A Use by Special Review permit for an oilfield service company.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 49 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
CR 38 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-

The business will utilize the existing access from CR 38. Adequate (min 45') truck turning radiuses are
• required at the access. Please show the existing accesses on the Plat and label them with the approved
Access Permit number(will be provided).
A water quality feature design has been provided and is acceptable. Please show the boundaries of the
Water Quality Area on the plat and label as"Water Quality—No Build or Storage Area"
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show the existing access points on the Plat and label them with the Access Permit number (will
be provided).
2. Show the boundary of the Water Quality Area and label as "Water Quality — No Build or Storage
Area"
3. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
• diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for an oil and gas support
facility (roust-a-bout and excavating). There is an existing shop building on the property
for storage of equipment. Vehicles and excavating equipment will be stored in a fenced
area on the property. There are 12 employees at the site, including the property owner
who resides at the property.
Permanent drinking water and sewage disposal facilities must be provided to
employees and drivers who access the site. There is an existing residence on the
property that is served by an individual sewage disposal system (Permit No. SP-
• 9900407) and was sized for 5 bedrooms or 10 people. If the existing septic system for
the home is used for employees, the septic system must be evaluated by an engineer to
determine if adequate.
The residence is also served by an individual well (Well Permit No. 217954), and it is
approved for domestic purposes only. In a letter dated August 18, 2011, from the
Division of Water Resources, the Division noted that the applicant would likely be able
to obtain two exempt well permits, one domestic permit and one commercial drinking
and sanitary well permit. According to the Division, two permits could be obtained as
long as each permit was assigned a specific 35 acres or more of the property.
In lieu of re-permitting their domestic well or drilling a new well for commercial use, and
providing a restroom in the house for the drivers, the applicant is requesting that
portable toilets, hand sanitizer and bottled water be allowed since the drivers are only
on the property for short periods to pick up and drop off business vehicles and
equipment.
No vehicle and equipment washing is performed on-site. The large vehicles and
excavating equipment are serviced at off-site repair facilities; only maintenance of the
one-ton trucks is performed on the property.

A waste handling plan was submitted with the application. The waste handling plan
included removal and disposal or recycling of wastes generated from maintenance of
the one-ton vehicles. Royal Disposal provides trash pick-up.
The applicant submitted a dust abatement plan. On-site dust will be minimized by laying
crushed asphalt on the access driveway and traffic areas behind the shop.
There are 3 aboveground fuel tanks on the property: 2-1000 gallon diesel tanks and 1-
300 gallon unleaded gasoline tank. According to the applicant, the fuel tanks are located
inside a dirt berm that is lined with plastic. The plastic liner is covered with recycled
asphalt to hold it in place. The aboveground tanks will require to be permitted through
the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section. In
addition, a spill plan is required to be submitted to Environmental Health Services.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. In the event the applicant intends to utilize the existing septic system at the home,
for employee use, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the system's ability to handle the proposed hydraulic .
load. The review shall be submitted to the Environmental Health Services Division
of the Weld County Department of Public Health and Environment. In the event
the system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations.
2. The applicant shall submit evidence of an Aboveground Storage Tank permit from
the Colorado Department of Labor and Employment (CDL&E), Oil Inspection
Section for any aboveground storage tanks located on the site. Alternately, the
applicant can provide evidence from the (CDL&E), Oil Inspection Section that they
are not subject to these requirements.
3. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112).
4. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that there is a well appropriately permitted for the
commercial use.

• We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the State Aboveground Storage
• Tank Regulations.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential non-specified Zone as delineated in Section 14-9-30 of the Weld
County Code.
8. Adequate drinking, hand washing and toilet facilities shall be provided for
employees of the facility, at all times.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.

Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
12.All hazardous chemicals must be handled in a safe manner in accordance with
product labeling and in a manner that minimizes the release of hazardous air
pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must
be stored secure, on an impervious surface, and in accordance with
manufacturer's recommendations.
13.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
14.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV11-00041)was noted. This
violation was initiated due to the operation of an oil & gas roust about company and the storage
commercial vehicles and equipment without first completing the necessary Weld County Zoning Permits.
This case has not yet been presented to the Board of County Commissioners through the Violation
Hearing process. Since a complete Use by Special Review(USR)application was submitted prior to the
Violation Hearing, no investigation fee is required.
This complaint was received anonymously.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied, staff requests that this case be referred to the County
Attorneys Office, but legal action delayed for 30 (thirty) days to allow adequate time for the commercial
vehicles and the roust about operation to be removed from the property.

of any building.
2. A plan review is required for each building. Plans require the wet stamp of a Colorado
registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 2006 International Residential
Code; 2006 International Building Code; 2006 International Mechanical Code; 2006
International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy
Conservation Code; 2008 National Electrical Code and Chapter 29 of the Weld County
Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height
and allowable areas will be reviewed at the plan review. Setback and offset distances shall
• be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code
for the purpose of determining the maximum building size and height for various uses and
types of construction and to determine compliance with the Bulk Requirements from Chapter
23 of the Weld County Code. Building height shall be measured in accordance with Chapter
23 of the Weld County Code in order to determine compliance with offset and setback
requirements. Offset and setback requirements are measured to the farthest projection from
the building.
7. Provide letter of notification from Fire Protection District having jurisdiction prior to any new
construction.

Dear Mr. Ogle
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4. 2005 and March 11. 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition. the comments provided herein cannot be used to guarantee a viable water
supply plan or infrastructure. the issuance of a well permit, or physical availability of water.
• The Amen family is proposing to use their property for Amen Oilfield Service, Inc. The business
operations on their property would be limited to storage of trucks and large equipment, which would be
used at offsite locations. According to the application, the equipment and trucks would not be serviced

the site for brief periods for dropping off and picking up equipment. Therefore, the applicants propose
that the business will not have any water use. that employee sanitation would be provided through a
portable toilet with hand sanitizer and the employees would only use bottled water. If this method of
employee sanitation is approved by the County. this office does not have any objection to the proposal.
The Amen family's current domestic well appears to have permit no. 217954. This permit is
currently registered to a different person The Amen family may want to submit a change of ownership
form (available from our website http.//water.state.co us) to this office to update our database.
The Amen family should be aware that because their property is larger than 70 acres they would
likely be able to obtain two exempt well permits. one full domestic permit including outdoor water use
and one commercial drinking and sanitary well permit. Two permits could be obtained if each permit
were assigned a specific 35 acres or more of their property. The ability of the Amen family to obtain a
second well permit for commercial use would be evaluated at the time the well permit application is
submitted to our office.
