The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 11 is under the jurisdiction of the City of Dacono. Please address any access or right-of-way requirements with them. No additional structures or outdoor storage areas are proposed for this site. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency • Management Agency (FEMA). REQUIREMENTS: 1. Utilize the existing access to the site. 2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. 3. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. Central Weld Water District currently provides water for the existing residence and the store. Documentation from the District is required to ensure the existing tap can be utilized for the business. The existing septic system is permitted (G19880182) and was evaluated for adequate size and capacity, by High Plains Engineering, on January 25, 2011. The results of that evaluation found that the system is of sufficient size and capacity to handle the flow for a three-bedroom residence, 2 full time employees and 2 part time employees. A • new 1000 gallon septic tank will be installed for use by store personnel. As the applicant is planning to install a restroom in the store, for customer use, the Planning Department and Environmental Health Department agreed that a portable toilet may be utilized for customers while the permanent restroom is being built. The Departments agreed that the permanent restroom must be completed prior to recording the USR plat. A minimal dust control plan and waste handling plan are required. All Colorado Retail Food Establishment Rules and Regulations must be adhered to. The Consumer Protection inspectors have met with the applicant on site to discuss the requirements for a retail food license. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, for on site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. • • 2. A restroom in the store shall be installed and adhere to all Weld County Rules and Regulations. 3. The applicant shall submit documentation from Central Weld Water District to the Environmental Health Services Division of the Weld County Department of Public Health & Environment, certifying the existing tap can be utilized for the business. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: • 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. • 2 • 7. Adequate toilet and handwashing facilities shall be provided for patrons and employees, at all times 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Upon the investigation, it was determined a building permit is required for the work performed which a permit was not obtained. This would include the additions and change of use for the existing structure. 1. Building permits shall be obtained prior to starting. A plan review is required for each building or structure for which a building permit is required. Two complete sets of plans are required when applying for each permit. Include a Code Analysis Data sheet for the Weld County Building Department for each structure that requires a permit. Submittal plans shall include a floor plan showing the specific uses of each area for the building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. This violation was initiated due to the operation of a grocery store/meat market without first completing the necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this is an active violation, an investigation fee is required. The initial complaint was received from the Health Department. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, the store and meat market shall be removed from the property within 30 (thirty) days.
