HomeMy WebLinkAbout770339.tiff RESOLUTION RE : AMENDMENT OF LEASE AGREEMENT WITH THE UNITED STATES OF AMERICA CONCERNING PROPERTY AT THE WELD COUNTY MUNICIPAL AIRPORT. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 28th day of February, 1975 , the City of Greeley and the County of Weld as Lessor, and the United States of America as Lessee, entered into a Lease Agreement covering the use of property located at the Weld County Municipal Airport for a term beginning February 3 , 1975 and ending October 31, 2021, and WHEREAS, Paragraph No. 4 of said Lease Agreement provided for the payment of rent in arrears at the end of each fiscal year, and WHEREAS, federal law has changed the date of the United States Government' s fiscal year from the 30th day of June , to the 30th day of September, and WHEREAS , it is the desire of the parties to provide for the payment of rent in arrears at the end of the present fiscal year. NOW, THEREFORE, BE IT RESOLVED that Supplemental Agreement No. 2 , a copy of which is attached hereto, which provides for the payment of rent at the end of the fiscal year, September 30, be, and hereby is approved. BE IT FURTHER RESOLVED that the Chairman of the Board of County Commissioners, be, and hereby is authorized to execute the Agreement, and to make the same effective forthwith. DACA 45-5-75-00641 THIS SUPPLEMENTAL AGREEMENT, made and entered into this day of , 19 , by and between the CITY OF GREELEY COLORADO and WELD COUNTY,whose interest in the property is that of owner, for itself and its successors and assigns, hereinafter called the Lessor, and the UNITED STATES OF AMERICA, hereinafter called the Government, WITNESSETH: • WHEREAS, on the 28th day of February 1975 . , the parties entered into Lease No. DACA 45-5-75-00641 as amended covering the use of property located at City of Greeley, Weld County, Colorado for the term beginning 3 February 1975 and extending through 31 October 2021 renewable thereafter from year to year without further notice but in no event to extend beyond 31 October 2021 ; and WHEREAS, Paragraph 4 of said lease provided for the payment of rent in arrears at the end of each fiscal year (30 June) WHEREAS, Public Law 93-344 changed the date of the Government's fiscal year from 30 June to 30 September; and WHEREAS, it is the desire of the parties and in the best interest of the Government to provide for the payment of rent in arrears at the end of the fiscal year. NOW, THEREFORE, in consideration of the premises, Lease No. DACA 45-5-75- 00641 is amended in the following particulars, but in no others: Paragraph 4 is amended to read as follows: 4. The Government shall pay the Lessor at the following rate: $ .25 (twenty-five cents) for the period of 1 July 1977 through 30 September 1977 and at the rate of $1 .00 (one dollar) per annum in arrears at the end of each • fiscal year thereafter.
