RE: ACTION OF THE BOARD CONCERNING ZCV #1000117 AGAINST LARRY PRICE
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Larry Price, ZCV #1000117, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of January, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Larry Price, property owner was present at said hearing, and
WHEREAS, after hearing the testimony and statements provided, the Board deems it
advisable to refer the matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1000117 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of January, A.D., 2011.

VIOLATION REMEDY:
Please keep in mind if the mulch is spread prior to January 10, 2011, the above mentioned hearing will be
cancelled.
As we discussed over the phone the storage of large(commercial type) quantities of mulched/chipped wood is
not an allowed use without a Use by Special Review(USR) permit. This type of activity would be considered a
solid waste disposal facility. Once the mulch is spread and utilized on the property, this violation will be
closed.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County
Attorney's Office for immediate legal action.

OTHER CASE HISTORY:
09/23/2010 Phone call Larry Price (970-214-5141)called. He indicated that his intent was
to utilize the mulch on the property. He indicated he was going to
spread it out and eventually plant some trees. He said the mulch
kept the moisture in the ground. I asked if he was going to till it into
the ground. He said no. He was planning on leaving it on the top.
He said it kept the top cooler and held the moisture in better. I
explained that there was quite a bit of mulch on the property. He
indicated he planned on bringing even more. He said the amount
that he already has there wouldn't be enough for all the property he
owns there. He said he has neighbors taking mulch for themselves
as well. I told him I would have to discuss this with staff and get
back in touch with him. I transferred him to Commissioner Long's
voice mail as well.
09/29/2010 Phone call Commissioner Long left me a voice mail indicating that he had
received some messages from Larry Price. He indicated that if he
was going to spread the mulch that it would not be a concern. He
said, but he needs to see about getting it spread. Comm Long
indicated that he would contact Mr. Price and get his time line for
getting the mulch spread out.
10/04/2010 Phone call I called Larry Price again (970-214-5141). I advised him that I would
be getting a 30 day letter out in the mail to him which grants 30 days
for the compost pile to be spread out. He said he would get to
working on it. He did say that Commissioner Long left him a voice
mail and he did not get to speak with him directly.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be
in attendance to answer any questions the Board of County Commissioners might have about the violations.

business day before or as soon as possible to the above mentioned violation hearing date.
The Department of Planning Services staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal actions to remedy the violation. Our records indicate

for legal action.
