RE: APPROVAL OF RECORDED EXEMPTION NO. 386 - E & C YOUNG, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 25th day of April, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption No. 386, being the property of E & C
Young, Inc. , described as part of the Northwest Quarter of Section
2, Township 1 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
The Northwest one-quarter of Section 2, Tt 'nship 1
North, Range 65 West of the 6th Principal Ivbridian,
Weld County, Colorado, except a tract of approxi-
mately 5 acres conveyed by deed recorded in Book
1000 at Page 256, Weld County records.
Containing 155 Acres, more or less.
LOT A:
That part of the Northwest one-quarter of Section 2,
Township 1 North, Range 65 West of the 6th Principal
Meridian, Weld County, Colorado, described as:
Beginning at the North one-quarter corner of said
Section 2; thence 500°00'00"W along the East line
of said Northwest one-quarter Section 2, a distance
of 587.65 feet to the true point of beginning;
thence continuing S00°00'00"W along said East line,
a distance of 654.36 feet to a point on the Northerly
R.O.W. line of the service road for Interstate 76;
thence 554°48'40"W along said Northerly R.O.W. line,
a distance of 636.28 feet; thence N00°00'00"E parallel
to said East line Northwest one-quater a distance of
1021.03 feet; thence N90°00'00"E, a distance of
520.00 feet to the true point of beginning.

does not come within the purview of the definition of the terms
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by E & C Young, Inc. be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 25th day of
April, A.D. , 1979.

Dear Commissioners :
The attached application, plat and related items are in reference
to a request by E & C Young, Inc . , for a recorded exemption. The
parcel of land is described as Pt. NW% Section 2, T1N, R65W of
the 6th P. M. , Weld County, Colorado. This property is located
approximately 1/2 mile northeast of the Town of Hudson. The pro-
perty contains approximately 165 acres of Class IV and VI non-
irrigated soils and Class III, IV and VI irrigated soils in the
Agricultural Zone District. The request is to split the property
into parcels of approximately 10. 0 acres and 155. 0 acres .
E & C Young, Inc. , wish to sell the 10 acre parcel to the Front
Range Hay Company for an Alfalfa Cubing Facility. Front Range Hay
Company has applied for a Special Use Permit on the 10. 0 acre
parcel. The Weld County Planning Commission recommended approval
of the Special Use Permit on April 17 , 1979.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3 . 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the uses will be compati-
ble with surrounding agricultural uses. The request will allow
agricultural and related uses to be the predominant land use.

The following is a description of Front Range Hay Co. , Inc . , and the in-
tended use of property and facilities for which application for Special
Use Permit is being made .
Front Range Hay Co. purchases alfalfa hay from local farmers and custom
hay grinding operators . The ground hay is processed into cubes using a
John Deere cubing machine. (Picture of machine is enclosed) . The cubes
are marketed in 50 lb. bags, and in bulk. The cubes are sold in large
quantity wholesale only.
Proposed construction of a 60 foot x 275 foot steel building will be
used to house the cubing machine, sacking equipment, and to warehouse
cubes prior to shipment. Included in the construction plans is rest
room facilities for employees eith a septic system for waste disposal .
The cubing machine is powered by a 150 horse power electric motor result-
ing in a quiet operation. We use only sun-cured alfalfa so oder is net
a problem, nor does our operation produce pollution of air or water.
Normal work schedules will be from 8 : 00 AM to 5 :00 PM Monday through
Friday. We employ four full time persons, .ne well as two office personnel .
We expect to ship 10 semi-trailer loads of cubes each week to Feed Lots,
Race Tracks, and/or Dealers , etc.
Possible future construction plans would include a 24 foot x 30 foot
office building and a 70 foot scale on which we would weigh hay trucks .
It is the desire of this Company to fully comply with any and all local,
state, and federal requirements . We intend to operate our business in
a manner that will maintain our good rL=lationship with the Agricultural
and Business Communities of Weld County and our neighbors in Hudson.
We will provide an ever expanding hay market for the farmers in our Area.

RE: Petition for recorded exception of 10 acres / Front Hay Co. , Inc.
Dear Sirs:
The Hudson Planning Commission has reviewed a request from
Front Range Hay Co. for the above mentioned special land use permit.
The application states that the property is to be used for
processing dry hay, storing, bagging and shipping of the resulting
product.
The Commission' s position at this time is that there would
be no environmental problems developing from such use of the pro-
perty and the commission would not be opposed at this time.
However, since no public hearings have been held relative to
this permit the commission reserves it' s final decision until such
time as hearings are held and the adjoining property owners have
indicated approval.

6th Principal Meridian, Weld County, Colorado
A review of the data available in the Office of the State Engineer, Colorado
Division of Water Resources, indicates that there should be sufficient water,
physically and legally available, in the Fox-Hills aquifer, to serve the
domestic needs of a dwelling on 145 acres in the above-referenced location.
The aquifer exists at depths between approximately 675 and 850 feet.

We have reviewed the following special and conditional use permit applications :
1) Case No. SUP-383:79:5, Bruce Johnson and Sons, Inc. ,
hog farrowing and finishing operation.
2) Case No. SUP-384:79:6, Front Range Hay Company,
Alfalfa Cubing facility
3) Case No. SUP-385:79:7, Continental Pipe Line Company,
Oil Storage Facility.
4) Case No. CUP-46:79:6, Continental Pipe Line Company,
Crude Oil Truck unloading facility.
No geologic hazards nor serious constraints are known to exist in any of
these areas. However, footing trenches for permanent structures should be
inspected by qualified personnel to determine if any adverse soil conditions
are present.

Dear Mr. Cunliffe:
We have reviewed the E and C Young, Inc. , application for a
Recorded Exemption. This same site has also been reviewed as a
referral of the Front Range Hay Company application for a Special
Use Permit (our letter dated April 3, 1979). As indicated in our
previous letter, the construction of the access to the I-76 frontage
road will require a Driveway Permit.
