The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
ACCESS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit. (U.S. Highway

U.S. Highway 85 Access Corridor Plan: The applicant needs to identify on the plat. The U.S. Highway 85

. Highway 85 corridor plan that mile-marker 258.60 has a high priority. This access currently functions as a full
movement, un-signalized intersection. The angle of the intersection is approximately 50°. Be aware that future
improvements in the way of re-alignment or signalization may impact your parcel".
PRELIMINARY DRAINAGE:
The water quality calculations appear to be acceptable to Public Works.
SPECIAL FLOOD HAZARD AREA:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management
Agency (FEMA).
TRAFFIC STUDY:
Public Works Department is not requiring a traffic study.
SITE DISTANCE TRIANGLE: At the northeast corner of the property adjacent to the Union Pacific Railroad,
the applicant shall maintain the site distance triangle. Any landscaping or storage of equipment cannot exceed
2 ''A feet high at this location to avoid causing difficult site distance to the south for oncoming train traffic.
REQUIREMENTS:
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum
height of 12 inches until the area is completely developed.
IXstreet parking spaces including the access drive shall be surfaced with gravel and shall be graded to
vent drainage problems.
Weld County shall not be responsible for the maintenance of on-site drainage related features.

The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
jrsonably preserve the natural character of the area and prevent property damage of the type generally
ibuted to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for various commercial and industrial
uses. There is a grain elevator located on the property.
Water for the property is currently provided by Central Weld Water District.
There is not a sewage disposal system located on the property. The application proposes to
utilize a vault for sewage disposal. According to Policy 2.2.J of the ISDS Policies and
Procedure manual, a vault is not allowed unless the following criterion is met:
G. Vault Permit Policy
lbPurpose: To define when a vault permit is allowed.
Policy: A vault permit is allowed under the following conditions:
1. In situations where only the tank of the septic system is being replaced.
2. Where there is only a temporary water source available (bottled water, cistern); no
permanent water source is available (individual well or public water supply).
3. Temporary use for on-location construction offices (mobile offices) not to exceed 6
months.
4. Low flow commercial uses that are temporary, such as gravel mining operations.
5. Seasonal recreational facilities where use is no more than 6 months per year.
6. In order to comply with the EPA Class V Injection Well Regulation requirements, i.e.
hydrocarbon discharges from garage floor drains.
7. Vault system approved by the Board of Health or Board of County Commissioners.
If one of the above conditions cannot be met a commercial septic system must be installed.
The commercial system must be designed by an engineer and approved by the Board of Health.
All employees, visitors and patrons to the parcel must have access to adequate sanitation
facilities.
The application indicates the drive and parking area is gravel and the areas will be watered if
necessary to suppress dust.
A waste handling plan is required which shall include the name, address and phone number of
the disposal company. A dumpster will be provided for business waste. Servicing of vehicles is
ibcompleted off of the property.
The applicant may sell food in the future and all Colorado Retail Food Establishment Rules and
Regulations must be adhered to.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. An individual sewage disposal system is required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal Regulations. The
septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
lbWe recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. The applicant shall operate in accordance with the approved "waste handling plan", at all
times.
5. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.

6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall be operated in accordance with the approved "dust abatement plan", at all
times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Sewage disposal for the facility shall be by septic system. Any septic system located on
the property must comply with all provisions of the Weld County Code, pertaining to
Individual Sewage Disposal Systems.
9. Adequate drinking, hand washing and toilet facilities shall be provided for employees,
patrons and visitors of the facility, at all times.
10. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize Central Weld Water District.
11. The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
12. All potentially hazardous chemicals must be stored and handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
13. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division.
14. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV10-00098)was noted. This
violation was initiated due to the sale of vehicles, play ground equipment, sheds and feed and seed and
the storage of a house (structure), commercial vehicles and equipment without first completing the
necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners
through the Violation Hearing process on November 9, 2010. At that Violation Hearing, the Board of
County Commissioners referred this case to the County Attorney's Office, but delayed legal action for 180
days (05/09/11). Since this is an active violation, an investigation fee is required.
The initial complaint was received from staff; however, an additional complaint was later by a private
citizen regarding the status of this property.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied, all commercial vehicles and the feed and seed operation
shall be removed from the property within 30 (thirty) days of denial or the court case will process
apaccordingly.

1. After visiting the site and investigating the exterior of the building we are requiring
that the entire building be looked at by an engineer for structural stability. If
building permits are presented to the county we can look at them and determine
if the engineering report is still necessary. We have no permits on file for the
structure.
2. During the plan review process we will look to see if additional separation
between the mercantile and grain elevators will be required.
3. Bathrooms must be provided in the building for employees and the public
according to the 2006 International Plumbing Code section 403.1.
4. The portable food sales building will need to meet accessibility requirement and
need a separate building permit for the structure.
5. The storage of hay and other combustible materials shall meet the requirements
of the 2006 Fire Code and 2006 Building Code.
6. A letter from the local fire jurisdiction will be required with their comments at the
time application is made.
7. The accessibility requirements of Chapter 34 of the 2006 IBC.
8. Alterations, repairs, additions and changes of occupancy to existing structures
shall comply with the provisions for alterations, repairs, additions and changes of
occupancy in the International Fire Code, International Fuel Gas Code,
% International Mechanical Code, International Plumbing Code, and ICC Electrical
Code.
9. Building permits are required for buildings, structures and change of use for
buildings which required permits before the beginning of construction or the
proposed change of use. .
10.Buildings, structures and use shall conform to the requirements of the various
codes adopted at the time of acceptance of the permit application. Currently the
following codes have been adopted by Weld County: 2006 IBC; IMC; IPC; IECC;
2008 National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of
the Weld County Code.

Dear, Michelle Martin
I'am writing this letter on behalf of Western Mutual Ditch Co.
This in regard to case number USR-1783 UP Railroad and Jeremy
Long.
We feel this would be ok. We would require a fence to be built no
closer than 15 feet from the north bank of the ditch and 5 to 6 feet
high to keep trash form blowing in the ditch. We must have the
fence on both sides of the railroad tracks on the property Right-of-
Way. The fence must be fire proof and should be chain link type.
