discussion to
delete the second sentence and sub-paragraphs of Condition of Approval #1.E, and modify
Conditions of Approval #2 and #6 from "thirty (30)" to "sixty (60)" days to record the plat. In
response to Chair Kirkmeyer, Ms. Grieser stated she has reviewed, and agrees to abide by, the
Conditions of Approval and Development Standards, as proposed and modified.
Commissioner Long stated this is a great plan and a great group of people working for a great
cause, and he moved to approve the request of The Genesis Project of Northern Colorado for a
Site Specific Development Plan and Use by Special Review Permit #1781 for a Residential
Therapeutic Center in the A (Agricultural) Zone District, based on the recommendations of
Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as entered into the record. His motion included the changes as previously
summarized by Chair Kirkmeyer. The motion was seconded by Commissioner Conway. He
stated although the request to waive the application fee was denied, he would like to direct staff
to waive the impact fee due to testimony from the District Attorney regarding the public savings
in law enforcement. Chair Kirkmeyer stated there is a process and the issue may be discussed
further at the appropriate time. There being no further discussion, the motion carried
unanimously and the hearing was completed at 10:32 a.m.
