Stn. • (UN`DE n 5 S 5',ti k • Weld County Planning Department Use By Special Review Amendment Application Questions For USR 1251 at 6461 Hwy 392 Windsor Colorado 1.2.3. This is an application to amend the existing USR 1251 at 6461 Hwy 392 to include a micro- brewery. In 2007 we started a hop farm just west of The Windsor Gardener. It is the first hop farm on the fron range and one of the first in Colorado. The hop farm is consistent with Weld County's agricultural heritage and using hops grown on site in our brew will help showcase the farm. We have an opportunity to create a one of a kind business in Weld county which will help educate people on this new agriculturally based venture. In order to fulfill this, we will give tours of the hop farm and brewery. Beer tasting will be conducted in the tasting area which is located at The Windsor Gardener in a room and a patio that overlooks the hop farm. USR codes 23, 3,40, B18. 4. The site is a ten acre parcel just outside of Windsor. It has commercial land to the east. The parcel just north is agricultural land. A gravel pit lies south of the land and to the west is agricultural land with several acres in the flood way and flood plain. We are surrounded on three sides by Weld county. • 5.a. We will conduct pre-arrange tours of 5-10 people 2-3 times per week. We hope to have 10- 20 people per day visit the tasting room. 5.b. The Windsor Gardener currently employs 6 full to part time employees with 2-4 seasonal additions from April through July. -We will add 2 employees to the brewery with an additional 2-4 part time employees to help with the liquid center. 5.c. We will be open 4-6 days a week for serving and selling beer on site. Hours of operation are yet to be determined and will fluxuate. We will not be open late except on special occasions. 5.d. A warehouse will be built north and east of the greenhouse. It will be 4800 square feet with approximately 950 square feet dedicated as the brewery. The remaining 3850 square feet will be storage for the brewery and greenhouse. 5.e. There will be no livestock associated with the brewery. 5.f. There will be no significant change in vehicle use at the site. 5.g. Windsor Severance Fire district will provide fire protection. 5.h. Our domestic water supply comes from the town of Windsor and a 40 gallon a minute domestic well on site. We also own two shares of the Cache La Poudre Irrigation ditch#2 and 1/3 share of an irrigation well. • • 5.i. There is a septic system on site. Brewery waste will be transported off site until an analysis of the effluent is measured and a baseline established. Once the baseline is established we hope to recycle the brewery waste by using it as fertilizer on our hop farm. (SEE ATTACHED WASTE HANDLING PLAN) 6. SEE PLAT 7.NA 8. Storm water drainage will follow the historical flow to the Poudre River. 9. We propose to start construction of the warehouse as soon as approval from the building department is granted. ( Hopefully in June 2011) Brewery equipment will be installed after approval of the USR revision from Weld county. 10. We will re-use brewery effluent on our crops and spent grain will be given to local farmers for cattle feed. • • • Dust Abatement Plan Water will be applied to the work area to keep dust down during construction. • • • Public Works A traffic study is not required. There is an existing access to The Windsor Gardener from State Highway 392 onto 17`h Street in Windsor that will continue to be used. Drainage standards have been addressed per John Myers certified Colorado State engineer. • • • Waste Handling Plan We will initially haul our effluent to one of two offsite disposal facilities. (See attachment) We will treat the brewery effluent and recycle it to fertilize our hop field. This will be a beneficial reusable resource. We will work with Weld County Health Department to set this up. I have spoken to Troy Swain regarding this matter and he has been very informative and helpful. Proposed Distribution: Any interested party, by request, and the Division Homepage. Statement of Fact: The Division has recognized the need to establish an improved level of • consistency in the interpretation and application of the statutory exemption to a Certificate of Designation (CD) for solid waste disposal on one's own property. The Division seeks to promote consistency by summarizing the requirements and expectations of a landowner and the Division. Background and Discussion: The Colorado solid waste statute does allow for the disposal of a person's own waste on his own property without a Certificate of Designation for that disposal under law. This exemption is found in section 30-20-102(3), C.R.S. It says: "Notwithstanding the provisions of subsections(I)and(2)of this section,any person other than a governmental unit may dispose of his own solid waste on his own property,as long as such solid wastes disposal site and facility complies with the rules and regulations of the state board of health and does not constitute a public nuisance. For the purposes of this part I, such solid waste disposal site and facility shall be an approved site for which obtaining a certificate of designation under the provisions of section 30-20-105 shall be unnecessary. This subsection (3)shall not preclude any person from applying for a certificate of designation for the disposal of his own solid wastes on his own property." [Emphasis added] While the phrase "one's own waste" is used, it is often misused or misunderstood. According to the Colorado Solid Waste Act, each solid waste facility is required to get a Certificate of Designation before operating. However, according to section 30-20- • 102(3), Colorado Revised Statutes, if a person [or entity] disposes of his/her waste on Solid Waste Guidance One's Own Waste February 25, 2003 his/her own property (and is not a governmental unit), they do not have to obtain a • certificate of designation, as long as the operation complies with the regulatory requirements. The person would not have to obtain a certificate of designation if they comply with solid waste rules and regulations and do not let their property become a nuisance. Some people interpret the exemption to mean that if you do not dispose of any waste other than their own, they are not required to follow the Solid Waste rules and regulations. That is not a correct interpretation. What this exemption means is that so long as you take care of your property, and your disposal practices are to ensure that your property is meeting the minimum standards of the regulations, you do not need a certificate of designation. The minimum standards of the regulations require such things as: taking reasonable measures to collect, contain and dispose of litter; ensuring that noise, dust, and odors do not pose a health hazard; managing the site so that birds, insects, rodents, and other vectors dc; not pose a health hazard; and providing adequate cover so water does not pond on the site, and that wind erosion and/or water pollution does not become a problem. The minimum standards also contain a requirement that a facility or property shall submit a design and operations report to the Department for review and approval prior to disposing waste. In addition, once an owner sells his or her property, or ceases on-site disposal activities, the owner is required to leave the site in an orderly manner and with a good aesthetic appearance. The property owner will also have to inform prospective purchasers of the site, that solid waste had been disposed of on the property. Failure to follow these requirements is a violation of the Colorado law subject to enforcement. • Requirements: Any person wishing to dispose of their waste on their own property must: 1. Inform the local government (county or municipality) having jurisdiction since they may have an ordinance that either limits the disposal of materials on private property or forbid it to occur. This is to be done in writing. 2. Once the local government has approved the concept of the disposal the landowner should submit to this Department and the local government the following: proof of ownership. a description of the location and an address of the property,a description of the material proposed to be disposed, photographs of the area in question, information on the soil type and ground water level, distances to water courses and wells, distances to the property lines, and distances to the nearest residences both on and off the property. Brewery wastes serve not only as a source of water but also as a source of carbon for our compost. We are interested in receiving your brewery waste and will take it if it passes examination through our Waste Characterization Plan.We will have you fill out a Generator's Waste Profile Sheet and submit a lab analysis of your waste once you are up and running. It will be approved based on this information if it is proven to be non-hazardous, non-toxic, and useful for our operation. Once approved,we will agree on application methods of your material to our compost depending on the site it is sent to. You are welcome to include this letter in your correspondence with the Weld County Planning Department. They are • quite familiar with our operation and will help you develop your new adventure. High Hops Brewery must obtain a hauled waste permit, issued by the Water Reclamation Division,in order to discharge wastewater at the septage waste transfer station.The permit will specify required conditions for the discharge of wastewater at the transfer station.There is no fee for the permit, but there is a fee of$0.092 per gallon for wastewater generated outside Larimer County. The fee is subject to change.A permit application should be submitted to the Water Reclamation Division at least one month prior to the date the brewery will need services of the septage waste transfer station. Please note: Wastewater discharged at the septagc waste transfer station must have a pH between 5 and 11; discharge of wastewater outside this range is not allowed. Division experience has found that some untreated brewery wastewater is outside this pH range.High flops Brewery may need to adjust the pH of its wastewater within the required range in order for the wastewater to be accepted at the transfer station.
