WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at
a duly and lawfully called regular meeting held on the 28th day of February, 2011, at which
meeting there were present the following members: Chair Barbara Kirkmeyer, and
Commissioners Sean P. Conway, William F. Garcia, David E. Long, and Douglas Rademacher,
and
WHEREAS, notice of such meeting and an opportunity to be present has been given to
the taxpayer and the Assessor of said County, with said Assessor, Christopher Woodruff, being
present, and taxpayer, Owens-Brockway Glass Container, Inc., do Duff and Phelps, LLC/Bruce
Cartwright, not being present, and
WHEREAS, the Board of County Commissioners has carefully considered the attached
petition, and is fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board concurs with the recommendation of the Assessor and
the petition be and hereby is, approved, in part, and an abatement or refund be allowed as

Appointment of Agency for Property Tax Matters
Duff & Phelps LLC is authorized to represent Owens-Brockway Glass Container
Inc. on personal property tax matters concerning the glass plant located at 11133
Eastman Park Dr., Windsor, Colorado in Weld County Colorado. Any and all
previous authorizations are hereby revoked. Duff & Phelps LLC is authorized to
act on our behalf in obtaining and providing information, negotiating, settling and
assessing for all personal property matters related to the property owned,
possessed, or controlled by the undersigned at the above-referenced address.

Owens-Brockway Glass Container Inc.2008 Abatement of Personal Property for
Schedule P3307406
Dear Honorable Board,
On behalf of our client Owens-Brockway Glass Container Inc., Duff & Phelps is requesting that the
2008 value of the personal property be adjusted to$73,623,486. Our 2008 estimate of value uses the
same valuation methodology used by the Weld County assessor's office to establish the 2009 and 2010
personal property assessments.
The current proposed adjustment by the assessor's office of $81,685,137 is inconsistent with the
valuation methodology used for the Weld County assessor's 2009 and 2010 values.
1. Computer integrated equipment assets were valued with a 4 year life in the assessor's
2009/2010 valuations, but are still being valued with a 14 year life in the assessor's 2008
recommendation to the Board.
2. The glass manufacturing furnace assets were valued with a 10 year life in the assessor's
2009/2010 valuations, but are being valued with a 14 year life in the assessor's 2008
recommendation to the Board.
A list of these assets with the requested values for each are provided in the attached tables I and II.
