HomeMy WebLinkAbout20112456 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION#1843—LARRY RUMERY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 29, 2006, the Department of Planning Services administratively approved the application of Scott Van Demark, 20497 County Road 4, Hudson, Colorado 80642,for Recorded Exemption #1843, to divide the property into parcels estimated to be approximately 35 acres and five (5) acres, for property which is located on the following described real estate, to-wit: S1/2SW1/4 of Section 28, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS,the Department of Planning Services staff notified the current property owner, Larry Rumery, by certified letters dated April 6, and May 4, 2011,that certain outstanding Conditions of Approval had not been completed and that the matter would be scheduled for a hearing before the Board of Weld County Commissioners unless written documentation was received requesting a withdrawal of the case, or the outstanding items were completed and the mylar plat recorded, and WHEREAS,after reviewing the Department of Planning Service's concerns and hearing the testimony presented on June 13, 2011, the Board determined that said matter shall be continued until July 18, 2011, and then from July 18, 2011, to September 19, 2011, to allow the applicant additional time to complete the remaining Conditions of Approval and record the mylar plat. WHEREAS, after reviewing the matter and hearing the testimony presented on September 19, 2011, the Board determines that said application shall be denied for failure to complete the remaining Conditions of Approval and record the mylar plat. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the application for Recorded Exemption#1843 be, and hereby is,denied for failure to complete the remaining Conditions of Approval and record the mylar plat. The applicant shall submit, reviewed and have approved along with all conditions met an amendment to subdivision exemption 137 (SE-137) to remove a parcel of land described in a deed recorded 10/24/90 in B 1280 REC 02230947 from the boundary of SE-137. C. The current property owner of the parcel of land described in a deed recorded 10/24/90 in B 1280 REC 02230947 shall sign the plat. Staff Recommendation: Mr. Rumery indicated in our latest conversation that he has discussed condition approval A with the Henry Lyn Ditch Company and this condition can be resolved. He indicated he runs a landscaping business and has not had time(given that this is the busy season)to discuss with his neighbor in regards to resolving the boundary line discrepancy(outlined under conditions B and C). Staff has provided Mr. Rumery with the new hearing date and time and has on more than one occasion explained the options to Mr. Rumery(finalize the recorded exemption,withdraw the recorded exemption, and finally the possibility of denial). Given the fact that there are still some significant outstanding conditions that need to be addressed before the plat can be recorded, and that staff has not received any phone calls or correspondence from Mr. Rumery since July 2011, staff recommends that this case be denied. SITE CONDITIONS: The site is presently unoccupied. The building site is reasonably level with slopes of 1 - 2% extending away from the building site. The lot appears to be well drained with no erosion evident. GENERAL: This report represents the results of the data obtained during the subsoil investigation of a part of the S 1/2 SW 1/4 Sec. 28, T1 N, R65W, Weld County, Colorado. SUBSOIL CONDITIONS: Two four inch diameter holes were drilled to a depth of fifteen feet at the future building site, as shown on the attached site map. Samples of the soil were taken at 2 foot intervals. These samples were analyzed in the field and laboratory to determine the characteristics of the soil for identification and foundation design. The Atterburg Limits of the soil was checked, and revealed the soil to be NP (Non Plastic). In general, the soil profile shows a Sandy Silt (SM) material to a depth of 15 feet. Free water was found at a depth of 10 feet. The soils in this report were classified using the American Society of Testing Materials (ASTM) procedures. FOUNDATION RECOMMENDATIONS: The soil exhibits a low swell and consolidation potential therefore I recommend the use of continuous spread footing design for a maximum soil bearing pressure of 1000 pounds per square foot (PSF). SLAB ON GRADE CONSTRUCTION: 1. The natural soils are suitable for the support exterior concrete slabs, garage slabs, and basement slabs. Do not place a gravel layer beneath the concrete slab. The slab should be placed directly on the undisturbed natural soil, or well compacted fill material. 2. Provide frequent scoring of the slabs to provide control joints for possible cracking of the slab. Control joints should be placed to provide approximate slab areas of 100 square feet. 3. Proper drainage away from the foundation walls should be provided. A minimum slope of 12 inches in the first 10 feet out from the building is recommended. Roof downspouts and sillcocks should discharge into long concrete splash blocks (5 feet long) or into metal gutter extensions to deposit runoff water beyond the limits of the backfill soil near the foundation walls. 4. Steel reinforcement will be required in the footings and foundation wall. This will give the walls beam strength to span or bridge over any loose or soft pockets of soil not found in our exploratory holes or that may develop during construction. This should also help prevent any differential movement of the foundation system. CONSTRUCTION DETAILS: In any soil investigation, it is necessary to assume that the subsurface soil conditions do not vary greatly from the conditions encountered in the field and laboratory testing. The accompanying design is presented using best professional judgement based on the limits of the extent of testing commissioned by the client. Our experience has been that at times , soil conditions do change and variations do occur. These may become first apparent at the time of excavation for the foundation system. If soil conditions are encountered which appear different from the test borings as presented in this report, it is recommended that this office be called to inspect the open excavation prior to placing the footings.
