We are just followiing up to see what the status is of this property.
We do still have concerns as to what we were told are their requirements and what is actually happening.
Starting time is 7:00-Cars are here well before 6 a.m. Doors open and working by 6 a.m.
13 cars-Average of 18 up to 23.
2 twin axle trucks-At least 3. One of which does not have a motor. Also semi tractor trailers.
Numerous shipping containers.
2 vehicles parked there continously.
Appear to be painting oil well steps. Do not think they are compliant.
Several weeks ago a large metal wall was painted outside, on the weekend. It was noisy
and strong fumes. Did not think they could work on the weekend. Do not think this was compliant with the
�ealth department.
Numerous farming items and large silage bagging machine.
We are very concerned that they do not appear to be following the requirements they asked for while they are
appling for the special use permit. If they are not following the requirements when they are
trying to apply what will make them comply if they get the permit? Are physical checks being made to
the property?

Attached is a Word document with documentation of some of my concerns regarding Case#
USR-1785. I am the property owner adjacent to this on the north side. There are several pictures
with this document but there is no way to document the paint fumes we have smelled every day
this week. There is painting of stairs going on in the building but all doors have been kept open
and the paint smell is terrible. They have been painting all week. Aren't they supposed to have a
paint booth with filters? My biggest concern is that the operators of this business are not playing
by the rules now, why would they be expected to follow the rules after they get their permit. I am
not opposed to a business being run here as long as the rules are followed.

PRELIMINARY TRAFFIC STUDY
Traffic at this location will see a minimal increase. The I8 employees will not all be at this location. IS
employees drive automobiles or pickups to work and home at the end of the day.The company has two
delivery semi trucks these semis are sometimes at the shop and sometimes remain in the field delivering
products. On a biweekly basis steel will be delivered to this location by semi. The property is located on
Weld County 33 a paved road.
RE: The above. When I bought this property these buildings were uninhabited and the owner was not
using them. For the 10 yrs I have lived at this residence the absolute most traffic ever was two or three
cars per day with additional semi trucks a couple of times a week. There is now more traffic in one day
then we used to have in an entire year. Minimal increase??????

DUST ABATEMENT PLAN
The drive into the location is recycled asphalt this product creates little or no dust. Should
we see dust being created by our traffic we will first apply water as an abatement, should
this not be effective Magnesium chloride will be applied to all dust causing areas.
The drive is no longer recycled asphalt. It now is road base which is much dustier. Water has never been
applied let alone mag chloride.

3. Explain how this proposal is consistent with the intent of Weld County Code
Chapter 23.
• The proposal is consistent with the intent of the Weld County Zoning
Code for several reasons. The proposed use will create a productive
commercial use on a property that split off from surrounding farmland, for
a commercial Ag facility and has not used in this manor for several years.
This proposed use will foster the county's business and economic base.
This commercial use will use existing buildings that were not being used
in a productive economic and legal manor. The only people accessing this
building will be employees and an occasional steel supply truck. There
will be no retail trade taking place at this location .The Occupants of the
building are engaged in a lease purchase contract with the current owner
of the building. The proposed use will make efficient use of non-urban
development. The proposed use would conserve the value of the property
and be the most appropriate use for these buildings and land. This use has
no detrimental effect on the surrounding area and is not inconsistent with
previous uses. The proposed use would help to secure economy in
governmental expenditures. The county will not have to expend any
financial resources what so ever associated with this use by special review.

The applicant plans to install an opaque 6 ft fence for security and visual
screening.

1. Explain in detail the proposed use of the property.
The occupants of the property propose to use the property as an oil field
equipment manufacturing facility. This manufacturing will take place in
the existing buildings at the location. The location of the facility will
lessen miles traveled on county roads as it is close to the expanding
Niobrara play. These buildings have previously housed a trucking and
agricultural packaging company

Thank you for sending this exchange of notes to me.
I "know" that proper applications have been sent to the CDPHE-APCD for an Air Permit. I spend some time with them in
their office assisting them with the applications. The applications were to be forwarded to the APCD 2-3 weeks ago.
The applications were for "stationary" spray painting(what is conducted at their site NW of Ault) and "Mobile" painting
as what they do "in the field" when they are surface coating oil and gas field equipment that can't be moved to a central
facility.
The company, I was told, has purchased (present tense) a paint booth that is to be installed at this location NW of Ault.
Re. a paint booth: A paint booth will only remove over spray particulates. Fumes from the solvents in the paints will not
be removed by the booth. Solvent fumes removal does not occur from "nearly" all paints booths. Removal of solvent
fumes requires other technology such as a flare, refrigerated condenser. I am not aware of any paint booth in Weld
County that is required to remove solvent vapors from emissions from surface coating operations(Richie Brothers' huge
ivaint and blasting booths booth do not have solvent removal systems).
When I assisted them with applications, I determined that they are painting in a "Scenario 1"defined environment. The
emissions point for Scenario I is less than 10 meters in elevation and it is less than 100 meters from the nearest property
line. This is the "most" restrictive of the "Scenarios". As this is "Scenario I" they are required to be tracking and
reporting the volumes of uses of solvents such as xylene, toluene, and MethyEthylKetone (MEK).
I additionally,commented to them, that painting should be at times when the winds are from the west, north, SW or
NE. This would carry emissions away from the affected, complainant.

Attached please find our painting permit submitted to the Colo Dept of Public Health & Environment on 8-17-11. Your
attachment includes our cover letter (1 pg), completed APEN permit(3 pgs) and the Non-Criteria Reportable Air
Pollutant Emission Notice Addendum.
Also for your convenience I have included the following information:
- During a 30 day time frame when we are painting the cross over stairs we use approximately 17.5 gallons of paint
p/month and approximately 4 days p/month
- We use an Electrostatic Spray gun so the over spray and loss of paint is minimal
- Also, the amount of space between our cross over stairs and our neighbor to the north of us is approximately 350 ft
- Also, there is a building between our cross over stairs and the neighbor to the north of us
- Also, Phil Brewer, Environmental Specialist III, WC Dept of Public Health and Environment, has instructed C&H not
to impede our business whatsoever while waiting to hear back on our painting permit from the State of Colorado
- This gentleman to the north of us continues to trespass and harass our company in order to obtain pictures of our
property
In closing, you also need to know that during the months of April, May,June and the first three weeks of July of this year
we did not paint any stairs at all.
If you have any questions please feel free to contact us, we look forward to working with WC Planning Services to rectify
this opportunity we are dealing with.

If you are going to use a manufacture paint booth, manufacture specification and floor plan for location of booth will be
required to be submitted .. If you are going to build a spray room, all requirements from the 2006 International Building
and Mechanical Code will need to be submitted.An approval and comments will also be required from Eaton Fire
District for either system.
2006 International Building Code
[F] 416.2 Spray rooms.
Spray rooms shall be enclosed with fire barriers with not less than a 1-hour fire-resistance rating. Floors shall be
waterproofed and drained in an approved manner.
[F] 416.2.1 Surfaces.
The interior surfaces of spray rooms shall be smooth and shall be so constructed to permit the free passage of exhaust
air from all parts of the interior and to facilitate washing and cleaning, and shall be so designed to confine residues
within the room. Aluminum shall not be used.
[F] 416.3 Spraying spaces.
Spraying spaces shall be ventilated with an exhaust system to prevent the accumulation of flammable mist or vapors in
accordance with the International Mechanical Code. Where such spaces are not separately enclosed, noncombustible
Spray curtains shall be provided to restrict the spread of flammable vapors.
F] 416.3.1 Surfaces.

502.1 General.
An exhaust system shall be provided, maintained and operated as specifically required by this section and for all
occupied areas where machines,vats, tanks, furnaces,forges, salamanders and other appliances,equipment and
processes in such areas produce or throw off dust or particles sufficiently light to float in the air,or which emit heat,
odors, fumes, spray,gas or smoke, in such quantities so as to be irritating or injurious to health or safety.
502.1.3 Equipment, appliance and service rooms.
Equipment, appliance and system service rooms that house sources of odors, fumes, noxious gases, smoke, steam, dust,
spray or other contaminants shall be designed and constructed so as to prevent spreading of such contaminants to other
occupied parts of the building.

Attached please find our painting permit submitted to the Colo Dept of Public Health & Environment on 8-17-11. Your
attachment includes our cover letter (1 pg), completed APEN permit (3 pgs) and the Non-Criteria Reportable Air
Pollutant Emission Notice Addendum.
Also for your convenience I have included the following information:
- During a 30 day time frame when we are painting the cross over stairs we use approximately 17.5 gallons of paint
p/month and approximately 4 days p/month
- We use an Electrostatic Spray gun so the over spray and loss of paint is minimal
- Also, the amount of space between our cross over stairs and our neighbor to the north of us is approximately 350 ft
- Also, there is a building between our cross over stairs and the neighbor to the north of us
- Also, Phil Brewer, Environmental Specialist III,WC Dept of Public Health and Environment, has instructed C&H not
to impede our business whatsoever while waiting to hear back on our painting permit from the State of Colorado
- This gentleman to the north of us continues to trespass and harass our company in order to obtain pictures of our
property
In closing, you also need to know that during the months of April, May,June and the first three weeks of July of this year
we did not paint any stairs at all.
