HomeMy WebLinkAbout20110415.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000160 AGAINST ELEANOR HOCHMILLER LIVING TRUST/DEJOHN MOVING CO., FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eleanor Hochmiller Living Trust and DeJohn Moving Co., ZCV #1000160, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of February, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Johnny Miller, property owner, and Gary DeJohn, owner of DeJohn Moving Co., were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 8, 2011, to allow adequate time for the property owner to continue the Pre-Application process for a Site Plan Review (SPR), as well as, submit a completed Site Plan Review (SPR) application to the Department of Planning Services. I attempted to call him back, a guy told me he left, but he gave me his cell number (303-901-1982). I called Johnny. He said he is renting out the property to a guy who is temporarily storing those structures there. He said they are going to be going to Fort Morgan. I asked when. He wasn't sure. I explained that they are posing a safety issue. The Sheriffs Office is having calls about kids playing in and around them. I told him that I would only be able to grant 30 days to have them removed. He said he didn't think they guy could have them all out within 30 days. I offered to send a copy of the letter to the guy. He said okay. It is DeJohn Moving. I explained that I knew who that was and I would send him a copy of the 30 day letter. I explained he would need to attend the Violation Hearing in order to get any additional time since due to the safety issues, I will not be granting any additional time. He said okay. 01/05/2011 Phone call Gary DeJohn (381-2652 cell)called. He said John Hochmiller had him come down and see a letter that I sent him. He said that this site was zoned accordingly for storage. I said at a minimum a Site Plan Review(SPR)would be required, if not a Use by Special Review (USR). He said it zoned 1-3 (Industrial). I again reiterated that at a minimum a SPR would be required even in the Industrial Zone District. He said they are on the way to a Fort Morgan property for an addition to a motel. He said he banked with New Frontier and as a result his financing fell through. He said he has room to store them on the property in Fort Morgan, but they won't let him move them there until he gets the permit through them and he doesn't have the financing right now. I explained that they are posing a safety issue where they are situated. He said he would go back out there this weekend and re-secure all the buildings. He said they were all boarded up. I tried to explain that would only work for a short time because the kids would most likely break into them again. He said he would attend the February 8, 2011 Violation Hearing. Box 758 Greeley CO 80632 Re: storage of modular house units Dear Commissioners, I understand that you will be hearing an appeal of a zoning violation notice regarding the unsecured and unsupervised storage of modular housing units on property located between the I- 76 frontage road and the BNSF rail line, north of and adjacent to the Town of Hudson. We have been advised by the Weld County Sheriff's Deputy that serves Hudson that these units have been broken into and vandalized. In the past, we observed a similar problem with the abandoned apartment units on the old Hudson labor camp property before it was annexed and cleaned up. I assume that your staff has provided photos and other evidence of the condition of this property. I recommend that any order to abate the nuisance be enforced. Thank you for your consideration. Racine Town Administrator rat Bethany Salzman From: Christoper Cruz Sent: Saturday, February 05, 2011 4:12 PM To: Bethany Salzman Subject: 1-76 Frontage road This is an email regarding the houses that are being stored on the 1-76 frontage road near Hudson. I have personally searched numerous vacant houses sitting on the property for a missing 13 year old about a month and a half ago. During my search there is substantial damage to the houses that I cannot find out if it is recent or not. The neighbors (to north) as well as the town, has complained stating that they have seen juveniles in the vacant houses at some time. The houses are full of broken glass, are open (not closed up or locked) allowing access easily creating a risk of injury for anyone entering the houses as well as law enforcement if for any reason the houses need to be searched. There is no fencing or anything else that is in place to help deter anyone from entering the property as well as no trespassing signs, etc. If you have any other questions please let me know, thanks.
