RESOLUTION WHEREAS, a public hearing was held on August 26, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Harold Baumgartner, Box 3, Brighton, Colorado, requesting permission to locate a gravel pit operation on the following described property, to-wit: The Southeast Quarter of the Southwest Quarter (SEj'--SW1) of Section 9; the Northwest Quarter (NWI) of Section 16; part of the Northeast Quarter (NEa) of Section 17, all in Township 2 North, Range 68 West of the 6th P. M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northwest Corner (NWCor) of the Northwest Quarter (NWI-) of said Section 16, and considering the North line of the Northwest Quarter of said Section 16 to bear North 89°30'23" East, with all other bearings contained herein being relative thereto; Thence North 89°30'23" East along said North line; 1301 . 56 feet to the Southwest Corner of the Southeast Quarter of the Southwest Quarter (SWCorSEfSW4) of Section 9; Thence North 00°30'29" East along the West line of the Southeast Quarter of the Southwest Quarter of said Section 9, 1350. 91 feet to the Northwest Corner thereof; Thence North 89O5014811 East along the North line of the Southeast Quarter of the Southwest Quarter of said Section 9, 1310. 65 feet to the Northeast Corner thereof; Thence South 00°54'03" West along the East line of the Southeast Quarter of the Southwest Quarter of said Section 9, 1343. 31 feet to the Northeast Corner of the Northwest Quarter (NECorNW4) of said Section 16; Thence South 00°18'38" East along the East line of the Northwest Quarter of said Section 16, 2656. 36 feet to the Southeast Corner thereof; Thence North 89°59'44" West along the South line of the Northwest Quarter of said Section 16, 2669. 77 feet to the Southwest Corner thereof; Thence North 89O4610811 West along the South line of the Northeast Quarter of said Section 17, 2141. 68 feet to a point on the North- easterly Right-of-way line of the Chicago, Burlington and Quincy Railroad; Thence North 51°06'24" West along said Northeasterly Right-of-way line, 637. 99 feet to a point on the West line of the Northeast Quarter of Section 17; Thence North 00°35'42" East along the West line of the Northwest Quarter of said Section 17, 909. 77 feet to the Northwest Corner of the Southwest Quarter of the Northeast Quarter, (NWCorSW4NE4) of said Section 17; Thence South 89°57'18" East along the North line of the Southwest Quarter of the Northeast Quarter of said Section 17, 1327. 48 feet to the Southwest Corner of the Northeast Quarter of the Northeast Quarter (SWCorNEjNE4) of said Section 17; Thence North 0005210111 East along the West line of the Northeast Quarter of the Northeast Quarter of said Section 17, 1312. 70 feet to the Northwest Corner thereof; Thence North 89°51 '39" East along the North line of the Northeast Quarter of said Section 17, 1333. 78 feet to the Point of Beginning. PL0801 750204 Said described tract of land contains 318. 145 acres more or less, including a strip of ground 30 feet in width along the South line thereof for County Road Right-of-way purposes, and is subject to any other rights-of-way or other easements as granted or reserved by instruments of record or as now existing on said tract of land, and WHEREAS, the petitioner was present, being represented by counsel, Ed Brown of Brighton, Colorado, and WHEREAS, there was some opposition to the request of petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone, as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Harold Baumgartner (Platte Gravel) Box 3, Brighton, Colorado, to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That owner, contractor or operator, prior to opening any pit, shall submit location of pit, owner's name, and description of pit operation to the Weld County Engineer, and shall submit complete unit development plans for each gravel pit operation for approval by the Weld County Planning Commission and such unit development plan shall be filed in the office of the Weld County Clerk and Recorder. 3. That petitioner shall proceed with due diligence to effect construc- tion of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 4. Subject to a suitable four-strand barb wire fence, with in-between stays, being erected around the perimeter of the premises. 5. That petitioner post with the Weld County Board of County Com- missioners a cashiers check or a bank letter of credit in the sum of Two Thousand Dollars ($2, 000. 00) which shall be held in escrow by the County until petitioner or his successors and assigns use Weld County Bridge 20+/ 15A for hauling gravel from subject property gravel pit operation, and such proceeds shall be applied to the County expense in widening said Bridge 20+/ 15A. 6. That petitioner shall submit for filingwith the County a proper agreement containing the necessary restrictive covenants and providing for -2- water augmentation due to the mining of the gravel as may be agreeable with the water users association of District No. 6 . 7. That the operation and development of each gravel pit excavation and rehabilitation shall be in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 8 . No gravel pit operation will be allowed on subject property unless conditions contained in paragraphs 5 and 6 hereinabove are absolutely complied with. 9 . That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. In preparation ' for this analysis, we reviewed the correspondence and documents enclosed with your letter, along with information on historical cropping from the U. S. Soil Conservation Service. As shown on Exhibit A, we estimate that the average annual total con- sumptive use of water from all sources (precipitation, ground water and irrigation ditch water) on the 317-acre tract has historically been about 756 acre-feet. This estimate is based on the assumption that the irrigated crops have historically had an adequate water supply most of the time. Exhibit A also shows that the estimated average annual total consumptive , use of water from the 317 acres after completion of mining and reclamation is 786 acre-feet. This estimate assumes a final water-surface area of 201 acres as depicted on the "Rehabilitation Plan" bearing the revision date of September 25, 1974. These analyses indicate that the total consumptive use of water from all sources can be expected to be about 30 acre-feet per year more after completion of the mining and reclamation activities as compared to the historical use. It is also important to determine as near as possible the average annual consumptive use attributable to irrigation ditch water and ground water before and after mining. Part II of Exhibit A shows our estimate of the historical consumptive use of irrigation ditch water to be about 488 acre- feet per year. After completion of the mining and reclamation activities and putting 50 acres of land under irrigation, we estimate the average annual consumptive use of irrigation water to be 102 acre-feet. Brown December 19, 1974 Page 2 • Part III of Exhibit A shows the expected change in consumptive use of ground water. We estimate the historical average annual consumptive use of ground water to be about 118 acre-feet. After completion of mining and reclamation, the estimated consumptive use of ground water will be 442 acre- feet,or an increase of 324 acre-feet. The net change in use of the combina- tion of irrigation ditch water and ground water is estimated to be a reduction of 62 acre-feet per year from before-mining to after-mining conditions. We understand from the information provided to us the property has been irrigated with water provided by five shares of the Godding, Dailey and Plumb Ditch, one and one-half shares of stock in the Smith and Emmons Ditch and 100 units of Colorado-Big Thompson Project water. Using data we have in this office, we estimate the average volume of water available from these three sources has been 652 acre-feet per year. This assumes each share of Godding, Daily and Plumb to be worth 54.4 acre-feet, each share of Smith and Emmons to deliver 206.5 acre-feet and each unit of C-BT to deliver 0.7 acre-feet. This is slightly more than the information provided in your letter of October 29. If we use that data plus the 0.7 acre-feet per C-BT unit, the total average annual delivery amounts to 602 acre-feet. The 50 acres proposed to be irrigated at the completion of mining represents 20 percent of the historically irrigated acreage. Both stock and C-BT units representing 120 to 130 acre-feet of water should be retained for this purpose. In brief, we estimate that the burden on Boulder Creek,and therefore on the District 6 water users, will not be as great after mining and reclamation as under the historical irrigation practices. If all of the water now used on the property except approximately 130 acre-feet is left in Boulder Creek, and that 130 acre-feet used on the 50 acres of land proposed to be irrigated after reclamation, there should be no harm dope to the other water rights. We, therefore, recommend that these figures be incorporated in a plan for augmentation for the property. We see no need to enter into a separate agree- • ment with the District 6 water users. The matter of progressive release of the water to the river over the • five to ten years of gravel mining should be treated in the plan for augmen- tation. If the expected minimum mining time is five years, I recommend that the plan for augmentation indicate a 20 percent release per year of the por- tion of the shares of stock that will be allocated to this purpose. Protection should also be incorporated, as you have suggested, in case the project is stopped for one reason or another, and the full mining plan is not carried out. I should point out that one of the critical numbers in the above analyses is the 201 acres of free-water surface after completion of mining. I under- stand that no test boring has been performed, therefore the depth and thick- ness of the gravel deposit, as well as the volume of overburden and reject material is only estimated at this time. It would be advisable to determine this information more accurately because, as you can see, the surface area of the remaining lakes heavily influences the amount of expected consumptive use. AGREEMENT REGARDING SAND AND GRAVEL SPECIAL USE PERMIT AND RESTRICTIVE COVENANTS PERTAINING THERETO. THIS AGREEMENT is made this day of 197 , between , hereinafter termed the mining company, and hereinafter termed the Owners , and THE WATER USERS ASSOCIATION OF DISTRICT NO. 6 , a Colorado nonprofit corporation, hereinafter termed the Water Users; WITNESSETH WHEREAS, the mining company has purchased from the Owners certain sand and gravel in place described County, Colorado, and has applied for a special use permit from County and the State of Colorado; and The mining company is principally responsible for completion of mining and reclamation plans submitted to County, such plans consisting of a letter from and such other documents , maps and plans as have been filed with and approved by County; and The Owners are required to furnish augmentation water to compensate water users in Water Division No. 1 for anticipated evaporation losses and changes in increased water usage in the area covered by Exhibit A as a result of the mining and reclamation; and The Division of Water Resources of the Department of Natural Resources of the State of Colorado has approved the plan of augmentation herein described, subject to the approval of the Water Users; and WHEREAS, the Water Users have objected to the mining, reclamation and augmentation plans unless additional conditions are met and the mining company and the Owners are agreeable to these additional conditions; NOW, THEREFORE, it is mutually agreed as follows : 1 . The mining company agrees as follows : a. To conduct the mining operation in accordance with the requirements set forth in the mining plan and the regulations of County and the State of Colorado; b . To restore the premises to the condition set forth in said reclamation plan and the regulations of County and the State of Colorado; c . To construct the ponds contemplated by the plans in a good and workmanlike manner, and in such a manner that the same will be a part of the appropriation system and will have inlet and outlet structures which can be controlled by the State of Colorado Division of Water Resources and the Division Engineer of said Division No. 1. d. To cause all surface and subsurface drainage to drain naturally back into Boulder Creek and to construct a perimeter drainage system around the proposed excavations to aid in the drainage back into Boulder Creek in accordance with said plans ; such construction to be completed so that the drainage system will be self-maintaining or maintenance free; e . To slope the flood channel of Boulder Creek on a constant slope to the trickle channel of Boulder Creek ; and to reduce the trickle channel of Boulder Creek to approximately feet. f . To reconstruct The Ditch in such a manner as to meet the approval of the Board of Directors of The - 2 - Company and to install measuring devices in and out of the property to insure there shall be no losses to the ditch other than its historical losses ; g. To reimburse the Water Users for its necessary and reasonable attorneys fees and engineering fees for the preparation of this agreement, reviewing the plans , and conferences pertaining thereto. 2. The mining company and Owners further agree as follows: a. As long as they, their heirs , successors and assigns , own or have an interest in the property described on Exhibit A, they will maintain the restored structures , including ponds, ditches, channels and pumps in a good and working order and will do nothing to said structures which would adversely affect the interests of the members of the Water Users ; b. They will not claim, as a result of mining and restoration of the property, that any water has been salvaged or developed; any water to be used in the mining operation and restoration process will be considered tributary water to Boulder Creek and be subject to the appropriation system and the other existing laws of the State of Colorado; 3 . The Owners further agree as follows : a. They and their heirs , successors and assigns will allow all water attributable to shares of the capital stock of The Ditch Company, a Colorado corporation, to not be diverted through its headgate and to remain a part of the water of Boulder Creek; or, if diverted, shall not be used and shall flow back into Boulder Creek. b. The land heretofor irrigated by, and water hereto- for attributable to such shares shall no longer be irrigated or used by such shares except as herein provided; c. The ditch stock certificate for said shares shall be endorsed as follows , to-wit: "These shares and the usage of water attributable thereto are restricted by an agreement dated entered into between , et al, and The Water Users Association of District No. 6 , a Colorado nonprofit corporation, and are subject to the terms of that agreement. Enforcement. This agreement may be enforceable by the Water Users , any of its members who are adversely affected by any violation of any term hereof, by County, by the Division of Water Resources of the Department of Natural Resources of the State of Colorado, or the Division of Mines of the Department of Natural Resources of the State of Colorado, by seeking any appropriate equitable and legal remedies , includ- ing injunctive relief, specific performance and damages . In the event such enforcement is necessary, the mining company and Owners, and their heirs , successors and assigns , jointly and severally, agree to pay for any reasonable attorneys fees and costs necessary in obtaining such enforcement. 6 . Objections to Permit. In consideration of the covenants herein contained, the Water Users hereby withdraws its objections to granting the special use permit and consents that the same may be issued at the discretion of County and the Division of Mines of the Department of Natural Resources of the State of Colorado. Since a detailed plan of augmentation was not submitted concerning type of crops that have historically been grown on this parcel of land, the consumptive use of these crops, historical return flow patterns, yields of the ditch com- pany stock, elevation of the finished lakes and the flow line of Boulder Creek, and anticipated evaporative losses, many assumptions have been made in order to determine historical water use volumes and anticipated water use volumes as they relate to the rehabilitation plan. If the assumptions District 6 Water Users have made in evaluating this plan of agumentation are correct, it appears that the land envisioned for gravel mining has historically needed approximately 639 acre-feet of water during a critical water year (such as 1954) . The water currently owned by the applicant has furnished approximately 500 acre-feet of water, while the remaining 139 acre-feet of water probably has been furnished by the high groundwater table in the area. The applicant's reclamation plan will consume approximately 753 acre-feet of water, or approximately 114 acre-feet of water more than the land is consuming now. Therefore, District 6 Water Users recommend that the applicant assure, via contract, the District 6 Water Users that he will furnish the waters in his plan of augmentation (i .e. , 100 units of Northern Colorado Water Conservancy District water, five shares of capital stock of Godding, Dailey, and Plumb Ditch Company, and one and one-half shares of stock in the Smith and Emmons Ditch Company) and an additional 114 acre-feet of water from a source of his choosing. Since many assumptions were made in compiling the above figures which may or • may not be correct, if the applicant does not wish to furnish an additional 114 acre-feet to the District 6 Water Users, then the Water Users recommend that the applicant submit his own plan of augmentation to District 6 Water Users for their review. DISCUSSION: Mr. Intermill stated this was owned by Roland Miller; pit lays in and adjacent to a present gravel pit in the area. Propose to lower and extend the southeast portion of the present pit about five to six feet. Feel there is about 4,000 cubic yards of material available. Processed through a screening plant and then stockpiled to be hauled away as needed. Used for sanding of roads in the winter. Hard to determine length of time this will be used. Will not go below present water table. Mr. Anderson looked over the site. Could see no problems. About 4/10 of an acre. Weld County Planning staff recommends approval for the following reasons: (1 ) Platteville has no objections; (2) Agrees with Weld County Comprehensive Plan in extracting our natural resources and supplements H.B. 1529 regarding sand and gravel extraction; (3) Due to the fact that this is a State Highway Dept. site, the extraction and reclamation standards are included within the cover letter. Originally stated that there would be about 75 persons, however, it should have been 175 persons. Mr. Bockus stated that he had contacted the State Engineer's Office but had no final answer as of yet. Mrs. Lee stated that there were two new letters received from (1 ) District 6 Water Users; (2) St. Vrain Left Hand Water Conservancy District. Read them into the record. They basically are not opposed to the gravel operation; they would like an agreement between District 6 Water Users and the applicant. Mrs. Lee read both letters into the record. Planning staff recommends approval for following reasons: (1 ) Agrees with Weld County Comprehensive Plan and Weld County Zoning Regulations in extracting our natural resources; (2) It agrees with H.B. 1529 in the mining of sand and gravel ; (3) The reclamation plan has been revised and accepted by the Planning staff. Mr. Heitman wanted to know why, if the augmentation plans were approved by the State Engineer's Office, we should be involved with District 6 Water Users. They should be concerned with the State Office, not the applicant. The people that cause the loss of water are obligated to correct the situation. Until the State Engineer gets better regulations , we have to rely on the augmentation plans. Following staff recommendations, the parcels will be 50 acres and 150 acres instead of 93 and 215. Will go about 27' deep, making it about 12' to 20' below the Boulder Creek bed. It is located partially in the flood plain as noted in the Weld County Comprehensive Plan. They are going to dike the Boulder Creek on both sides to keep it as is. It is joining with Boys' World in California which has been in operation for about eight years. There are some "L" shaped buildings which will be used for staff housing. They are already on the property and the building inspector has inspected them prior to their moving them. North of there is the building that will serve as, a cafeteria and classroom areas. Round buildings will serve as cottages for the boys. These to be constructed in the future. Each will house approximately 12 boys and a set of house parents. There is also an old church building located on the premises. Mr. Steele stated they were concerned about odor control , expulsion, drainage, flash flooding, etc. 1056 I The lagoon will be located quite some distance fromlthe buildings. It will be a series type lagoon. The overall operation will have about 50 people. Access to the property is from the North presently, coming in off of Co. Rd. 110. Approximately 22 acres of wheat, rest in pasture. Most of the boys will be ten through fourteen. Most of them will have learning difficulties or possible home problems; they will not be de- linquent boys and will not be placed by the courts. Most will be placed by private individuals. There will be a school on the property having a certified teacher. They have dug footings and poured concrete walls according to Building Code specifications. However, there are no building permits issued at this time. They were under the impression everything was ok; not trying to be illegal . Water has been approved through a 50 gallon permit well located approximately 1500' from the east section line and 880' from the north section line; puts it over approximately between the two ponds in that area. It is the proposal to have a fire line run in front of the cabins. Do have plans to expand possibly to have a separate operation for girls. Will probably use pressure pump for the lake for fire protection. There are State regu- lations regarding fire safety; schooling; etc. , that will be met. Weld County Planning staff recommends approval for the following reasons: (1 ) It agrees with the Weld County Comprehensive Plan and Weld County Zoning Resolution in promoting agricultural uses of the land; (2) Health Dept. recommends approval . The Planning Commission, however, did not approve this type use, but stated they would recommend the Industrial use. This parcel at one time was in the city limits of Platteville, but has since been deannexed. There is some problem with the access. Not sure if it has been vacated yet. There is a right-of-way lease on the railroad property. Need to renegotiate a lease with the railroad regarding uses on the property. This was considered and left up to the Town of Platteville whether or not it should be a PUD or straight zoning. They stated they would support straight "I" zoning. Is located in their comprehensive planning area. Weld County Planning staff recommends this request be tabled for the following reasons: (1 ) Although Platteville has shown support for this application, there is a need for Mr. Farley to renegotiate with the Union Pacific Railroad. The new lease should eliminate the restriction to agricultural use and also should provide access to the property. Also, at this point, the lease does not describe the entire parcel ; it falls short. The parcel is about 450' deep. If he goes to an I-UD, he would first have to go before the Board of Adjustment for a variance on lot 1057 size. It was felt that it would he better for all if it would go through an I-UD instead of straight I zoning. This will give better control re- garding what could be put into the area. SUBJECT: Chalet West APPEARANCE: Doug Sears Tape 547 DISCUSSION: Mr. Fortner stated that Mr. Sears would like the Planning Commission to review the possiblity of changing the density. Overall density will not change. Mr. Sears felt that the PUD had created a white elephant as it is presently not marketable as is. Asphalt already installed is deteriorating from lack of use. The amendment to the PUD he is requesting is very minimal at this time. The PUD limits the use to duplexes, four-plexes and tri-plexes. About 39 total acres. Would like to take the 21 acres left and file for single-family units but keep the overall density of 6 units per acre. Put the additional units, which would be about 10 units per acre if allowed, against the mobile home court. That would make it a high density transition between the mobile home park and the single family to the north. Representing Reiker, Haney & Smith as the developers and owners of this property. Mr. Sears wanted the Board to authorize the Planning Director to give him a letter that states the amendment proposed warrants further pre- sentation. Replatting would not solve the problem. One paragraph of the PUD needs to be changed to allow single family units. Everything else is ok to do what they are seeking. Mr. Weigand stated that all they could do today is to authorize their staff that, due to the pre- sentation today, they would accept an application with this amendment; then he (Sears) follows through with the rest of the necessary steps to get this thing done. Also, the Board required a hydrology report, do they still want it. He is asking if he could provide a water augmentation plan instead. The main reason for the hydrology report is because of the changing of the river channel . It was asked if Mr. Spallone put the river channel back to the original flow, would the hydrology report still be required. In the beginning, even the water users felt that if the creek were channeled, it would be a benefit to the entire area. Mr. Spallone was simply trying to help. The main reason it didn't work out, is because he doesn't own enough property to continue channeling it on through. He can straighten a channel on his property as such, however, if any damage comes to anyone because of it, he would be fully liable. It was felt that they shouldn't have to spend a lot of money to have a hydrology report done. The main concern is what will happen upstream and downstream because of the change in river channel . First phase will be a new haul road out to Hwy 52 and closing the opening on County Road 1 . Second phase will be construction of two more pits and moving the crusher lo- cations. Third phase will be construction of another pit and the final rehabilitation will be cleaning up the area. Total acreage is about 300.906 acres. Mr. Houtchens stated that it was about the spring of 1973 when Mr. Spallone had contacted him and inquired about some land that had an existing sand and gravel operation there. Wanted to know if Weld County had any regulations regarding this. Mr. Houtchens stated they did and would send him the necessary forms. About the summer of 1973, H.B. 1529 was passed and there was a good deal of con- fusion surrounding how this Bill would apply to sand and gravel oper- ations and how the County's regulations would inter-relate. Mr. Houtchens asked the Planning staff to obtain an opinion either from the County Attorney or the State Attorney General 's Office so they would know how to proceed. He was told at that time that as long as Mr. Spallone continued operations at this site, since it had been in existence for a number of years, that regardless of what happened on the State level , he wouldn't 1040 need any County approval because it was a pre-existing use. Mr. Houtchens advised Mr. Spallone of this, and further advised him to contact the State Bureau of Mines and proceed to obtain whatever State permits he needed. They (the State) wrote Mr. Spallone a letter stating that they hadn't adopted procedures to implement this new House Bill ; but as soon as those procedures were adopted, he would be notified. Mr. Spallone also asked Mr. Houtchens about straightening the channel of the river on his property. Mr. Houtchens advised him that it might create some problems that wouldn't involve Weld County, but might involve water users and possibly the State Engineer's Office. The State Engineer's Office said advised Mr. Houtchens of general principles of water law and water law liability arising out of changing the channel of a river. Subsequently, Mr. Spallone was contacted by the Weld County Planning Office and advised that the problems between the new State Law and the County Zoning Regulations had been resolved and it was de- termined that the County still had the authority to grant land use permits for sand and gravel operations; it was questionable whether or not his operation still constituted pre-existing use and he should come forward and make application for a special use permit just to be sure. Mr. Spallone has taken these steps since that time. Mr. Houtchens stated that the neighbors in the area are basically concerned with what will happen to the natural drainage pattern. Mr. Spallone and his engineer (the County Engineer and the engineers from the State have looked at this property) and feel that, based on the advice they have, nothing has been or will by this plan be created that will cause a water hazard to any other adjoining properties. Planning staff recommends this be tabled for the following reasons: (1 ) Provide a hydrological study by a qualified engineer to determine if the proposed channelization of Boulder Creek will cause flooding up or down stream; (2) Provide augmentation plans for water loss due to evaporation from the services of the proposed lakes; we further recommend: (1 ) That they prepare a right-of-way deed of 20' on County Road 1 ; (2) Prepare right-of-way deed for 15' on State Highway 52 as requested by the Colorado Highway Dept. ; (3) Change cross-section of haul road across Boulder Creek to lower swale an additional 24 inches; (4) Add the 4,955 foot contour. Mr. Lorenson further stated that there was one other thing requested by the County Engineer. He felt that the finished road grade should be 6" above the existing finished grade. Mr. Lorenson asked the County Attorney representative regarding the 20' right-of-way. Mr. Hellewell stated that we could not legally require them to comply, but we can ask for dedication should the road need to be widened. Mr. John P. Donnelly, representing some of the residents who live adjacent to the gravel pit, directed some questions to the staff and also had some information they would like to make available. First, is the staff going to ask the inspector of Bureau of Mines to conduct a study of the operation and incorporate that study into their report. It' s in the Statute regarding Open Mining Operations. Mr. Donnelly felt that the inspector might have some valuable information to contribute. Mr. Hellewell stated that the Bureau was so backlogged, it might be 15 years before any thing could be accomplished. Mr. Lorenson stated that they had sent this application to the State Geological Survey and they, in essence, act as the Planning staff's consultant. In addition to that, it has to be approved by the Land Reclamation Board (a member of the Mine staff is on that Board). Flood control was the main concern. Mr. Donnelly wanted to know how much gravel had been mined prior to September of 1973. Mrs. Lee read a letter from Mr. Marvin Swanson stating that his father (the late Carl 1041 Swanson) had purchased a parcel of property in Section 31 , Weld County, Colorado; and since that time gravel has been removed from that property on several occasions. The letter was dated August 8, 1973. Mr. Donnelly stated that he has people living there for 30 years that state there has been no gravel operation there. Mr. Donnelly stated their principal con- cern is with the dike that is constructed across the south end of the property. They had a number of pictures showing flood conditions in 1969 and 1972 and what will happen to that area if the dike is allowed to re- main as is and proper precautions are not taken to allow for proper flood control projects, spillways, etc. , to relieve the pressure. It floods in a northerly direction and empties into Boulder Creek, and further south is Coal Creek; in times of heavy rainfall , Coal Creek overflows, because it can't handle the water, and flows northerly into the natural drainage of Boulder Creek. Mrs. Carol Martin showed her pictures of the flood in 1969 and the one in 1972. Mr. Donnelly stated that he understood that the purpose for the construction of the dike was because one of the accesses is out over a load limit bridge and have been requested not to use this bridge because their loads exceed the limit (Boulder County's bridge and it was their request to stop usage). So now they are coming out around the property to get access to a road and bridge that will handle the loads. Part of this is what the recommendation regarding lowering the haul road refers too. Tape 541 Mr. Donnelly stated that the thing they wanted was adequate planning so that with the 100 year high water mark, no flooding would occur. This dike they have put in has stopped the water and is impeding its flow. Would like to know what straightening the channel will do in case of a flood. Mr. Norman Johnson showed where his property was and stated the flood water took out his ditch last spring. The new canal he built will have no effect on flood waters; it will flood before it ever gets to it. Mr. Donnelly wanted the Planning Commission to really take a look at the impact of these structures (landfills, or whatever) on the water flow and potential floods. Second, if they don't have authority to operate, there ought to be a Cease and Desist Order issued. The County Attorney did not recommend this type of Order, the best would be a positive injunction. Mr. Ken Dikke, District 6 Water Users Association read a letter regarding their recommendations on this gravel pit. First, regarding the application of Turnpike Construction Co. , the depth of the proposed excavation is not indicated. It covers 100 plus acres, it is obvious that removal of a great amount of material could cause serious environmental impact on areas extending well beyond the site. There is no evidence that such an impact study has been made which could provide a suitable basis for the plans of evaluation that the Commission needs to judge the merits and demerits of this proposal . Secondly, the application does not show how the stream channel and normal flow will be maintained throughout the operation. Want to assure that all water rights downstream will be adequately protected during and after the operation. Further,it is not indicated how the flood waters or flood flows would be controlled. Significant changes in the channel will be required for effective mining operations. Straightening of the channel (and shortening) is indicated. This would increase the channel grade and increase the stream flow with the result that much of the energy, that is now absorbed by the meandering channel will then be concentrated in those reaches of the channel just below the site. This would cause appreciable change in the errosion pattern and could cause extensive damage to agricultural land, fences, roads, water control structures and so forth. The drawing for the application shows four 1042 . separate lakes to be formed. There is no showing depths or how the water surface elevations are to be controlled, (what effect will this have on ground water levels in adjacent areas; what about the increase in evapor- ation on those lakes that may affect normal standflow; who will have the continuing responsibility for an increase in liability that may be as- sociated with these lakes) . Mrs. 0. W. Smith - How much pumping did they intend to do, as it lowers well water levels; their property has eroded from the river channel about 10 feet so far; livestock is getting out because of this. Mrs. Lee read letter from Mr. Blake, Mining Department dated September 1973, addressed to Mr. Spallone. It basically states that no plans of implementation of provisions of House Bill 1529 had not been worked out yet. Mr. Spallone's letter of request for forms is on file in that office and until such time that they can proceed with the issuance of required permits, Mr. Spallone's letter of request will be his insurance against operating your property illegally. When the necessary forms are available, they will contact Mr. Spallone. Mrs. Smith stated that the level of the river has dropped considerably since the beginning of Mr. Spallone's operation . Jack Hill , Godding Ditch Co. , mainly concerned about their headgate being washed out with the straightening of the channel . Also concerned with a silt problem; who would be responsible for damage caused. Copy of letter Mr. Hill read submitted to file. John Lamar, owned 160 acres just north of this site. The first gravel operation on his property had a channel and a 70' bridge and he never had any trouble with it washing out a headgate. He had no objections to the operation proposed by Mr. Spallone. Dave Camenisch, representing Rural Ditch, submitted letter. Mrs. Lee read letter, basically concerned with: (1 ) Entire river and its course has been changed; in case of flood, it could by-pass the Rural Ditch headgate on either side and cause great damage and undue hardship to ditch stockholders. (2) Flood waters in the past have dumped into Boulder Creek; when this has happened, the water has flowed over its banks onto the flat lands to the east leaving the Boulder Creek not subject to much increase from this point on (just above their headgate). But since the river is now capable of carrying all of this water, the flood waters flow on down the Boulder Creek and they want to know who will be responsible if their ditch is eroded away by Boulder Creek. Not against gravel operations, only concerned with protecting their ditch and the ditch stockholders. Mr. Donnelly requested the Planning Commission to decide if this operation should be stopped and proceed with recommending to the Board of County Commissioners to issue a stop order. Mrs. Gieblehouse, wanted to know, while they are digging the gravel , would it affect the quality of the well water. Mr. Watson stated that this was one of the issues under consideration. MOTION: By Mr. Anderson, To table this and take a field trip to the site within seven days. Seconded by Mr. Rothe. A vote of "Aye" by Watson, Nix, Anderson, Heitman and Rothe. RESOLUTION: To recommend to the Board of County Commissioners that a "Cease and Desist Order" be issued until such time it can be determined to be in compliance. Property consists of 300 plus acres; lies sort of on both sides of Boulder Creek. Will be a wet pit operation. There will be five stages, each lasting approximately one year. Operation will conform to Weld County Zoning regulations and also the Colorado Open Mining Land and Reclamation Act of 1973. There will be three to six employees; operating hours to comply with regulations; all air and water pollution standards will be observed. Old top soil will be stored and stockpiled as needed. Reclamation plan presented. There will be two lakes, one approximately 215 acres and one about 93 acres. Diking will be replanted and they will preserve as much of the present vegetation as possible. Will be used for recreational uses. Mr. Bockus read from the Weld County Comprhensive Plan, Number VI , Item #6 page 50 and page 71 . Planning staff recommends this be tabled for the following reasons: (1 ) Inconsistancies between the stated plan and the map of the plan; (2) Inadequate recreational site plan; (3) Inadequate information pertaining to overburden and stockpiling. Mr. Roy Jost read further comments per- taining to: Inadequate access to the larger of the two lakes; no indi- cation of how stated recreation activities are planned or provided for; some confusion regarding the vegetation; concern regarding overburden storage plans; possible inadequate width of drainage corridor of Boulder Creek (diked on both sides); possible inadequacy of wildlife cover, shore- lines and accesses to area; and it is recommended that an augmentation plan concerning how the river will be compensated for the evaporative losses of the two lakes be presented. Mr. Dikke from the District 6 Water Users Association brought up the same questions brought up earlier concerning Turnpike Construction. Basically concerned with flooding possibilities and protecting the users of the ditch waters. Also loss by evaporation. They figure they would lose 900 acre feet of water on 300 acres of land. It was asked if a fund of some type could be set up where a set amount would be charged per ton of gravel extracted and this money in turn would be used for maintenance of the area in later years. Mr. Freese stated that actually, the widening and straightening of a stream tends to make it more capable of handling flooding possibilities instead of a meandering stream that tends to erode its banks. He further felt that this project would help the flood problems. Felt that they could widen Boulder Creek in that area and make it an adequate depth to aid in preventing floods. Mr. Bockus stated he could see no real conflict with the staff recom- mendations. Mr. Lorenson stated that the plans did not need to be quite as detailed as mentioned, but they should leave enough ground to do some- thing with. Be able to leave more than just a 10' path around the lakes, etc. The State Reclamation Board will require bonding before this project is started. Mr. Milton Nelson, Boulder Creek District 6 Water Users Association, stated concern regarding time involved for the water to reach the headgates. SUBJECT: Irving Ferrell , Jr. Tape 542 DISCUSSION: Mr. Lorenson summarized the situation by stating that the office had received information regarding Mr. Ferrell ' s sale of fertilizer from his property where there is a large manure pile. A letter of violation was sent to Mr. Ferrell as this is not a use allowed in an "I" zone. The Ferrill 's were under the impression that this use (stockpiling of fertilizer) was allowed. Their attorney, Mr. Dinner, has since been into the office regarding this matter. Mr. Ferrell is requesting that he not be made to move this pile until the spring when he will be getting rid of it anyway. Previous location had been in the County (101 - 8th Street) and had been there since 1961 , prior to zoning. It was then annexed into the city of Greeley. Mr. Ferrell had checked with the Planning Office regarding the zoning. Has building permits for sheds to be remodeled. Got' a letter from the attorney's office stating they were legal . Mr. Ferrell has been selling fertilizer for several years. If he's not legal , he'll clean it up and sell out as soon as he can. He has about 5,000 tons stockpiled. It would take about a year to clear the ground. Mr. Hellewell informed the Board they could either recommend to the Board of County Commissioners that he cease operation immediately, or give them the year requested. Mr. Hellerick, Attorney, also checked this property for the zoning, but did not find out what uses were allowed. No motion is needed at this time as they still have a few days before their allowed time (by the violation letter) is up. SUBJECT: Change of Meeting Date Tape 543 DISCUSSION: There has been some discussion regarding changing the meeting date from the first Monday and third Tuesday as Monday sometimes is a busy day for several members of the Commission and the staff. It's difficult to write staff comments and discuss them with the applicant(s) . It is recommended we allow 30 days lead time on all cases (SUP, Zone Changes, etc. ) . This will allow sufficient time for return input plus comply with State regulations. Planning Commission has the right to set reasonable procedures outside anything else. Re- maining overburden , if depth to gravel is as little as two feet , will cover this same ten acres with an addi - tional 45 feet of soil . a . It is suggested that this site is inadequate for over- burden storage for the entire operation . b . The extraction plan states intention to excavate the site in stages . It is recommended that the overburden from any stage of excavation be stored on the site of the next stage of excavation . Upon completion of mineral extraction of any stage , the stored overburden can be used for the reclamation of that site . The plan envisions mining for gravel in part of the Northeast one-quarter of Section 17, the Northwest one-quarter of Section 16, and the Southeast one-qaurter of the Southwest one-quarter of Section 9, all in Township 2 North, Range 68 West. The total area under which the mining operations will be conducted is approximately 318 acres. The plan envisions mining the above described property over a five year period. Upon completion of the mining operation, there will be in existence two lakes with a total of approximately 308 acres of open water surface area. With estab- lishment of these lakes, the area would be consumptively using much more water than it has historically consumptively used in its present state, which is basically pasture land. No plan of augmentation has been submitted in the Agricultural Unit Development Plan concerning how the river will be compensated for the evaporative losses of the two lakes, or how return flows which have historically flowed to this property will be returned to the river. As this plan is currently envisioned, Last Chance Ditch, which has an appropria- tion for approximately 96.94 second-feet of water in Water District 5 ( in the St. Vrain & Left Hand Water Conservancy District) would be damaged to the extent of reduced flows available for appropriation unless an augmentation plan is presented to augment the river the additional depletions that will be caused by the lakes. Careful management is needed to keep these soils from becoming too wet to cultivate and farm. 34P-AB Wet loamy soils This is a moderately shallow, poorly drained soil with a medium textured surface and subsoil. Depth to sand and/or gravel is 20 to 40 inches. The soil is mottled from 10 inches downward and may or 'may not have a water table within 60 inches. The soil is usually moderately saline. Careful manage- ment is needed to keep these soils from becoming too wet to cultivate and farm. 51B-A Vona sandy loam This is a deep, well drained soil with a moderately light textured surface and subsoil. The subsoil is weakly developed. Water intake is medium to rapid. Water holding capacity is poorto fair. Erosion hazard from both wind and water is moderate. Organic matter maintenance is important. Slope is 0-1%. 51B-B Vona sandy loam Same soil as described above, except the slope is 1 to 3 percent. 51B-C Vona sandy loam Same soil as described above, except the slope is 3 to 5 percent. 4 CO-CONS-2 CAPABILITY GROUPS OF SOILS Capability classification is the grouping of soils to show, in a general way, their suitability for most kinds of farming. It is a practical classification based on limitations of the soils. the risk of damage when they are used, and the way they respond to treatment. The soils are classified according to degree and kind of permanent limitation, but without consideration of major and generally expensive landforming that would change the slope, depth, or other characteristics of the soils; and without consideration of possible but unlikely major reclamation projects. Roman numerals are used to show the 8 broad Capability Classes and letters follow the class numeral to indicate the principal problem or hazard. Classes and sub-classes used are as follows: Class I - Few or no limitations that restrict choice of crops or require conservation measures. Class II - Some limitations that reduce the choice of crops or require moderate conservation measures. - Class III - Severe limitations that reduce choice of crops or require special conservation practices or both. Class IV - Very severe limitations that restrict the choice of crops , require very careful management, or both. Class V - Not suited for cultivation but has few or no hazards when used for pasture, range, woodland or wildlife. Class VI - Not suited for cultivation. Severe limitations. Suited for range, pasture, woodland or wildlife with careful management and needed conservation practices. - Class VII - Not suited for cultivation. Very severe limitations. Suited for range, woodland or wildlife uses if carefully managed. Usually cannot apply physical practices such as pitting, furrowing, seeding, etc. Class VIII - Not suited for cultivation, range, pasture or woodland. Suited only for recreation, wildlife, water supply or esthetic purposes. e - Erosion by wind or water is the major problem. w - Excessive water such as wetness, overflow, or high water table. s - Major problem is in the soil. It may be too shallow, too heavy, stony, low in fertility, salty, alkaline or have low moisture capacity. c - Climate is the major hazard. Growing season may be very short, there is a shortage of rainfall or both. Examples: IIIe - Class III land where erosion is the major hazard. IVc - Class IV land where the climate is the major problem. July 5, 1974 Suite 300 1350 Chambers Road Aurora, Colorado Weld County Planning Commission Board of County Commissioners Gentlemen: The Platte Gravel Corporation (also known as Adams Transit Mix) which employes 180 people and is located two miles south of Fort Lupton on Highway #85 in Weld County has applied for an Agricultural Unit Development Plan--sand and gravel mining in 5 1/4 of Sec 9 , the NW 1/4 of Sec 16 , and the NE 1/4 of Sec 17 all in TZN, R68W and consisting of approximately 318 acres f. Since the original hearing before the Planning Commission on June 18th, we have incorporated your staff ' s recommendation and suggestions into our plans although they were over and above of what your present zoning regulations require. We sincerely hope that this meets your favorable consideration and approval. We have also reviewed and considered other letters and comments as submitted to you by other agencies expressing interest in our proposed plans. The following are our comments to the various letters received by us from your planning staff: 1. Letter dated May 17, 1974 from Soil Conservation Service and signed by Mr. James A. Crabb, Soil Scientist, plainly states that our proposed min- ing area is subject to periodic flooding and is better suited for commercial sand and gravel pro- duction, than agricultural uses. 2 . Letter dated June 11, from Longmont Soil Conser- vation District contradicts itself which becomes obvious by careful comparison of page 1 versus pages 2 and 3. Page 1 of the letter recommends that agricultural uses should be continued on our property, but pages 2 and 3 that contain scientific soil analy- sis--description, indicate to us the extreme unsuitability of soils for agricultural uses. Letter dated June 14 , from Rocky Mountain Consult- ants Inc. , representing District 6 Water Users Association implies a possible larger consumptive use of water as a result of our plans, than pre- sently exists. Enlarging the land areas in our Rehabilitation Plan as we have done, following your staff' s recommendations , the surface water area has been reduced to approximately 200 acres ± with a sub- sequent reduction of possible evaporation losses. 4 . Letter dated June 14th, from St. Vrain & Left Hand Water Conservancy District. (Some comments apply as in item 3. ) Following, we are including our water rights on subject property that in our opinion are more than adequate to augment any water losses if and when they occur as a result of our plan. A. 100 acre foot units of water as allotted by the Northern Colorado Water Conservancy Dis- trict. B. Five (5) shares of the capital stock of the Plumb & Dailey Ditch Co. C. Evaluation is to determine the suitability of the area for extraction of commercial gravel. Most of this area is along the flood plain between Boulder and Idaho Creeks. The soils are shallow to malerately deep (10-40 inches) to sand and gravel and being on the flood plain have a shallow watertable and are subject to flooding. The area is probably better suited for commercial sand and gravel than for agriculture, however, there is always the hazard of pollution to both Boulder and Idaho Creeks from the excavation process. .Tames A.
