The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 11 is under the jurisdiction of the Town of Frederick. Please address any access or right-of-way requirements with them. The recorded exemption plat RE-5036 shows 20 feet of future right-of-way in addition to the 30 feet of existing right-of way for a total of 50 feet of right-of-way from the centerline of the road (100 feet of right-of-way total with both sides of the road). Pursuant to the definition of SETBACK in the Weld County Zoning Cone (23-1-90), the required setback is measured from the future right-of-way line. • Please show the existing and future right-of-way on the plat. Please show the future right-of-way as 20 feet per RE-5036 unless the Town of Frederick requests otherwise. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Please address any access or right-of-way requirements with the Town of Frederick. 2. Please show the existing and future right-of-way, 30 feet and 20 feet respectively, on the plat. 3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. 4. Central Weld Water District (tap 952) provides water for both residences. There is one septic permit associated with the property which was designed for a 3 bedroom residence. Septic permit SP-9500165 received final approval in 1995 and was designed by an engineer because replacement soil was utilized for the leach field. The system will need to be evaluated by an engineer for the addition of the second residence. If the configuration of both residences does not exceed 3 bedrooms an • evaluation would not be required. However, as the connection from the 2nd residence to the existing septic system was not inspected, a septic repair permit and an inspection through this Department are required. We have no objections to the proposal; however, we recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event the applicant intends to utilize the existing septic system for the second dwelling (total of 4 bedrooms), the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. Alternately, the applicant can install a new septic system for the 2nd dwelling. 2. In the event the applicant intends to utilize the existing septic system for the second dwelling (total of 3 bedrooms), the septic system shall be installed according to the Weld County Individual Sewage Disposal Policies and Regulations. • • We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in Section 14-9-30 of the Weld County Code. • 6. Any septic system located on the property must comply with all provisions of the Weld County Code pertaining to Individual Sewage Disposal Systems. 7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 8. This violation was initiated due to the conversion of a barn into a second single family dwelling unit without first completing the necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this is an active violation, an investigation fee is required. The complaint was received from a private citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied,the second single family dwelling unit shall be removed from the property within 30 (thirty) days of such denial. Additionally, if denied by the Board of County Commissioners please request this violation case be referred to the County Attorney's Office with a delay of legal action for the 30 (thirty) days mentioned above. • • SERVICE,TEAMWORK,INTEGRITY,QUALITY Hello
