RESOLUTION
WHEREAS, MARY CAMP, of Weld County, Colorado, has presented to the Board of County
Commissioners of Weld County his application for a County Retail license for sale of 3.2%
beer only, and the said applicant, having paid to the County Treasurer of Weld County the
sum of Fifty Dollars ($50.00) therefor, and having produced a state retail license for sale
of 3.2% beer only, outside the corporate limits of any town or city in the County of Weld,
at the location described as follows: RED BIRD CAFE ON 5TH STREET ROAD EAST OF GREELEY,
and the County Commissioners, having examined the said application and the other
qualifications of the applicant do hereby grant a license to said applicant to sell 3.2%
beer only at retail, at said place, and do hereby authorize and direct the issuance of said
license by the Chairman of the Board, attested by theCounty Clerk end Recorder of Weld
County, good for one year from the date of issue unless revoked, according to law,
provided, however, that said license shall be issued upon the express condition and
agreement that the place where licensee is authorized to sell beer under said license will
be conducted in strict conformity to all laws of the State of Colorado and any violltion

thereof shall be cause for revocation of the license.

IN THE MATTER OF RESOLUTION RE: THE GREELEY COUNTRY
CLUB APPLICATION FOR LICENSE FOR SALE OF LIQUOR BY DRINK
WHEREAS, The Greeley Country Club, on May 22, 1936, did make application for a Club
License for the sale of liquor by the drink, and
WHEREAS, The Board of County Commissioners has considered the application and has
heard , orally, persons both for and against granting such license, and
WHEREAS, The Board of County Commissioners has read and considered letters and
petitions against issuance of such license, and
WHEREAS, The City Council of the city of Greeley has officially protested the issuance
of such license on the ground that the City had taken over the golf course and the City
opposed liquor,
NOW, rPTEREFORE, BE IT RESOLVED, That the application of the Greeley Country Club for
a Club License to sell liquor by the drink be denied.

others does not warrant toleration of drunkenness,

THIS AGREEMENT made at Greeley, Colorado, this 10th day of July, 1936, by and between
the COUNTY OF WELD, a quasi municipal corporation, hereinafter called First Party, and
GALLAND CHEVROLET, INC. , a Colorado corporation, hereinafter called Second Party,
WITNESSETH:
WHEREAS, second party has entered into an agreement with the United States Treasury
Department, State Procurement Office, to furnish to Works Progress Administration one
Chevrolet Truck, Model Number 1936, 131" Dual, one and one-half ton capacity, and is to
receive seventy-five cents (75f1) per hour as rental price for said truck to be used upon
Weld County Roads W. P. A. Project No. 679, and
WHEREAS, first party desires to acquire title to said truck,
NOW, THEREFORE, IT ISAGREED by and between the parties hereto that first party willat
all times furnish a driver for said truck; that second party is making a charge against
and for said truck in the total amount of One Thousand Sixteen and 22/100 Dollars,
($1,016.22 ) representing the following items, to-wit:

That first party will furnish and deliver for use in said truck all necessary oil,
gas and repairs and will charge second party regular retail price less the gas tax therefor;
first party shall bill second party at the end of each calendar month for all oil, gas and
repairs furnished during the month proceeding and second party shall pay the same at such
time and shall keep an account thereof and add to the total price of the true k. Rentals
received each month shall be applied first to the payment for oil, gas and repairs and the
excess shall be applied upon the purchase price of the turck. When second party has received
as rental from the Treasury Department and has applied the totalsum of One Thousand Sixteen
and 22/100 Dollars, ($1,016.22) for truck and has paid first party for all oil, gas and
repairs furnished, then second party agrees to deliver to first party good and sufficient
transfer of title and Certificate of title for said truck and thereafter the said truck
shall be the property of first party.
IT IS FURTHER STIPULATED AND AGREE: that should Works Progress Administration cease to
pay the rental of seventy-five cents (75¢) per hour to second party before the total sum
hereinabove indicated has been paid or if this contract shall not be completed within ten
months time, first party agrees to pay the unpaid portion of the original purchase price,
to-wit, One Thousand Sixteen and 22/100 Dollars ($1,016.22 and cancel such sums as shall
remain unpaid to first party for the gas, oil and repairs theretofore furnished and title
shall then be transferred to first party .
IT IS FURTHER STIPULATED AND AGREE that first party agrees to reimburse second party
for any and all taxes assessed against second party by rea on of ownership of s&id truck.
IN WITNESS whereof first party has caused this agreement to be signed pursuant to
resolution of Board of County Commissioners, and second party has caused its corporate

AND 16th STREET, CITY OF GREELEY
WHEREAS, The Board ofCounty Commissioners has been informed by the present owner of
the "Gaines Property" , across the avenue from the Greeley Hospital, and adjacent to the
Greeley hospital Nurses Home, that he intends to build a filling station on the site of
the "Gaines Property", and
WHEREAS, in our opinion, the resulting noise would be particularly objectionable in
this neighborhood, designated by the City of Greeley as a "Quiet Zone", and
WHEREAS, the nurses of the Greeley Hospital find it necessary to sleep in the Nurses '
Home, next door to the proposed filling station, periods during all 24 hours of the day,
and the noise and other objectionalbe features incident to the operation of a filling
ll station are particularly undesirable, and
WHEREAS, the odor of grease and oil would be especially objectionable to patients,
sensitive due to illness.
NOW, THEREFORE, BE IT RESOLVED, That the Board ofCounty Commissioners of Weld County,
Colorado, acting as The Board of Trustees of the Greeley Hospital, request the City Council
of the City of Greeley to take the necessary steps to prevent the construction of the pro-
posed filling station.

WHEREAS, John Plane, of Weld County, Colorado, has presented to the Board of County '
Commissioners of Weld County his application for a County Retail license for sale of
3.2% beer only, and the said applicant , having paid to the County Treasurer of Weld
County the sum of Fifty Dollars ($50.00) therefor, and having produced a state retail
license for sale of 3.2% beer only, outside the corporate limits of any town or city in
the County of Weld, at the location described as follows: STATE MINE, TWO MILES EAST

And the County Commissioners, having examined the said application and the other
qualifications of the applicant do herebygrant a license to said applicant to sell 3.2%

3.2% beer only, and the said applica nt, having paid to the County Treasurer of Weld County
the sum of Fifty Dollars ($50.00) tqerefor, and having produced a state retail license for
sale of 3.2% beer only, outside the corporate limits of any town or city in the Countyof
Weld, at the location described as follows: NORTH OF EATON ON HIGHWAY 85,
And the County Commissioners, having examined the said application and the other
qualifications of the applicant do hereby grant a license tosaid applicant to sell 3.2%
beer only at retail, at said place, and do hereby authorize and direct the issuance of
said license by the Chairman of the Board, attested by the County Clerk and Recorder of
Weld County, good for one year from the date of issue unless revoked, according to law,
provided, however, that said license shall be issued upon the express condition and agree-
ment that the place where licensee is aut"orized to sell beer under said license will be
conducted in strict conformity to all laws of the State of Colorado and any violation
thereof shall be cause for revocation of the license .

IN THE MATTER OF AGREEMENT WITH TOWN OF WINDSOR
RE: IMPROVEMENT OF WALNUT STREET AND WEST STREET
On motion made, seconded, and on vote unanimously carried, it is
RESOLVED, that the following agreement with the Board of Trustees of the Town of
Windsor, Colorado, is hereby authorized, to-wit:
AGREEMENT
The County of Weld, State of Colorado , agrees to gravel, grade and oil, under U. S.
Government W. P. A. Project No. 388, all of Walnut Street from the eastern boundary of the
Town of Windsor to West Street and thence northward on West Street to the Town limits .
The Town of Windsor, Colorado , agrees to furnish all gravel for said project and will
pay for the use of the machinery and equipment belonging to the County at the following
rates, to-wit:
l Ton Trucks at 75c per hour
60 Caterpiller tractor and grader at 82,25 per hour
30 Caterpiller tractor and fresno at 1.50 per hour
Maintainer with 12 foot blade at $2.25 per hour
Dragline at $5.00 per hour
Crushing rock at 20c per cubic yard
Each truckdriver, grader and tractor at 42c per hour
IT IS FURTHER AGREED that the County Commissioners will make no charge for the super-
vision of said work.
IT IS FURTHER AGREED that the County may use gravel from the pit belonging to said

Town for the completion of any porticn of said W. P. A. Project, and will pay therefor 5
per cubic yard for all gravel used by the County outside of the City Limits of Windsor.

RESOLVED, That the following statement expresses tne unanimous opinion of the The
Board of County Commissioners .
"The Board of County Commissioners consider the County Library a worthy project.
However, after giving the Delegation' s request for $1,000.00 careful consideration, it was
decided that the request cannot be granted at this time for the following reasons:
1. The money was not budgeted and now cannot be legally appropriated, in the opinion
of the the County Attorney.
2. There is provision in the law for financing County Libraries . This is close to
election time and the matter should be put up to the voters of Weld County, as the law
provided. If the voters favor a County Library, we have a firm foundation for the
program. Otherwise, we might be considered as overstepping our rights if we made a special
appropriation when the law specifically provides a method of financing.
3. It is our understanding that County Sponsorship of the Library Project is not
necessary for its continuation for the next six months .
4 . We cannot consider this as an emergency making necessary emergency appropriations ."

IN THE MATTER OF RESOLUTION APPOINTING
COMA"ISSIONER TO CONVEY PROPERTY
WHEREAS, on July 3, 1900 a petition waspresented to the Board of County Commissioners
of Weld County for the establishment of a County road over the lands hereinafter described,
and on July 19, 1900 the Board of County Commissioners of Weld County appointed road viewers
to view said road as provided by law and on October 11, 1900 the said viewers made their
report together with a map thereof which report and map was apr,roved by the Board of County
Commissioners and recorded in book 83, page 271 of the records of Weld County, L'olorado, and
TEREAS, pursuant tosaid proceedings a County road was opened over the said lands, and
said road over said lands was used by the public to and until the construction of State High-
way No. 81, and
WHEREAS, said State Highway No . 81 wich is adjacent to the said road over the lands
above described and said Highway No. 81 now serves the public convenience and necessity in
place of said former public road and cost of maintenance of said former public road would
require an unnecessary expense to Weld County, and
WHEREAS, The Great Western Sugar Company, a corporation, has by deed recorded in book
992 page 356 Weld County records, acquired the title to t}-e lands over which id former
road was constructed as well as the lands abutting thereon, and the vacation of said road
will not leave any land adjoining that portion of said road to be vacated with' ut an
established road.
WHEREAS, IT is now declared to be a benefit to Weld County to abandon and vacate the
portion of the road hereinabove described.
NOW, T}'FREFORE, BE IT RrSOLVEP that the County road now existing over the lands herein-
above described be and the same is hereby abandoned and vacated and it is hereby ordered
that Kathleen E. Day hereby constituted and appointed as comr ssioner of the County of Weld
to make a conveyance of said lands over which said highway was established as aforesaid to
The Great Western Sugar Company, which said lands are more particularly described as follows,
to-wit:
A strip of land sixty feet in width measured at right angles to, lying immediately

North of, parallel to and abutting on the North right of way line of the Chicago, Burlington
and Quincy Railroad commencing at the West boundary line of Section Two (2) Township One (1)

constructed.
IT IS FURTHER ORDERED that to such conveyance the said Kathleen E. Day is authorized
to affix the seal of saic County and said conveyance when executed according to this order
shall have the effect to quit claim to said The Great Western Sugar Company all right,
title and interest Weld County may have in and to said lands above described.

THIS AGREEMENT, Made at Greeley, Colorado, this 13th day of August, 1936, by and
between the County of Weld, a quasi municipal Corporation, first party, and Clyde and 7 ,,

WHEREAS the Board of County Commissioners of first party have found it necessary to
acquire for road purposes about .31 of an acre of land belonging to second parties, the
exact amount and location of which shall be determined by the survey of the State Highway
Engineer' s office, being in a portion of the South Half (Si) of the Southwest Quarter
(SW4) of Section Six (6) , Township Four (4) , Range Sixty-five (65) , and
WHEREAS second parties are willing that said land be so taken and used and whereas
parties have failed to agree as to full compensation and both of said parties desire to avoid
trouble and expenses of an Eminent domain proceeding,
NOW, THEREFORE, IT IS AGREED that L. R. LOVE
CHARLES OF BEHRENS, AND
CLALDE CLARKSON
shall act as arbitrators, and they are hereby appointed arbitrators by the parties
hereto, and
IT IS FURTHER AGRL'FD that there is hereby submitted to said arbitrators for their
determ nation the following matters, to-wit:
(1) The value of the lands actually taken, (2) The damage, if any, to the lands not taken,
(3) The benefits, if any, caused by the i;provement.
It is further agreed that the parties hereto will abide by the award of said arbitra-
tors and that the award when made may be filed by the successful party with the Clerk of
the District , Court as a basis of judgment, and that execution may be issued for its collect-
ion.

Commissioner S. K. Clark introduced the following resolution and moved its adoption:
WHMREAS, a new road from Fort Collins, Colorado, to Cheyenne, Wyoming, has been con-
structed which closely parallels the hereinafter described road, and
WHEREAS all of the owners of land adjoining said described road have petitioned this
Board that the hereinafter described road be abandoned and vacated,
NOW, THEREFORE, BE IT RESOLVED by The Board ofCounty Commissioners of Weld County,
Colorado, pursuant to the provisions of Section 1289, Compiled Laws of Colorado, 1921,
sk that the following established road and right ofway for said road is hereby vacated:

All that part of the county highway beginning on the West line of Section Eighteen
(18) , Township Eleven (11) , North, Range Sixty-seven (67) West, and extending northeasterly

RESOLUTIO N
WHEREAS, Harley E. Harding, of Weld County, Colorado, has presented to the Board of
County Commissioners of Weld County his application for a County Retail license for sale of
3. 2% beer only, and the said appicant, having paid to the County Treasurer of Weld County
the sum of Fifty Dollars ($50.00) therefor, and having produced a state retail license for
sale of 3. 2% beer only, outside the corporate limits of any town or city in the County of
Weld, at the location described as follows: BRIGGSDALE BEER PARLOR, BRIGGSDALE, COLORADO,
And the County Commissioners, having examined the sdid application and the other qualifica-
tions of the applicant do hereby grant a license to said applicant to sell 3.2% beer only
at retail, at said place, and do hereby authorize and direct the issuance of said license
by the Chairman of the Board, attested by the County Clerk and Recorder of Weld County,
good for one year from the date of issue unless revoked, according to law, provided,
however, that said license shall be issued upon the express condition and agreement that the
place where licensee is authorized to sell beer under said license will be conducted in
strict conformity to all laws of the State of Colorado and any violation thereof shall be
cause for revocation of the license.

By reason of sundry resignations, refusals to act , and other causes, it was on the 28th
day of September, 1936, unanimously ordered by the Board of CountyCommissioners of Weld
County, Colorado, that the 1936 primary and general election boards of registry, and judges
of election heretofore appointed by this board as such, be changed and new appointments made,
in accordance with present requirements, and Counting Judges be appointed in precincts en-

WELD COUNTY, COLORADO, a quasi municipal corporation, hereinafter called First Party, and
THE LIBERTY TRUCKS AND PARTS COMPANY, INC. , A Colorado corporation, hereinafter called
Second Party, WITNESSETH:
WHEREAS, second party has entered into an agreement with the United States Treasury
Department, State Procurement Office to furnish to Works Progress Administration one Austin
77 Sr. Dual Drive Motor Grader with full hydraulic control including steer, Buda 6 cylinder
K 369 motor, 6 speeds forward and 2 reverse, cab with glass front and curtains side and rear,
upholstered seat, 12' oil mix moldboard with boots, wide front axle, leaning wheels, front
tires 32 x 6 lug type, rear tires 8.25 x 24 (8 tires) lug type, starter andlighting systems,
wheel brakes, juffler andradiator guard, andis to receive Two and 25/100 Dollars ($2.25) per
hour as rental for said motor grader to be used upon Weld County Roads W. P. A. Prodeets NO.

WHEREAS, first party desires to acquire title to said motor grader.
NOW, THEREFORE, IT IS AGREED by and between the parties hereto that first party will at
all times furnish a driver for said motor grader; that second party is making a charge
against and for said motor grader in the total amount of Five Thousand One Hundred Seventy
Two and 70/100 ($5172. 70) , representing the following items, to-wit:

shall then be transferred to first party.

objections thereto , on motion, same were ordered approved as read.

ing bond has been presented, that it is regular in form and the sureties being deemed

IN THE MATTER OF COUNTY RETAIL 3.2% BEER LICENSE •
NO. 87, JESS GARCIA, EAST SIDE, EATON, COLORADO
RESOLUTION
WHEREAS, JESS GARCIA, of Weld County, Colorado, has presented to the Board of County
Commissioners of Weld County his application for a County Retail license for sale of 3. 2%
only, and the said applicant , having paid to the County Treasurer of Weld County the sum of
Fifty Dollars ($50.00) therefor, and having produced a state retail license for sale of
3.2% Beer only, outside the corporate limits of any town or city in the County of Weld, at
the location described as follows: LOT 10 and LOT 11, BLOCK 3, EAST SIDE, EATON, COLORADO,
And the County Commissioners, having examined the said application and the other
qualifications of the applicant do hereby grant a license to said applicant to sell 3. 2%
Beer only at retail, at said place, and do hereby authorize and direct the issuance of
said license by the Chairman of the Board, attested by the County Clerk and Recorder of
Weld County, good for one year from the date of issue unless revoked, according to law,
provided, however, that said license shall be issued upon the express condition and agree-
ment that the place where licenseeis authorized to sell beer under said license will be
conducted in strict conformity to all laws of the State of Colorado and any violation
thereof shall be cause for revocation of the license.

On motion made and seconded, it was
RESOLVED, That the County Treasurer is authorized to sell, assign, and deliver tax
sale certificate no. 1520 of the 1931 sale for the tax of 1930 to 1933, inclusive ,
covering SEi 29-7-58, upon receipt of $149.45 together with his fees for making assignment.
