Home My WebLink About20111895.tiff o/O RESOLUTION RE: APPROVE EXTENDING PERFORMANCE BOND FOR SITE PLAN REVIEW, SPR#340- ROLINDA COLORADO COMPANY, LIMITED WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 16, 2001, the Department of Planning Services approved Site Plan Review, SPR #340, for Rolinda Colorado Company, Limited, and Firebaugh Precast, Inc., P.O. Box 691, Canal Fulton, Ohio, 44614, for the Fabrication of Precast Concrete Products on the following described real estate, to-wit: Lots 6-12, Block 1 and Lot 7, Block 2, Panoram Industrial Park Subdivision, being part of the N1/2 of Section 12, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, on April 15, 2002, the Board approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance) and accepted Performance Bond BND 5877623 from Ohio Farmers Insurance Company, Westfield Companies, Westfield Center, Ohio, 44251-5001, in the amount of$350,000.00, and WHEREAS, pursuant to certain Conditions of Approval in said Resolution, the Departments of Planning and Public Works conducted field investigations on June 13, July 12, and July 19, 2011, and determined that the requisite improvements were not completed, and therefore recommend that Performance Bond BND 5877623 in the amount of$350,000.00 from the Ohio Farmers Insurance Company be retained until improvements have been completed. On April 15, 2002 the Board of County Commissioners by Resolution accepted Performance Bond number BND 5877623 in the amount of Three Hundred and Fifty Thousand Dollars ($350,000.00) and no/100's from the Ohio Farmers Insurance Company, Westfield Center, Ohio 44251-5001. The Department of Planning Services received a General Form Status Inquiry from the Ohio Farmers Insurance Company,Westfield Center, Ohio 44251-5001 dated May 31,2011 and received June 7, 2011, requesting notification of outstanding issues associated with the completion of the site improvements associated with Site Plan Review No. SPR-340. The Departments of Planning and Public Works conducted a field investigation on June 13, 2011, July 12 (PW) and July 19, 2011(PL) and determined that the requisite improvements were not completed,therefore it is our recommendation that the Performance Bond number BND 5877623 in the amount of Three Hundred and Fifty Thousand Dollars($350,000.00)and no/100's from the Ohio Farmers Insurance Company, Westfield Center, Ohio 44251-5001 be retained until improvements have been completed.
