A Use by Special Review Permit for an Oil and Gas Support and Storage Facility, including LNG liquefaction and storage and fueling station. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Weld County Road Classification Plan: CR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line Access/Roadway: The applicant is proposing a new access from CR 22. Please provide a completed access permit • application along with photos at the access point, a traffic control plan and appropriate fee. The application and instructions are available on the Weld County Public Works website under "Permits/Applications". Questions concerning the access permit should be directed to Janet Carter at 970-304-6496 x3750. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. The minimum distance between low- volume commercial access points shall be 660 feet. 1. Provide a completed access permit application along with photos at the access point, a traffic control plan and appropriate fee. 2. Show the approved access on the Site Plan and label it with the approved access permit number. 3. Tracking control is required to prevent the tracking of mud and debris on to the County roadway. Please show and label double cattle guards (2 cattle guards placed back to back to allow for a full rotation of truck tires)with 50' of recycled asphalt(or equivalent) at the access. 4. Place the entry gate far enough back from the roadway to allow a truck with trailer to completely pull off of the County roadway before stopping to open the gate. 5. The access must have a minimum of 60' radiuses to accommodate large trucks turning in and out of the site. 6. An Improvements and Road Maintenance Agreement is required before the plat can be recorded. 7. Please add the following note to the plat: • a. An increase of delivery truck traffic over the maximum of 40 roundtrips per day will trigger additional review and possibly additional improvements. Site: 8. Please place the following note on the Plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Stormwater: The applicant is showing two Water Quality Areas for the site. Please provide the calculations for these water quality areas. The areas should conform to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria Manual. Please label these areas on the site plan as "Water Quality— No Build/Storage Area". The southern area must be located outside of the future right-of-way for CR 22. 9. Provide calculations for the Water Quality Areas and label them as "Water Quality — No Build/Storage Area" on the plat. 10. The project will disturb over an acre of land therefore, a State approved Stormwater Management Plan will be required. Please provide a copy of Storm Water Management Plan application as submitted to the State. Please provide a copy of the approved permit once it has been obtained. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. 11. The project will disturb over an acre of land therefore, a Weld County Grading Permit is required before construction. • 12. Please place the following notes on the Plat: a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. b. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. c. There will be three stages to this project. Phase 1 would consist of two 16,300 gallon storage tanks. Phase 2 would add a liquefaction facility for transport to customers. Phase 3 would be the expansion of the liquefaction facility. Phases 1 and 2 will not be manned facilities and will consist of less than 20 people per week accessing the facility to transport in and out product. Phase 3 will consist of employees and truck drivers and there may be up to 300 people per week accessing the site. The application does not propose any sanitary facilities until phase 3 which will take 6 • months to construct, depending on market conditions. The use of portable toilets and bottled water is acceptable until phase 3 is completed. As this is a commercial facility the septic system must be designed by an engineer and approved by the Board of Health. The system must be large enough to accommodate employees, truck drivers and customers. The application indicates a domestic water tank will be utilized for phase 3. A cistern is not allowed if another water source is available. A well permit through the State Division of Water Resources or a tap from a water district is required. If the State will not issue a well permit and a tap from a water district is not available, a cistern must be applied for and approved by the Board of Health. A waste handling plan was submitted which states that trash will be contained in receptacles and hauled away by a local trash company. The name, address and phone number of the waste removal company needs to be included in the plan. The dust abatement plan indicates the ground will be compacted and 3 inches of 1 '/z inch rock will cover the compacted area. All other areas will be revegetated with native grasses. • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2 The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include the following: The waste handler and facility where the waste will be disposed, including the facility name, address, and phone number. We recommend that the following requirements be incorporated into the permit as • development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved waste handling plan, at all times. 5. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14), as applicable. • 2 6. The facility shall be operated in a manner to prevent odors. Odors detected off • site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan, at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 9. The operation shall comply with all applicable oil and gas operations regulated by the Colorado Oil and Gas Conservation Commission. 10.Adequate drinking, handwashing and toilet facilities shall be provided for personnel on site. Portable toilets and bottled water shall be provided for phases 1 and 2. . 11.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. A septic system shall be installed when phase 3 is completed. 12.The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). 13.A permanent, adequate water supply shall be provided when phase 3 is completed. 14. In the event an individual well is utilized and is serving more than 25 persons on a daily basis, the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 15.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). • 3 16.The operation shall comply with all applicable rules and regulations of the State • and Federal agencies and the Weld County Code. • • 4 Hello
