This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 46 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line The applicant will use the existing accesses to the property as approved by Access Permit#AP11-00175. No additional accesses will be granted. Please show the existing accesses on the Plat and label them with the Access Permit number. • A Water Quality Feature has been designed for this site and is acceptable. The Water Quality Area is shown on the site plan. Please label the water quality area as"Water Quality— No Build or Storage Area" This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency(FEMA). REQUIREMENTS: 1. Show the existing access points on the Plat and label them with the Access Permit number (AP11-00175). 2. Please label the Water Quality Area as"Water Quality— No Build or Storage Area" 3. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. • c. Weld County is not responsible for the maintenance of onsite drainage related features. To mitigate safety concerns about traffic and dust from the site, the applicant shall enter into an Improvements and Road Maintenance Agreement with the County. This agreement shall detail the approved haul route (east to CR 39) and require dust mitigation if the County determines it has become a problem. 2. Add the following notes to the plat: a. The application indicates that there will be a total of sixteen people who will use the site. There are two shops located on the property which are served by individual sewage disposal systems. According to this Departments records, the north shop septic system (SP-1100068) was sized for 8 workers and 8 drivers. The south shop septic system (SP-1100069) was also sized for 8 workers and 8 drivers. The residence is also served by a septic system (SP-0500387) which was sized for a 3 bedroom home. • Central Weld Water District provides water to the property. The application states that employee waste will be stored in a dumpster and serviced by B and C Refuse. All other materials will be recycled or collected in dumpsters and sent to the landfill. We are requesting a waste handling plan that indicates what the recycled materials are and what type of waste materials will be sent to the landfill. This is required to determine if an application through the State is necessary. A minimal dust abatement plan is requested. Applying water if dust becomes an issue would be sufficient as there are concrete aprons adjacent to each shop building. An air emissions permit from the State may be required We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control • Division, Colorado Department of Health and Environment, if applicable. 4 Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 2 6. This facility shall adhere to the maximum permissible noise levels allowed in the • Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 8. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 9. Adequate drinking, handwashing and toilet facilities shall be provided at all times. 10.Sewage disposal for the facility shall be by septic system. This violation was initiated due to the operation of a commercial business without first completing the necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this case has not been presented to the Board of County Commissioners, no investigation fee is required as this time. The initial complaint was received from a private citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied,the commercial vehicles and all commercial operations shall be removed from the property within 30(thirty)days. Building permits shall be obtained prior to the construction or change of use of any building. The two existing structures be used will require change of use permits. . • 2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2006 International Residential Code; 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy Conservation Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require wet stampted engineered drawings and engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. • 7.
