RE: HEARING TO SHOW WHETHER GOOD CAUSE EXISTS FOR REVOCATION OF USE
BY SPECIAL REVIEW PERMIT#1250 FOR A HOME BUSINESS (STORAGE OF
CABINETS AND EQUIPMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT -
DONALD AND MARGARET IARUSSI
A public hearing was conducted on January 5, 2011, at 10:00 a.m., with the following present:
Commissioner Barbara Kirkmeyer, Chair
Commissioner Sean P. Conway, Pro-Tem
Commissioner William F. Garcia
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:

County Attorney, Bruce Barker
Planning Department representative, Ken Swanson
The following business was transacted:
I hereby certify that pursuant to a notice dated December 17, 2010, and duly published
December 22, 2010, in the Fort Lupton Press, a public hearing was conducted to Show whether
good cause exists for the revocation of Use by Special Review Permit #1250 for a Home
Business (storage of cabinets and equipment) in the A (Agricultural) Zone District, held by
Donald and Margaret larussi. Bruce Barker, County Attorney, made this a matter of record.
Ken Swanson, Building Official, stated he has been working with the property owner, and the
property owner has initiated submittal of blueprints on several occasions; however, they have
not been complete enough to accept. He clarified he has reviewed the letter provided by the
engineer, and he confirmed the submittal process is in progress. In response to Commissioner
Conway, Mr. Swanson stated the property owner seems to be making progress, therefore, he
recommends the matter be continued so that the necessary blueprints may be completed and
submitted to staff. Further responding to Commissioner Conway, Mr. Swanson confirmed a
continuance of the matter for a period of two weeks appears to be appropriate. Chair Kirkmeyer
clarified the property owner has already been given time to get the issue corrected, since the
probable cause hearing was continued before this Show Cause hearing was scheduled.
Mr. Swanson reiterated staff allowed the property owner additional time since he was making
progress obtaining the necessary permits.
Don larussi, property owner, clarified he was originally required to obtain two building permits,
and he confirmed he applied for, and received, one of the building permits; however, the
process for the second building permit is still pending. He confirmed he has been working with
staff to complete the process, and the engineer he hired could not complete a set of blueprints
until the first of the year, due to the holidays. He indicated he expects the process to be
completed within the next two weeks, and hopefully even as early as next Monday.

No public testimony was offered concerning this matter.
Commissioner Rademacher moved to continue the Show Cause Hearing concerning Use by
Special Review Permit #1250, held by Donald and Margaret larussi, for a Home Business
(storage of cabinets and equipment) in the A (Agricultural) Zone District to January 19, 2011, at
10:00 a.m. The motion was seconded by Commissioner Conway, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:15 a.m.
This Certification was approved on the 10th day of January, 2011.
