• THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of
the Weld County Code.
2. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect. Section 22-5-100.A. (OG.Goal 1.)states"
Promote the reasonable and orderly exploration and development of oil and gas mineral
resources;" and Section 22-5-100.B. (OG.Goal 2.) states"Ensure that the extraction of oil
and gas resources conserves the land and minimizes the impact on surrounding land and the
existing surrounding land uses;" and Section 22-5-100.B. (OG.Policy 2.9.) states"Impose
protective measures through available state, County and federal regulations to ensure that
the mineral operator conducts operations in a manner that will minimize current and future
environmental impacts." The request for a Site Specific Development Plan and a Special
Review Permit for a Mineral Resource Development Facility including a Electric Natural Gas
Processing Facility,and a Major Facility of a Public Utility—Poudre Rural Electric Association
Terminus substation in the A(Agricultural)Zone District is for a new 4 unit gas compressor
facility, being part of a new five part compressor, pipeline and gas processing plant network
necessitated by the need to move larger volumes of gas due to the recent increases in drilling
activity and projected additional production increases anticipated by producers.
B. Section 23-2-220.A.2--The proposed use is consistent with the intent of the A(Agricultural)
Zone District. Section 23-3-40.A.2 of the Weld County Code provides for Oil and Gas Support
• and Service, Electric Natural Gas Processing Facility,and a Terminus substation, as a Use
by Special Review in the A(Agricultural)Zone District.

• C. Section 23-2-220.A.3 --The uses which will be permitted will be compatible with the
existing surrounding land uses. The property slopes south to north to a high point, and
slopes in a downward gradient to the North. There are multiple accesses to property
mostly associated with Noble Energy's oil and gas site improvements. There is a
communications tower in the center portion of the 640 acre tract of land that appears to
access off of County Road 49. A gas pipeline and Fibre-optic cable are in the right-of-way
west side of County Road 51.
In the immediate area, there is limited residential development, although there are
residences to the south and west of the parcel. The site is currently planted in a grain,
and the property is posted "No Trespassing." There are seven (7) property owners within
five hundred feet of this facility.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the future
development as projected by Chapter 22 of the Weld County Code and any other applicable
code provisions or ordinances in effect, or the adopted Master Plans of affected
municipalities. The site is within the three mile referral area of the Town of Kersey. The
Town returned a referral indicating no conflict with their interests.
E. Section 23-2-220.A.5--The application complies with Section 23-5 of the Weld County Code.
The existing site is not within a recognized overlay district, including the Geologic Hazard,
Flood Hazard or Airport Overlay District. The existing site is within the County-wide Road
Impact Fee Area.
• Effective April 25, 2011, Building Permits issued on the proposed lots will be required to
adhere to the fee structure of the Weld County Road Impact Program. (Ordinance 2011-2)
Effective April 25, 2011, Building Permits issued on the proposed lots, will be required to
adhere to the fee structure of the County Facility Fee and Drainage Impact Fee. (Ordinance
2011-2)
F. Section 23-2-220.A.6--The applicant has demonstrated a diligent effort to conserve prime
agricultural land in the locational decision for the proposed use. This proposed facility is
located on a 160 acre parcel utilizing 40 acres in the center of the parcel for an Electric
Natural Gas Processing Facility and Poudre Rural Electric Association Terminus substation.
Ongoing agricultural production will continue on lands not impacted by this proposed facility.
The proposed facility is sited on lands that are designated "Prime" and "Other' on the
Important Farmlands of Weld County map dated 1979.
G. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code),
Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and
Development Standards ensure that there are adequate provisions for the protection of
health, safety, and welfare of the inhabitants of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
1. Prior to recording the plat:
A. The plat shall be amended to delineate the following:
• 1. All sheets of the plat shall be labeled USR-1792(Department of Planning Services)

• 2. The attached Development Standards. (Department of Planning Services)
3. The plat shall be prepared in accordance with Section 23-2-260.O of the Weld
County Code. (Department of Planning Services)
4. The applicant shall delineate the trash collection areas. Section 23-2-260.C.11 and
Section 23-3-350.A.6 of the Weld County Code address the issue of trash collection
areas. Areas used for storage or trash collection shall be screened from adjacent
public rights-of-way and adjacent properties. These areas shall be designed and
used in a manner that will prevent wind or animal scattered trash. (Department of

5. County Road 50 and County Road 51 are designated on the Weld County Road
Classification Plan as local gravel roads,which requires 60 feet of right-of-way at full
build out. The applicant shall verify the existing right-of-way and the documents
creating the right-of-way and this information shall be noted on the plat. All setbacks
shall be measured from the edge of future right-of-way. If the right-of-way cannot be
verified, it shall be dedicated. These roads are maintained by Weld County.

6. Tracking control is required to prevent tracking of mud and debris on to the County
roadway. Please show and label a double cattle guard(2 cattle guards placed back
to back to allow for a full rotation of truck tires)at the access. Place the cattle guards
far enough back from the County roadway to allow a tractor trailer to completely pull
off the main roadway before crossing the cattle guards. (Contact Amy Burry, Utility
• Coordinator for Weld County Public Works for a right-of-way permit for any work that
may be required in the right-of-way. A special transport permit will be required for
any oversized or overweight vehicles that may access the site. (Department of

7. Please show and label on the Site Plan, the proposed access width and identify as
paved or gravel. Keep in mind that larger trucks utilize the facility and the access
road needs to be wide enough to accommodate two trucks passing in different
directions. Turning radiuses into the site (45-60 foot radiuses required to
accommodate trucks). (Department of Public Works)
8. Please delineate a stop sign at the point ingress and egress for access onto County
Road 51. (Department of Public Works)
9. Submit the calculations for the Water Quality Depression and show the feature on
the Plat. Label it as"Water Quality, No Build or Storage Area".(Department of Public

10. The approved Lighting Plan for the Facility. (Department of Planning Services)
B. The applicant shall address the concerns of the Department of Public Works specific to
Parking and Circulation, the Traffic Study, and Stormwater Drainage, as indicated in their
referral dated July 25, 2011. Evidence of such shall be submitted in writing to the Weld
County Department of Planning Services. (Department of Public Works)
C. The applicant shall submit evidence of an Air Pollution Emission Notice(A.P.E.N.)and
Emissions Permit application from the Air Pollution Control Division, Colorado Department
• of Health and Environment, if applicable. Alternately, the applicant can provide evidence
from the APCD that they are not subject to these requirements. Evidence of such shall

• be submitted in writing to the Weld County Department of Planning Services (Department
of Public Health and Environment)
D. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health & Environment.
The plan shall include at a minimum, the following:
1) A copy of the SPCC plan.
2) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number). Evidence of such shall be submitted
in writing to the Weld County Department of Planning Services. (Department of

E. The applicant shall provide written evidence on letterhead from Central Weld County
Water District indicating a commitment for commercial/ industrial service of water to the
facility. (Department of Public Health and Environment)
F. The applicant shall either submit a copy of an agreement with the property's mineral
owner/operators stipulating that the oil and gas activities have been adequately incorporated
into the design of the site or show evidence that an adequate attempt has been made to
mitigate the concerns of the mineral owner/operators. Drill envelopes can be delineated on
the plat in accordance with the State requirements as an attempt to mitigate concerns. The
plat shall be amended to include any possible future drilling sites. (Department of Planning

G. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the
• Weld County Department of Planning Services. (Department of Planning Services)
2. Prior to Construction
A. The project will disturb over an acre of land therefore, a State approved Stormwater
Management Plan will be required. Please provide a copy of Storm Water Management Plan
application as submitted to the State. Please provide a copy of the approved permit once it
has been obtained. The applicant is required to comply with all Colorado Department of
Health and Environment, Water Quality Control Division regulations regarding storm water
quality permitting and protection and construction storm water discharges. (Department of

B. The project will disturb over an acre of land therefore, a Weld County Grading Permit is
required before construction. (Department of Public Works)
C. A building permit shall be obtained prior construction of any new structures. (Department
of Building inspection)
D. A plan review is required for each building or structure for which a building permit is
required. Two complete sets of plans are required when applying for each permit. Include
a Code Analysis Data sheet provided by the Weld County Building Department with each
Building Permits Submittal plans shall include a floor plan showing the specific uses of
each area for the building. (Department of Building inspection)
E. Occupancy Classification will be determined by Chapter 3 of the 2006 International
Building Code. Buildings, structures and use shall conform to the requirements of the
various codes adopted at the time of acceptance of the permit application. Currently the
• following codes have been adopted by Weld County: 2006 IBC; IMC; IPC; IECC; 2008
National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of the Weld

F. All building plans shall be submitted to Platte Valley Fire Protection District for review and
approval prior to issue of Building Permits. (Department of Building inspection
G. The Building Department requests a pre-construction meeting before submitting permit

H. The applicant shall submit an Improvements Agreement and post collateral for all on-site
and off-site improvements. (Department of Public Works)
3. Prior to issuance of a Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal Regulations. The
septic system is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations. (Department of

4. Upon completion of 1.above the applicant shall submit a Mylar plat along with all other documentation
required as Conditions of Approval.The Mylar plat shall be recorded in the office of the Weld County
Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in
accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat
and additional requirements shall be submitted within sixty(60) days from the date of the Board of
County Commissioners resolution. The applicant shall be responsible for paying the recording fee.

• 5. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Amended Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo
Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not
acceptable). This digital file may be sent to maps(dico.weld.co.us. (Department of Planning

6. In accordance with Weld County Code Ordinance 2005-7 approved June 1,2005,should the plat not
be recorded within the required sixty(60)days from the date of the Board of County Commissioners
resolution a$50.00 recording continuance charge shall be added for each additional 3 month period.

7. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County

1. The Site Specific Development Plan and a Special Review Permit for Oil and Gas Support and
Service, including, but not limited to an Electric Natural Gas Processing Facility in the A(Agricultural)
Zone District, and subject to the Development Standards stated hereon. (Department of Planning

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination. (Department of Public Health and

4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public

5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
• blowing debris, and other potential nuisance conditions. (Department of Public Health and

6. The applicant shall operate in accordance with the approved "waste handling plan", at all times.

7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone
as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise

8. All potentially hazardous chemicals must be handled in a safe manner in accordance with product
labeling and in a manner that minimizes the release of hazardous air pollutants(HAP's) and
volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious

9. Any septic system located on the property must comply with all provisions of the Weld County
Code, pertaining to Individual Sewage Disposal Systems. (Department of Public Health and

10. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the
approved "dust abatement plan"at all times. (Department of Public Health and Environment)
11. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control Commission, and the

• 12. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

• 13. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons,

14. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division. (Department of

15. The applicant shall comply with all provisions of the State Underground and Above Ground

16. The operation shall comply with all applicable rules and regulations of State and Federal agencies

17. A building permit shall be obtained prior to the construction of any new structures. (Department of

18. A plan review is required for each building or structure for which a building permit is required. Two

19. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2006 International Building
• Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International
Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld County Code.

20. All building plans shall be submitted to Platte Valley Fire District for review and approval prior to

21. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases,diversions,concentration and/or unplanned

22. The applicant must take into consideration storm water capture/quantity and provide accordingly for

(COGCC) rules and regulations including drill pad construction, storm water controls, and

28. The property owner or operator of the Electric Gas Processing Facility will amend their permit to allow
for a 115 kV or greater electric transmission line connection to a terminus substation facility located
on site and utilized to power the gas processing facility through a separate land use permit(Use by
Special Review for a Major Facility of a Public Utility). (Department of Planning Services)
29. The facility will comply with the approved Lighting Plan and Section 23-3-250.D.1 Lighting Standards
of the Weld County Code. (Department of Planning Services)
30. The property owner or operator shall be responsible for complying with the Design Standards of
Section 23-2-240, Weld County Code. (Department of Planning Services)
31. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 23-2-250, Weld County Code. (Department of Planning Services)
32. Necessary personnel from the Weld County Departments of Planning Services, Public Works, and
Public Health and Environment shall be granted access onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Conditions of Approval and
Development Standards stated herein and all applicable Weld County regulations. (Department of

33. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or
• Development Standards are permitted. Any other changes shall be filed in the office of the

34. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may be

I have scheduled a meeting with the Weld County Planning Commission on September 20, 2011, at 1:30 p.m. A
subsequent hearing will be held on October 12, 2011 at 10:00 a.m. with the Board of County Commissioners. Both
hearings will be held in the Hearing Room, Weld County Administration Building, 1150 O Street, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance to answer any questions the Planning
Commission members or Board of County Commissioners may have.
Colorado Revised Statute, C.R.S.24-65.5-103 (adopted as part of H.B.01-1088) requires notification of all mineral
estate owners 30 days prior to any public hearing. The applicant needs to provide the Weld County Planning
Department with written certification indicating the above requirement has been met.
A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to
the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the
hearing time, date, and location. In the event the property is not adjacent to a publicly maintained road right-of-way,
one sign will be posted in the most prominent place on the property and a second sign posted at the point at which
the driveway(access drive)intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the Weld

Property is located on multiple parcels in Section 31, Township 5 North Range 64 West of the 6th P.M. Donna Boulter
[0963-31-3-00-003]; Thistledown, Inc. [0963-31-3-00-040]; and Michael Boulter[0963-31-3-00-004] The property is not
currently configured to accommodate future development as lot line adjustment will be required if feasible.
DCP will be acquiring this property or portion thereof for an Electric Processing Plant and compressor facility. There is an
existing power line to the North of the property that will be utilized for generation (Tri-State G&T). Without engineering
assistance, it appears that a step down substation/switching station will be utilized to down size the kV to industrial levels.
The facility will be comparable to Lucerne or Eaton as for size and equipment.
•astructure: Multiple pipes coming in, one small 10" diameter of less going out, destination not specified. The facility is
unmanned yet visited daily,
Access from CR 51 heading to West into DCP site. Will require industrial grade water and bottled water for employees.
Water or Foam for fire suppression, internal yard will be graveled and graded. Other issues: on site Lighting, dust
suppression, waste handling plan, dumpster for on-site generated trash disposal, fenced enclosure if sited on exterior to
building.
Numerous oil and gas wells on site, unknown as to ownership, likely to be Noble Energy Staff suggested a MOU or SUA
agreement prior to PC Hearing. Not known if there are other encumbrances on site.
Traffic Study not required. Narrative only; Drainage Study not required. Narrative only
Staff urged the applicant to contact staff for any questions:

Staff explained the USR process. The applicant shall submit 4 packets for a 7 day completeness review. After the 7 day
completeness review the applicant will be informed of what items are still required to make the application complete. Staff
requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will
be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as
many of the referrals as possible. At that meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission hearing.

Weld County Public Works has received the submittal application for the 7-Day Completeness Review. This
phase of the planning process is a content review of the submitted materials, NOT a technical review.
Comments made during this phase of the process will not be all-inclusive, and will address the critical issues of
concern including but not limited to the Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. The Public Works Department will perform a detailed
technical review of the project once the submittal application is deemed acceptable and is promoted to the
review phase of the planning process.
SITE PLAN REVIEW:
The applicant needs to place on the plat drawing the width of the access identified as paved or gravel. Keep in
mind that large trucks utilize this facility and the access road needs to be wide enough to accommodate two
trucks passing in different directions. Turning radiuses shall be 45° to 60° to accommodate tractor-trailers.
From the pre-application meeting dated January 28, 2011, a tracking pad consisting of double cattle guards will
be required to prevent tracking mud on to Weld County roads. This needs to be placed and shown on the plat
rawing across both lanes. A stop sign shall be installed prior to entering on to County Road 51 as a safety
em. Also identify on the plat drawing at the parking lot and circulation patterns whether it is gravel or
pavement.
TRAFFIC STUDY:
Dust Abatement will be required during plant construction for adjacent structures (residential) that may be

the following comments:
1. Construction documents, statement of special inspections and other data shall be
submitted in two sets with each permit application. The construction documents
shall be prepared by a registered design professional. Where special conditions
exist, additional construction documents to shall be prepared by a registered
design professional and submitted to the County.
2. A Fire District approval letter will be required.
3. Buildings, structures and use shall conform to the requirements of the various
codes adopted at the time of acceptance of the permit application. Currently the
following codes have been adopted by Weld County: 2006 IBC; IMC; IPC; IECC;
2008 National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of
