The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 53 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 46 is a local paved/gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The applicant will use the existing access to the property. No additional accesses will be granted. • Please show the existing access on the Plat and label it with the approved Access Permit number (will be provided). A water quality feature design has been provided and is acceptable. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show the existing access points on the Plat and label them with the Access Permit number (will be provided). 2. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. SUBJECT: USR11-0002 ENVIRONMENTAL HEALTH DEVOE COLORADO DATE: SEPTEMBER 1, 2011 Environmental Health Services has reviewed this proposal for an oil and gas support and service business. The company hauls water and gravel to drilling and well service companies. The proposed use of the property is for storage of the vehicles, equipment and supplies. There is an existing individual sewage disposal system (SP-9900564) that was permitted for a 3 bedroom home or 6 persons. According to the applicant, the home has been converted into office space. There are 19 employees, including office, drivers and mechanics, who access the site on a daily basis. The drivers and mechanics must • also have access to potable water, restroom and hand washing facilities. The existing septic system will require an engineer's review to ensure there is sufficient capacity to serve the proposed business. If the septic system is found to be inadequate, the system will require to be upgraded. Central Weld County Water District provides water to the site. The applicant will need to submit documentation from the Water District indicating there is sufficient capacity to serve the business. A dust abatement plan has been submitted and was found to be adequate. Dust will be controlled by applying water on unpaved roads and/or treat with magnesium chloride, and restricting vehicle speeds. Light maintenance of vehicles and equipment is performed in the shop. The waste handling plan included removal and disposal of refuse and wastes generated from maintenance of vehicles, such as used oil, tires and batteries, and from spills of vehicle fluids. The applicant informed that there are no floor drains in the shop. Also, vehicles and equipment will not be washed at the site. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: • We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The existing septic system shall be reviewed by a Colorado Registered Professional Engineer for the proposed business use. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. Submit documentation from Central Weld County Water District indicating that the existing tap is sufficient for the commercial operations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 2 • 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. The facility shall utilize the existing public water supply (Central Weld County Water District). 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. This violation was initiated due to the operation of a commercial business without first completing the necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this case has not been presented to the Board of County Commissioners, no investigation fee is required as this time. The violation was initiated upon an inspection of an almost adjacent violation case turned in by a private citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied,the commercial vehicles and all commercial operations shall be removed from the property within 30(thirty)days. Additionally, if denied by the Board of County Commissioners please request this violation case be referred to the County Attorney's Office with a delay • of legal action for the 30 (thirty) days mentioned above. • SERVICE,TEAMWORK,INTEGRITY,QUALITY • 1. Building permits shall be obtained prior to the construction or change of use of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements the Weld County Code do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical or water for watering or washing of livestock or poultry. 2.A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2006 International Residential Code; 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy Conservation Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require wet stamped engineered drawings and engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the • purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Offset and setback requirements are measured to the farthest projection from the building. 7.
