HomeMy WebLinkAbout20110210.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING TO OUTLINE WORKING PROCEDURES FOR INFORMATION SHARING AND COLLABORATIVE EFFORTS AND AUTHORIZE CHAIR TO SIGN-COMMUNITY DEVELOPMENT INSTITUTE (CDI) HEAD START WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Memorandum of Understanding to Outline Working Procedures for Information Sharing and Collaborative Efforts between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Community Development Institute (CDI) Head Start, commencing January 1, 2011, and ending December31, 2011, with further terms and conditions being as stated in said Memorandum of Understanding, and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding to Outline Working Procedures for Information Sharing and Collaborative Efforts between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Community Development Institute (CDI) Head Start be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. Griego, Director, Human Services artmei RE: Memorandum of Understanding between the Weld County Department of Human Services and Community Development Institute (CDI) Head Start Enclosed for Board approval is a Memorandum of Understanding between the Weld County Department of Human Services and Community Development Institute (CDI) Head Start. This Agreement was reviewed by the Board by a Pass-Around Memorandum dated December 20,2010, and approved for placement on the Board's Agenda. The Memorandum of Understanding is non-financial and is a requirement under a joint memorandum from the Office of Head Start and the Administration on Children Youth and Families, ACF-IM-HS-10-04 (7/28/2010 Serving Families involved in the Child Welfare System. The purpose of the MOU is to outline collaboration and working procedures between the Department and Community Development Institute (CDI)Head Start in the areas of communication and sharing of information, ongoing collaborative efforts, and other cooperative arrangements. The term of this Memorandum of Understanding is January I, 2011 to December 31, 2011. If you have any questions, please give me a call at extension 6510. 2011-0210 MEMORANDUM OF UNDERSTANDING BETWEEN WELD COUNTY DEPARTMENT OF HUMAN SERVICES AND COMMUNITY DEVELOPMENT INSTITUTE HEAD START SERVING WELD COUNTY, CO This Agreement is between Weld County Department of Human Services (hereinafter referred to as WCDHS) and Community Development Institute Head Start (hereinafter referred to as CDI HS), for the period from January 1, 2011 to December 31, 2011. I. PURPOSE STATEMENT The purpose of this Agreement is to establish collaboration and working procedures between the WCDHS and CDI HS in the provision of services to Regional Head Start and Migrant and Seasonal Head Start children eligible for program services for the 2010 school year in compliance with the joint memorandum from the Office of Head Start and the Administration on Children Youth and Families, ACF-IM-HS-10-04 (7/28/2010) Serving Families Involved in the Child Welfare System. The intent of the Agreement is to: 1. Encourage strong communication, cooperation and the sharing of information between WCDHS and CDI HS on behalf of the children and families they mutually serve, 2. Establish ongoing collaborative relationships between WCDHS and CDI HS. 3. Define outreach and service partnership strategies WCDHS and CDI HS will undertake collaboratively on behalf of the children and families they mutually serve. 4. Ensure that each Agency cooperatively maintains communication and shares leadership responsibilities at the local level to ensure that available resources are utilized in the most effective manner. 5. Ensure that cooperative arrangements between WCDHS and CDI HS are developed, implemented, and persevered. II. RESPONSIBILITIES OF CDI HS 1. Review annually recruitment and selection policies to prioritize enrollment of foster children and children with open child welfare cases and communicate the policies to WCDHS. 2. Designate a CDI HS liaison to WCDHS to facilitate communication between the agencies. 3. Work with WCDHS to establish a mutually agreed upon screening process for Head Start families who are involved in the foster care/child welfare system, to include a referral form that identifies the child's foster care status as a basis for eligibility and includes information for the child's case worker. 4. Collaborate with WCDHS to utilize current child welfare agency support services for foster/child welfare children enrolled in Head Start, including joint case planning and service planning meeting. 5. Ensure that foster care/child welfare children and families enrolled in Head Start receive "normalized" treatment in the program. 1 6. Ensure that foster care/child welfare children and families' confidentiality is maintained. 7. Work collaboratively with WCDHS to develop cooperative staff training opportunities to increase knowledge of services offered, terminology, goals, objectives and policies. 8. Collaborate with WCDHS to arrange joint trainings of mutual interest. III. RESPONSIBILITIES OF WCDHS 1. Designate a WCDHS liaison to CDI HS to facilitate communication between the agencies. 2. Work with CDI HS to establish a mutually agreed upon screening process for Head Start families who are involved in the foster care/child welfare system, to include a referral form that identifies the child's foster care status as a basis for eligibility and includes information for the child's case worker. 3. Refer identified age-eligible foster care/child welfare children to CDI HS for possible services. 4. Collaborate with WCDHS to utilize current child welfare agency support services for foster/child welfare children enrolled in Head Start, including joint case planning and service planning meetings. 5. Provide a letter to foster families, foster family case workers and relative caregivers of age-eligible children to encourage them to enroll their children in Head Start, advising them that foster children are eligible for free Head Start services, explaining the comprehensive services Head Start offers and providing information about how to enroll children in Head Start. 6. Work collaboratively with CDI HS to develop cooperative staff training opportunities to increase knowledge of services offered, terminology, goals, objectives and policies. 8. Collaborate with CDI HS to arrange joint trainings of mutual interest. 9. Ensure that the Consent for Release of Information forms referred to below are signed by each child who is identified for services. IV. CONFIDENTIALITY 1. Consent for Release of Information forms in accordance with the Family Education Privacy Rights Act and the Health Insurance Portability and Accountability Act that will assist CDI HS and WCDHS in providing optimal services will be generated and signed by each child who is identified for services. V. MODIFICATION OF AGREEMENT 1. All modifications to this agreement shall be in writing and signed by both parties. VI. ASSIGNMENTS 1. This Agreement shall be binding upon the parties hereto, their successors, theirs, and legal representatives. 2 VII. EARLY TERMINATION: In the event that CDI HS is no longer funded as interim management contractor for operation of the local Head StarUEarly Head Start program, CDI HS may terminate this Agreement prior to the end of its stated term upon thirty (30) days written notice to the WCDHS. VIII. MISCELLANIOUS PROVISIONS 1. No Third-Party Beneficiary Enforcement. It is expressly understood and agreed that enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the parties hereto and nothing contained in this Agreement shall give or allow any claim or right of action whatsoever by any other person on this Agreement. It is the express intention of the parties hereto that any person or entity, other than the parties receiving services or benefits under this Agreement shall be deemed an incidental beneficiary only. 2. Waiver of Immunities/Third Party Liability. No portion of this Agreement shall be deemed to constitute a waiver of any immunities of the parties hereto or their officers or employees may possess, nor shall any portion of this Agreement be deemed to have created a duty of care with respect to any persons or entities not a party to this Agreement. 3. Severability. If any term or condition of this Agreement shall be held to be invalid, illegal or unenforceable, this Agreement shall be construed and enforced without such a provision, to the extent this Agreement is then capable of execution within the original intent of the parties.
