RE: APPROVE CORRECTION TO BOUNDARY FOR USE BY SPECIAL REVIEW
PERMIT#1033 FOR A BRINE WATER DISPOSAL FACILITY IN THE
A (AGRICULTURAL)ZONE DISTRICT- HIGH SIERRA WATER SERVICES, LLC
RE: APPROVE CORRECTION TO BOUNDARY FOR SECOND AMENDED USE BY
SPECIAL REVIEW PERMIT #589 FOR EXPANSION OF AN EXISTING NATURAL
GAS PROCESSING PLANT IN THE A (AGRICULTURAL) ZONE DISTRICT -
ENCANA OIL AND GAS (USA), INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 12, 1994, the Board of Weld County Commissioners approved
the application of Conquest Oil Company for a Site Specific Development Plan and Use by
Special Review Permit #1033 for a Brine Water Disposal Facility in the A-(Agricultural) Zone
District, on the following described real estate, being more particularly described as follows:
Part of the SE1/4 SE1/4 of Section 28, Township 1
North, Range 67 West of the 6th P.M., Weld
County, Colorado, and
WHEREAS, on July 27, 1994, the Board of Weld County Commissioners approved the
application of Vessels Oil and Gas Company for a Site Specific Development Plan and Second
Amended Use by Special Review Permit #589 for the Expansion of an Existing Natural Gas
Processing Plant in the A (Agricultural) Zone District, on the following described real estate,
being more particularly described as follows:
Part of the SE1/4 of Section 28, Township 1 North,
Range 67 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on January 10, 2008, the Department of Planning Administratively approved
Amended Recorded Exemption #1595, with the boundary of USR-1033 (located on Lot A of
AMRE-1595) as shown on the recorded plat being surrounded by the boundary of
2nd AmUSR-589 (located on Lot B of AMRE-1595), and
WHEREAS, on December 19, 2011, the Board was presented a request from High
Sierra Water Services, LLC, and Encana Oil and Gas (USA), Inc., current property owners of
the respective applications, to correct the legal boundaries of the Use by Special Review plats,
in accordance with Section 23-2-280.B of the Weld County Code, and

WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendation of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request from High Sierra Water Services, LLC, and Encana Oil
and Gas (USA), Inc., current property owners of the respective applications, to correct the legal
boundaries of the Use by Special Review plats, in accordance with Section 23-2-280.B of the
Weld County Code be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the corrected boundary for a Site
Specific Development Plan and Use by Special Review Permit #1033 for a Brine Water
Disposal Facility in the A (Agricultural) Zone District, currently held by High Sierra Water
Services, LLC, be, and hereby is, described as follows:
Lot A of Amended Recorded Exemption No.
1469-28-4 AMRE-1595; being part of the SE1/4
SE1/4 of Section 28, Township 1 North, Range 67
West of the 6th P.M., Weld County, Colorado.
The plat for said USR-1033 shall accurately reflect this corrected boundary, and
BE IT FURTHER RESOLVED by the Board that the corrected boundary for a Site
Specific Development Plan and Second Amended Use by Special Review Permit #589 for the
Expansion of an Existing Natural Gas Processing Plant in the A (Agricultural) Zone District,
currently held by Encana Oil and Gas (USA), Inc., be, and hereby is, described as follows:
Lot B of Amended Recorded Exemption No.
1469-28-4 AMRE-1595; being part of the SE1/4 of
Section 28, Township 1 North, Range 67 West of
the 6th P.M., Weld County, Colorado.
The plat for said USR-589 shall accurately reflect this corrected boundary.

SUBJECT: Proposal for corrected amendment of 2nd AMUSR-589 & USR-
1033 in order to adjust USR boundaries to match property lines
Legal: Lots A & B of Recorded Exemption-1595; located in the SE4 of Section 28, Ti N, R67W,
Weld County.
Location: West of and adjacent to County Road 19 & North of and adjacent to County Road 4.
Background: A Site Specific Development Plan & Amended Use by Special Review Permit for
expansion of an existing natural gas processing plant was under case Amended Special Use
Permit#589-2 (2nd AMUSR-589) approved by the Board of County Commissioners on July 27,
1994. (See Exhibit#1)
A Site Specific Development Plan & Amended Use by Special Review Permit for a brine water
disposal facility (one Class II water injection well) was approved by the Board of County
Commissioners on January 12, 1994.
The boundaries of USR-1033 (located on Lot A of Recorded Exemption 1595) as shown on the
recorded plat indicate the USR boundaries as surrounded by 2nd AMUSR-589 (Lot B of
Recorded Exemption 1595). (See Exhibit#2)
Conquest (now High Sierra) and Encana have been submitted and received a staff approval to
amend Lot A and Lot B of Recorded Exemption 1595 (under Amended Recorded Exemption
1595) to incorporate the access and all improvements off of County Road 19 associated with
USR-1033 into the boundaries of Lot A of Recorded Exemption 1595. (See Exhibit#3)
Request: Encana & High Sierra are proposing to amend the boundaries of 2nd AMUSR-589 and
USR-1033 to match the boundaries of Lot B and Lot A of Recorded Exemption 1595
respectively. There are no proposed changes to the onsite operations approved under 2nd
AMUSR-589 and USR-1033 and there are no changes to the approved development standards.
(See Exhibits#4 and #5)
Board of County Commissioners approval of this is requested in accordance with Section 23-2-
280.B of the Weld County Code.

RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A
BRINE WATER DISPOSAL FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT -
CONQUEST OIL COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado. and
WHEREAS, the Board of County Commissioners held a public hearing on the
12th day of January. 1994. at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Conquest Oil Company, 1610 29th
Avenue Place, Suite 200, Greeley, Colorado 80631, for a Site Specific
Development Plan and Special Review Permit for a brine water disposal facility
in the A (Agricultural) Zone District on the following described real estate, to-
wit:
Part of the SE} SEf of Section 28.
Township 1 North, Range 67 West of the 6th
P.M., Weld County, Colorado
WHEREAS, said applicant was represented by Dale Butcher. Vice President of
Conquest Oil Company, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County Comprehensive
Plan Agricultural Policies. The proposal will not remove
prime agricultural land from production.
b. The proposal is consistent with the intent of the Agricultural
Zone District and is provided for as a Use by Special Review.
c. The use which would be permitted will be compatible with the
existing surrounding land uses which include agricultural
production, oil and gas facilities, and rural residences. The
uses which would be permitted will be compatible with the
future development of the surrounding area as permitted by the
existing zoning.

WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
27th day of July, 1994, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Vessels Oil and Gas Company, 1050
17th Street, Suite 2000, Denver, Colorado 80265, for a Site Specific Development
Plan and Amended Special Review Permit d589-2 for expansion of an existing
natural gas processing plant in the A (Agricultural) Zone District on the
following described real estate, to-wit:
Part of the SE;, Section 28, Township 1
North, Range 67 West of the 6th P.M., Weld
County, Colorado
WHEREAS, said applicant was represented by Steven Smith, Engineer for
Vessels Oil and Gas Company, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive Plan
policies in that expansion of the use does not infringe on the
continued agricultural use in the vicinity or County. The
proposal does not appear to have any adverse impacts on the
agricultural interests of the County or the environment.
b. The proposal is consistent with the intent of the Agricultural
Zone District and is provided for as a Use by Special Review.
c. No overlay districts affect the site.
d. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
