RESOLUTION RE: DENIAL OF SPECIAL USE PERMIT FOR A WASTEWATER TREATMENT PLANT - ERIE WATER AND SANITATION DISTRICT, P. O. BOX 386 , ERIE, COLORADO 80516 . WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 18th day of October , 1978 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners, for the purpose of hearing the application of the Erie Water and Sanitation District, P. O. Box 386, Erie, Colorado 80516, for a Special Use Permit for a wastewater treat- ment plant on the following described property: A tract of land lying in the Northwest Quarter of Section 6, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, more particularly descrihad as follows: Commencing at the Northwest corner of said Section 6, Township 1 North, Range 68 West, thence South 00°04'32" West, 2646.31 feet to the Southwest corner of said Northwest Quarter of said Section 6; Thence South 88°44'39" East, 1532.86 feet along the South line of said Quarter section to the True Point of Beginning; Thence fran True Point of Beginning proceed South 88°44'39" Fast along the South line of the North- west Quarter of said Section 6, 300.00 feet to the northwesterly right-of-way line of the Burlington Northern Railroad; Thence North 22°55'13" East, 962.63 feet along said railroad right-of-way; Thence North 88°44'39 West, 673.81 feet; Thence South 00°04'32" West, 894.82 feet to the True Point of Beginning; Said described tract containing 10.00 acres, more or less. WHEREAS , the petitioner was present, and WHEREAS, evidence was presented by the petitioner in support of the grant of the Special Use Permit, and WHEREAS, evidence was presented by surrounding property owners urging denial of the Special Use Permit, and WHEREAS, Section 3. 3.E. 4.h. of the Weld County Zoning Resolu- tion authorizes such uses in an Agricultural District upon approval by the Board of County Commissioners after finding that the proposed operation conforms to the requirements of Section 3. 3.E. 2 . of said Zoning Resolution, and 780178 WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studied the request of the petitioner, the comments of sur- rounding property owners, the recommendations of the Weld County Planning Commission, and all of the exhibits and evidence presented in this matter and having been fully informed and satisfied that the request for a Special Use Permit for a wastewater treatment plant on the heretofore described real estate, does not conform to the purposes of Section 3. 3.E of the Weld County Zoning Resolu- tion. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for a wastewater treatment plant on the aforementioned tract of land, be and hereby is denied as failing to satisfy the requirements of the Weld County Zoning Resolution. BE IT FURTHER RESOLFED by the Board that the reasons for denial contained in the Planning Commission recommendation dated August 15, 1978 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. Jim Smith of Ray and Associates Inc. briefly brought the Planning Commission members up-to-date regarding what is being proposed and why this site was selected. There being no questions at this time , Tom Honn read the staff ' s comments regarding the application . Chairman Carlson then asked for comments from the audience . Mr. Wong, attorney representing residents of Westview Subdivision , expressed their concern regarding odor from prevailing winds , potential health problems with regard to contamination if a flood occurs , devaluation of properties , the distance sewage would have to be pumped, and why this particular site was selected next to a subdivision . Other property woners expressing concern with the proposal included Benny Bruntz, Walt Morris , Olive Martin, and Don Meechum. Mr. Meechum asked why the present disposal site cannot still be used . Mr. Smith later remarked that it has been condemned by the EPA, is located too near the 208 service area, and is located in a floodplain . George Montano expressed concern also as did John Hefner. Mr. Wong read a letter from Mountain Bell to Mr. Sam Little which stated that they felt it was economically unfeasible to increase utility service in Erie. These above concerns were basically answered at the first hearing, but Mr. Smith stated in answering these concerns that the site is isolated from the floodplain , the building is enclosed so there would be only a musty odor, does not feel properties would be devaluated in comparing this proposal to the plant in Boulder, and pumping is for internation circulation only as it is a gravity fed system. Discussion followed regarding the 208 plan and the boundaries involved with service. Mr. Hiatt asked for clarification of where the outfall line is proposed . Mr. Smith responded it would either go north on County Line Road to 52 and then west to Boulder Creek or from the end of the service at County Line Road diagonally to Boulder Creek. Discussion followed regarding the discharge permit and Later quality. John Hall of the Weld Planning Commission lutes Page 2 August 15, 1978 A County Health Department clarified the difference between the recommendation of the State Health Department and the negative recommenation of the Weld County Health Department . MOTION: Be it therefore resolved to recommend denial of the application based on the recommendation of the Weld County Health Department and also because of testimony received from the surrounding property owners and the applicant . that this is not compatible with the area and in harmony with the character of the neighborhood. Highway 85 SUBJECT: Change of Zone from "E" Estate Zone District to "C" Commercial Zone District APPEARANCE: Jay Steinberger DISCUSSION: Mr. Steinberger' s business is a Ford franchise dealership which is presently located in Eaton . Because of its present inadequate size additional property was purchased one mile north of Eaton in order to expand. This property has not been used agriculturally since approximately 1963 which is the time the 4 lane highway was put in in that specific area. There are curb cuts presently on the property and room for a deceleration lane coming from the north to the south in the south bond lane which makes it natural for turning from the southbound lane into the proposed dealership facility . At this time Chuck Cunliffe read the staff ' s recommendation for approval . No further discussion . MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation. Motion by Irma White, seconded by Percy Hiatt . Bliss CASE NUMBER: Z-306 : 78: 10 LEGAL DESCRIPTION: Lot 1 , SE* SW*, Section 9, T5N, R65W LOCATION: Southwest corner of the intersection of East 18th Street and Balsam Avenue SUBJECT: Change of Zone from "E" Estate Zone District to "C" Commercial Zone District APPEARANCE: Jerry McRae DISCUSSION: This application and the Johnnie Bernhardt application followin were both presented at the same time by Mr. McRae as the properties are close to each other. Mr. Bliss desires to have a produce storage building and office and Mr. Bernhardt desires to have mini warehouse storage units if the requests are granted. No water will be necessary on the properties to operate these businesses. There being no questions at this time, Chuck Cunliffe read the staff' s recommendation for denial . Mr. McRae then presented a map showing where the properties are located and what areas are presently zoned Commercial . General discussion followed. Chairman Carlson then asked for comments from the audience. William Bearer at this time then spoke in representing; residents of East 19th Street Road, Basswood Avenue , and Balsam Avenue who are in opposition to the proposal . ' ' Planning Commission lutes Page 3 August 15, 1978 These area residents are opposed because the area is already established for residential with some light businesses permitted; devaluation of properties ; taxes have already doubled ; increased traffic would not only be a problem but a hazard; noise and dust ; better sites are available ; and water taps are not presently available. Don Hungenberg also stated he felt this area should be kept in Estate zoning as people enjoy living there where they can have a few horses , etc. on small acreages and would prefer it be left that way. Earl Steel and Linda Reed also expressed opposition to the request . Mr. Bernhardt then stated that he needed no water for his request . He is requesting the change of zone so that he can make his property work for him. The land is not big enough to farm and the taxes are going up on it . Mr. Bliss also stated that he would need no more water for his operation 'and would not cause a strain on the sewer system. There would also be very little increased truck traffic--probably small farm trucks only . Discussion followed. MOTION: Be it therefore resolved to continue the application to September 5, 1978, for a field trip and further testimony . Motion by Jerry Kiefer, seconded by Irma White. SW , Section 35 , T4N, R66W LOCATION : 1 miles south and 1 mile east of Gilcrest APPEARANCE : Ivan Gilbaugh DISCUSSION: Mr. Gilbaugh, representing Mr. Becker, explained that Mr. Becker had purchased the 4. 4918 acres with a 25 ' easement with the under- standing that he could obtain a building permit . It was not until he applied for the building permit that he was told he could not build on the property. He is proposing to eliminate the 25 feet to enlarge the parcels . Tom Honn went into a great deal of explanation in this regard. There being no comments at this time, Chuck Cunliffe read the staff 's recommendation for denial . George Becker stated that he tried to work with Mr. Lorenz, owner of Parcel C, so they could get a recorded exemption on the property, but Mr. Lorenz would not cooperate . Motion by Percy Hiatt , seconded by Jerry Kiefer. There was a vote of "aye" cast by Percy Hiatt and Jerry Kiefer. A vote of "no" was cast by Chuck Carlson, Bette Kountz, and Irma White . This motion failed on a 3 to 2 vote. Gary Fortner at this time stated that the Weld County Building Trades Advisory Committee has been formed and to-date has been working out quite well . The following proposed amendments to the Weld County Building Code has been thoroughly studied and reviewed by this committee and fully support the amendments . Joe Jarvis , Building Inspection Director, then briefly discussed the following items with the Planning Commission members. Adoption of standards for energy conservation and amending the Weld County Building Code to provide energy conservation requirements. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners . Motion by Jerry Kiefer, seconded by Bette Kountz. A vote of "aye" was cast by Chuck Carlson , Jerry Kiefer, Percy Hiatt , Bette KOuntz , and Irma White . Motion carried. Proposed amendment to Section II .A. 4. of the Weld County Buidling Code . The amendments pertain to standards for the inspection of plumbing systems . MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners . Motion by Jerry Kiefer, seconded by Percy HiatL . A vote of "aye" was cast by Chuck Carlson, Jerry Kiefer, Percy Hiatt , Bette Kountz, and Irma White. Motion carried. Proposed amendment to Section III .P. of the Weld County Building Code. The proposed amendment would make provision for approval of deviations from the Weld County Building Code by the Director of Bulling Inspections at his discretion whenever there are practical difficulties involved in carrying out the provisions of the code. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners. Motion by Jerry Kiefer, seconded by Percy Hiatt . There was concern at the last meeting regarding compatibility with the surrounding area. Michael Hart stated in this regard that there is a parcel of land on the south side of Road 16l and on the west side of Boulder Creetc that is zoned Industrial. There was also concern about the potential impn."t of the mini,, operation and the difference of the impacts rega: ding air quality of the area. Dr. George McVeel then gave an extensi\ report of his investigation of the air quality as it now exists in the arca and what the effects would be of the sand and gravel alone. llc stated i-to t as the operation exists now the air quality is relatively good at the present tiai: with the exception of some particul ate Latter such as dust and small amounts of other pollutants from oil and gas ' c, l 1 s in the are•i and from automobiles . The impacts of the sand and €'- rave. operation alone will produce some particulate matter as will tin, asphalt and concrete plant . He stated that the impacts wi 1 I be -r,:' I 1 in the long-run and on the average there will actually be a redus � io❑ of the amount of particular released into the air. Discus.-,ion followed regarding how many employees would be involved with the operation . There will be approximately 15 persons involved according to Ed Mclowell . Mr. Kiefer asked if the material mined five miles upstream isbrought to the plant or will the asphalt and concrete plant use only the material that is on Fite. Mr. McDowell stated that the material is hauled back to Boulder and is processed further upstream in an asphalt plant there and used in Boulder. The concrete plant in Boulder l:r s2ntly has it,, own source of material where it is located . No ma rtal _from these .sites would be hauled to the proposed ' Planning Commissic Minutes I Page 2 ' August 1, 1078 plants and would be very uneconomical . Discussion followed where the majority of the material will be processed. Torn I? • aer then expressed his opposition to the proposal by stating that Lh( non-particulate emissions would be trapped because the proposal is in a valley and there would also be an increase of carbon monoxide and hydrocarbons because of the increased traffic and dust . Helen Bryant stated that her father owned the property that is zoned industrial and had no intention of having an industrial operation on the land. At this time the slide presentation was again shown for the benefit of Mrs. Kountz that was prepared by surrounding property owners opposed to the proposal. Mrs. Kountz was not present for the previous Planning Commission hearing. Other persons expressing opposition because of incompatibility with the area , dust , noise , and pollution included : Ken Neuens , Dale and Lynn Johnson , John True, Mike Shaw, Carol Bultaup , Howard Rasmussen , Sandy True , Mrs. Saudee and Doris Saudee. Lucy Stromquist , also a surrounding property owner, was concerned about the possible decrease of food production and Helen Nelson read some statistics which stated that there is 44 miles of surrounding property of which 1. 75 miles and 4101 acres represent those opposing the site and 2', miles and 960 acres which represent those who have no oUjection to the proposal . Mr. Nix raised the concern of the possible conflict of intc rest in knowing Mr. Milton Nelson„ No member on the Board felt it necessary for Mr. Nix to abstain from voting. Tom llonn then read the conditions that were to be subject to the staff ' s tcconamendation into the record. Chairman Carlson asked for clarification as to whether it was County Road 3 or . A . Toga Henn stated that the memo from ; .ic' County Engineer ' s Office refers to it as County Road 3. Discussion followed regarding alternate routes. It was decided the County Commissioners should make this final decision . The proposed site location of the wastewater treatment plant is located within the service area defined by the 201 Waste- water Facilities Plan and the defined land use plan map on the Erie Comprehensive Plan. 2. The Town Board of Erie has recommended approval of this request . 3. The Colorado Water Conservation Board has indicated that the nucleus of the proposed wastewater plant facilities will be protected from the inundation of the 100-year flood. 4. The Boulder Valley Soil Conservation District has set forth no objections to this request . 5. The Colorado Department of Health has set forth no objections to this request . They have recommended that the design of the plant should include sufficient capacity to accept septic tank pumpings from the area. 6. The Colorado Geological Survey has set forth no objections to this request . They have indicated, with regard to the mineral resources underlying the site, that it is apparently not economically viable and find it difficult to justify the conservation of these gravels. 7. The Boulder County Planning Department has indicated that this request is in basic conformance with previous plans . 8. The Weld County Engineering Department has set forth no objections to this request. 9. The Colorado Division of Water Resources has indicated that a dependable drinking water supply will be available to the site. 10. The Weld County Health Department has indicated in a letter dated July 17, 1978, the following: "Although this department concurs with the need for Erie' s Wastewater Treatment Plant , we cannot recommend approval of the proposed site due to its close proximity to Westview Estates residential area (approximately 500 feet to nearest residence) . Erie Water and Sanii ion District SUP-367: 78: 19 STAFF RECOMMENDATION August 15, 1978 Paragraph 4. 1, Criteria Used in the Review of Waste- water Treatment Facilities published by the Colorado Department of Health in June, 1973, states: . . . a sewage treatment plant site should be as far as feasible from any present built-up area or any area which will probably be built- up within a reasonable future period. " Therefore, we respectfully propose another site be selected with emphasis on separation from existing and proposed residential development . " 11 . Our office, to date, has received 7 letters and 1 petition with 51 signatures from surrounding property owners and people in the immediate area who oppose the approval of this request . ERIE WATER AND SANITATION DISTRICT SPECIAL USE PERMIT DEVELOPMENT STANDARDS 1. Permitted uses on the hereon described Special Use Permit area shall be a 500, 000 gallon per day wastewater treatment plant with associated maintenance and administrative facilities . Major facilities shall be limited to those as shown hereon. 2. All phases of the wastewater treatment plant facilities and operations shall conform with all applicable County, State and Federal Health Standards and Regulations and any other applicable rules and regulations of governmental bodies having jurisdiction on the premises . 3, All phases of the operation must conform to maximum permissible noise levels as stated in 25-12-103, CRS, 1973. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 5, No strucutres or facilities used in the processing of sewage shall be permitted closer than 350 feet to the south Special Use Permit boundary. All structures shall comply with the minimum setback requirements as defined in Section 3 . 14 of the Weld County Zoning Resolution. 6. Lighting provided for security and night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. 7. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Boulder County Engineering Department . 8. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 9. All design and construction shall conform to the Weld County Building Code. ,,_ 10. The site shall be enclosed with a 6 foot high chain link fence. c 11. Signs warning the public that the site is a wastewater treatment facility shall be placed on all sides of the facility. If the fill matter is to be acquired on site it should be indicated and care taken to avoid creating drainage problems on adjacent property. The staff is requesting a more detailed description of the activated sludge process proposed to be utilized at the site. This description should include information on wastewater treatment processing equipment and use areas including its design, its functional part of the process, and its effects in producing air and water pollution, odor, noise , glare, fire or other safety hazards. Little 5263 Buffalo Road Erie, Colorado 80516 Dear Mr. Little: This is in reply to your letter which you wrote in behalf of the citizens of Westview Estates. I'm sorry to learn that so many of you are dissatisfied with your telephone service and want to promise that we will do all that we possibly can to correct it. t This will not, however, include the extension of Denver metropolitan service to your area. Let me explain why this is not possible. When we developed the service in 1965 we expected it would be of great benefit to both our customers and Mountain Bell. To be very candid, Mr. Little, it was a financial disaster for us, and we are still suffering from the effects of it upon our operations. As a result, we do not want to further expand this service. Equally important, we have been ordered by the Colorado Public Utilities Commission not to expand it, not in Denver or anywhere in the state. So this must be considered a closed issue. The alternative suggestion I have for those customers needing extended calling privileges is to subscribe to "metro pack" service. This allows 60 minutes of conversation to all of the cities and communities within a 30-mile radius for a monthly charge of $5.65. Additional minutes are charged at a rate of nine cents each. This service is available immediately and can be installed for any customer wishing it. In your area we are presently providing four-party service to all customers. If this class of service is not completely satisfactory and you or others would like a one- or two-party type service, we will be happy to see if it can be provided. Please contact our manager, Mr. Jerry Hall, 776-8340, and he will check our facilities . I'm sure you realize that there would be an increase in your monthly rate for either of these services. Fortner Weld County Planning Director 915 10th Street Greeley, Colorado 80631 Re : SUP-367; 78;19 Erie Water & Sanitation District Dear Mr. Fortner: Wastewater Treatment Plant In response to the Department of Planning Services staff comments to the above referenced Special Use Application, said response dated August 1, 1978, the following supplemental infor- mation is hereby provided. 1. Landscaping. A copy of the proposed landscaping plan is attached hereto. Please note on the landscaping plan that a combination of ever- green, and deciduous plant materials have been used to screen all process basins and activities from surrounding property. Plantings surrounding the Administration/Control Building are such that the building lines will be softened and cause the structure to blend into the natural site. Please note that the landscaping is not of the continual barrier type, but rather has been planned to screen the facilities while providing a natural appearance. Plant mater- ials have been selected to provide a variety of texture and color while minimizing maintenance. The selection of plant materials has also been governed by the angles and relative elevations of the proposed facility to the surrounding properties. Lower growing more dense types of vegetation have been selected for use on the southern end of the site where the ground level is at relatively the same elevation as the site and the sight distances to the facility are shorter. On the north and northeasterly portions of the site larger species of trees have been used since the ground rises to the northeast thereby necessitating taller vegetation. In all cases more rapidly growing varieties of plant materials have been used. Mr. Gary Z. Fortne August 7, 1978 Page Two Native grasses will be used on the majority of the site in order to minimize irrigation requirements. These grasses will consist of buffalo grass for areas surrounding the treatment basins where pedestrian and light vehicular traffic are required and either crested wheat or brome in those areas which are not required to be used during normal operation and maintenance pro- cedures of the facility. Sod and plant materials requiring irrigation will be used only in the immediate vicinity of the Administration/Control Building. 2. Site Grading. The top elevation of all process basins will be constructed above the 100-year floodplain elevation. Excavation from the process basins will be used to berm up around the process basins and around the Control Building. All excess excavation from the construction will be used in this berm, however there is no inten- tion of borrowing materials from the site in order to further ex- tend the berms. In general the existing site will be left untouched as regards site grading. A site grading plan has been prepared with the final contours shown. 3. Wastewater Treatment Process Equipment and Operation. The design of the facility has incorporated that treatment process and equipment selection to reduce noise, operational traffic and odors to the absolute minimum. The treatment process is totally aerobic thereby precluding the formation of hydrogen sulfide and other gasses which produce noxious odors which are generally associated with wastewater treatment plants. The aeration system selected is that which provides that all noise generating equipment be placed within the Administration/Control Building. The process design and process basin sizing have been approved by EPA and The Colorado Department of Health as prescribed by regulations. A specific step by step description of the process and its operation is as follows . A. Headworks. The headworks includes flow measuring and grit removal equipment. The sewage enters the headworks, passes through a Parshall flume which measures the incoming flow and transmits a signal to the control room for monitoring. The Parshall flume is a continuous flow-through device with no retention of the sewage. The sewage then flows into an aerated grit chamber which washes and re- moves the grit, which would be damaging to plant equipment, from the sewage. The grit is collected and removed from the site for deposition at an approved landfill. From this point the sewage is sent to the aeration basin. B. Aeration Basin. The aeration basin has a detention time of approximately eight hours, during which time the sewage is aerated by diffused air. The diffused air is provided by blowers located in the Control Building which is blown through underground pipes to the aeration basins at which point it is passed through fine-bubble ' Mr. Gary Fortner August 7, 1978 Page Three diffusers located within the basin. Swing-arm diffusers which allow for the removal from the basin of a selected number of dif- fusers at a time preclude malfunctions which would result in shutting down of the aeration basin. Backup blowers are provided so that malfunction in equipment can immediately be corrected by shifting to the backup blower. After the sewage has been retained in the aeration basin for the prescribed time it is withdrawn on a continual basis and sent to the clarifiers. C. Clarifiers. The clarifiers are in essence stilling basins in which the activated sludge (nonliquid materials) settles to the bottom of the basin. Two clarifiers have been provided so that operation is continuous in event of a malfunction of the clarifier mechanism in one clarifier. The sludge removed from the clarifier is sent partially back to the aeration basin for re- circulation and partially to the digester with the particular per- centage split being dependent upon operational parameters. D. Digester. The digesters operate in an identical fashion to the aeration basins, but will have coarse-bubble diffusers as opposed to the fine-bubble diffusers used in the aeration basins. The sludge materials will be retained in the digester for up to 15 days under continuous aeration. The digester operation results in near total stabilization of the waste materials. The sludge will be removed from the digester periodically with the frequency of removal dependent on plant flows, weather, etc. , and will be wasted to the sludge drying beds. E. Sludge Drying Beds. The sludge drying beds are essentially sand/gravel filters in which the liquids drain from the waste sludge and return to the front end of the plant. The stabilized sludge will be air dried and removed for use as soil conditioners or wasted to an approved sanitary landfill if sludge quantities exceed the demand used for soil conditioning purposes. F. Chlorine Contact Chamber. The liquid portion of the activated sludge sent to the clarifier will pass over the effluent weir, be chlorinated and will be retained in the chlorine contact basin for 30 minutes prior to discharge to the receiving stream. G. Administration/Control Building. The Administration/ Control Building will house the laboratory, maintenance shop, garage, emergency generator, recirculation pumps and the air blowers. I believe this letter provides that information requested and addresses those comments in the previously referenced document. Paragraph 4. 1 , Criteria Used in the Review of Wastewater Treatment Facilities published by the Colorado Department of Health in June, 1973, states: " . . a sewage treatment plant site should be as far as feasible from any present built-up area or any area which will be probably be built-up within a reasonable future period. " Therefore, we respectfully propose another site be selected with emphasis on separation from existing and proposed residential development. The following provisions will apply to the wastewater treatment plant regardless of its location: 1 . A fugitive dust emission permit must be applied for through this office. This permit will apply to such activities as earth moving and road building during the construction phase. 2. An emission permit must be applied for through this office for any process emitting air pollutants to the atmosphere. 3. Noise levels shall comply with those standards listed in 25-12-103, C.R.S. , 1973. 4. This 10-acre tract lies on Fl flood-plain gravels along Boulder Creek, as shown on the CGS gravel resources map of the Erie quadrangle . The Ray and Associates ' report shows one ,test-hole _log that recorded 10 ft of overburden on 11- ft of gravel and sand . The thick overburden and high overburden-to-resource ration suggest that the hole was drilled very close to the eastern margin of the deposit, but I could not find the location of the test hole on any of the enclosed maps . Assuming that this log is representative of the entire tract, I find it difficult to justify the conservation of these gravels . The unattractiveness of the site is also born out in the brief economic analysis of gravel extraction, but those calculations are not a rigorous treatment of the situation. Although this site is apparently not economically viable, I think it is important to note that substantial acreage over this deposit is available yet in the rest of the NW% sec. 6 . In view of the fact that eleven gravel pits have operated within 2 miles of this tract, the probability is high that the remainder of section 6 will become an increasingly important reserve. Assuming that we can claim the same equal right to be heard , as Mr. Keith Bell representing hay & Associates , we would like to clarify some erroneous claims and assumptions made by r"r. Bell. 1 . Mr. Bell stated that information concerning the proposed sewage facility was always available and easily accessible to all interested parties . On April 18, Hr. Sam Little called Hr. Steve i.click, Chairman of the Erie Water and Sanitation Board , to inquire about the location of the proposed plant. He was told , to quote the more acceptable of the vulgar language used in Ir. Helick's reply; "To go to hell and mind his own business . " Mrs. Pattie Bruntz asked the men doing surveying work on the Bruntz property what they were doing and was rudely and crudely told that it was none of her business. We then wrote a letter to the county officials requ-sting the information that could not be obtained from the local public officials. At that time we were primarily concerned with the effects of the proposed operation on our domestic water supply since the plant was to be situated in a flood plain. We had assumed that the plant would be similar to the White Rocks treatment Plant in Boulder, Colorado with which we were familiar. Since we now know that it is not planned as a similar type of operation, we are also extremely concerned with the other undesirable aspects of this proposed operation for the treatment of raw sewage. 2. Mr. Bell stated that contact had been made with three parties owning adjacent poperty to the proposed ste . As I recall the names mentioned were the Eltings , Smiths and Martins . 2 There are more than three residences within the 500 foot perimeter of the site. Indeed, contact had been made and , in fact , was initiated by these residents some time ago stating their opposition to the plant location being considered. 3. Mr. Bell stated the the newly annexed Erie Air Park would not be using the services of the sewage plant; when Mrs . rteese suggested a southern site , close to Coal Creek and between Erie and the Air Park Development. The first permits given were for individual septic systems because of their location and size of lots. However, in the annexation agreement , it is stated that all light industry, which is already being planned and developed, will be issued septic permits only until the second filing of the Development is approved by the city. Obviously, this will only be a matter of time; 4. P'ir. Bell stated that the land was purchased without condemnation of any property involved. First of all , we question how a site could be prematurely pur- chased before official approval was given for plant construction. Dr. Beckey, former owner of this property, informed Benny and Pattie Bruntz who are within the 500 foot zone , that the property had been condemned. One of the parties , either Dr. Beckey or s'lr. The Town of Erie, in my judgement, has no more right to install such a facility near my property than would I to build a feed lot or waste lagoon at the southeast edge of Erie. The Town of Erie has either annexed or some arrangement south of town to take in the airpark. It would appear that there is ample space there where such a facility could be built which would not be within one mile of any dwelling. I believe the request by the Town of Erie to place such a facility within 500 feet of my property is completely and totally unreason- able. At this point, it would appear to me that the City of Erie wants to get their waste as far away from them as possible knowing the foul odor that will result. Since I don't dump my waste water on their main street, I can't imagine why they should believe that I will be any more enthused about smelling their waste. I share this with you only because of a conversation with my father and family who have al*+rays been very politically alert , intcrested and involved in government at local , county and state levels . Iiy father was amazed and gratified that in our short time of rural living north of brie , that we have been involved with county decisions at four different occasions ; as he has long maintained that the "government guts" is at county level for rural residents . He also said that we Were fortunate in having been listened to and responded to by our county officials and , of course , were encouraged to get actively involved in order to keep intact this type of government by the people through their elected representatives . Early last spring 1 wrote a hurried letter to you expressing concern about the brie sewer plant site proposed by the Erie Water and sanitation District. We were extremely frustrated because of our failure to get information about that project th- t directly affected many families in this area. In that letter i expressed some concerns and failed to cite others , which upon investigation, proved to be just as serious . I stated in the letter that the odor would not be of major concern, basing my judgement on my knowledge of the White hocks Water Treatment Plant in the city of Boulder. Since then we have contactplant operators in .Boulder and also have visited the operation on 75th Street where the -aw sewage is treated . Indeed , when the plant was big and the city was small , there didn't seem to have a serious problem but they certainly do now and so do the residents in the nearby vicinity! hxpansion and remodeling is now in the process so time will tell if this problem can be solved for those home owners . Our situation cannot even be compared to theirs as those people chose to buy :end build homes knowing a sewage treatment plant was in operation. Our families chose our home sites with no knowledge of the impending hazards of floods , chemical plants and sewage treatment plants in our backyards . I am confident that you, our elected officals of Weld County, will see this situation as being of sufficient concern to the welfare of the many families living in this area north of nrie , that you will carefully consider all the inform•-tion that was presented to the Weld County Planning Commission concerning the proposed site for the town of Lrie. It will be a modern acti- vated sludge plant designed to accommodate the anticipated future growth of Erie and to meet the effluent standards of the Weld County Health Department, the Colorado Department of Health and the U.S. Environmental Protection Agency. The proposed plant will be automated and employ a maximum of three persons. At this time it is anticipated that the staff will consist of one full-time operator and one part-time operator. Noise generating equipment will be limited to such equipment as air blowers, compressers, pumps , emergency power generation, etc. The noise level associated with this equipment is relatively low and the equipment will be housed within the administration building; hence, the noises generated would not be audible beyond the confines of the special use area. The activated sludge process is being utilized to minimize odors. The slight musty odor associated with activated sludge would not be of sufficient concentration that odors would be de- tectable outside the special use area. In addition, the plant is located in an area of low population density with agricultural land to the north and east which is the downwind of the prevailing wind. The only nonagricultural zoning is to the south of the pro- posed plant site. A Weld County subdivision adjoins the property on the south with the nearest dwelling located approximately 700 feet to the south of the process basins . The entire site will be landscaped with special consideration being given to the south boundary of the proposed site to buffer it from the area zoned for residential use. The administration building and process basins will be located approximately 1, 600 feet off of County Line Road and should there- fore be reasonably unobtrusive. The administration building has been designed with brick and block exterior walls utilizing a false mansard roof line to result in an attractive building which har- monizes with the area. WASTE DISPOSAL The treated waste water will be discharged into Coal Creek just upstream from the confluence with Boulder Creek. An effluent permit (Permit No. CO-0021830) has been secured from the Colorado Department of Health. Other than treated waste water the major product resulting from operation of the proposed treatment plant -3- ✓ will be a biologically stabilized sludge. In addition small amounts of inorganic matter (ground bones, plastics, glass , etc. ) will be produced. The stabilized sludge is an excellent soil con- ditioner which will be available to local residents for land application subject to stringent controls as to location and in- tensity of application. Sludge in excess of that used for land application, as well as the inorganic material, will be disposed of in the Weld County land fill. This method of disposal has been approved by Mr. Glen Paul, Director of the Weld County Health Department. WATER SUPPLY No process water is required for the proposed treatment plant. Irrigation water for the site landscaping will be provided by plant effluent. A domestic well with a capacity of less than 15 gpm will be drilled on the site to provide drinking and wash water for the plant employees. A well permit from the Colorado State Engineer' s Office is included as Exhibit 2. ROADS Access to the proposed treatment plant will be via an existing private road which links the special use area with County Line Road. It is anticipated that the road will be improved to Weld County standards although it will be maintained by the Erie Water & Sanitation District. FLOODPLAIN The treatment plant site is in the 100-year floodway as shown in the October 1976 Flood Hazard Analysis prepared by the U.S. Department of Agriculture Soil Conservation Service. A cross section through the site as determined by Exhibit A-1 of said re- port is plotted on the site grading plan P-1 of this Application. As determined from said report the slope of the 100-year storm from south to north across the site is 0. 6% . The elevations of the administration/control building and those of the treatment basins, clarifier structures and head works are set above the 100-year flood elevation as shown on site grading plan P-1 . Since the site is to the extreme eastern edge of the floodway and the site grading near and around the plant works is above the floodplain elevation, there is no reason to assume a detrimental effect from flood water. -4- 1 ALTERNATIVE SITES The evaluation of alternative sites revealed that sites to the west of County Line Road were either too near existing dwellings or too deep in the Coal Creek and/or Boulder Creek floodplain. Sites to the west would also have been located up wind from exist- ing dwellings, considering the prevailing westerly to southwesterly wind. Due to the above factors, sites were evaluated which were sufficiently down grade from the existing facility to allow gravity flow of the interceptor main, but which were as high as possible in the Coal Creek/Boulder Creek floodplains. The initial site selected and core drilled was approximately one mile south of the selected site. The subsurface soil conditions on that site proved to be totally unsuitable. Sites further to the north (north of Highway 52) were also considered. It was determined that several small tracts front on Highway 52 and could potentially be developed as home sites. The land to the north of these small parcels is deep in the Boulder Creek floodplain. The selected site is the one which best meets the following criteria. 1. Separation from existing dwellings. 2 . Capable of being served by a gravity interceptor line. 3. Down wind from the prevailing wind patterns . 4 . Highest in the Coal Creek/Boulder Creek floodplain. -5- Vl RECOVERABLE MINERALS The plant site is located along the east edge of the F-2 mineral designation as shown on your records. The following page is a test hole log on the site which indicated approximately ten feet of recoverable gravel exists with eleven feet of overburden. The following shows that it would not be economical to recover this gravel. Cost to Remove Overburden The site is mall and the overburden is not suitable top soil and would therefore not have any economic value.
