RE: SUBMITTING TO THE QUALIFIED ELECTORS OF THE COUNTY OF WELD,
STATE OF COLORADO AN AMENDMENT TO PARAGRAPH (5) OF SECTION
5-3 OF ARTICLE V OF THE HOME RULE CHARTER FOR WELD COUNTY,
COLORADO DELETING THE REQUIREMENT THAT IN THE EVENT OF
CONFLICT BETWEEN THE BOARD OF COUNTY COMMISSIONERS AND
ANY OTHER COUNTY OFFICER, SUCH COUNTY OFFICER SHALL BE
REPRESENTED BY THE WELD COUNTY DISTRICT ATTORNEY AND SUB-
STITUTING THAT REQUIREMENT THAT SUCH COUNTY OFFICER BE
REPRESENTED BY A SPECIAL COUNSEL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board feels that it is in the best interests of
Weld County that a certain provision of the Home Rule Charter. for
Weld County, Colorado be amended, and
WHEREAS, Section 30-11-506, CRS 1973 and Section 17-1 of
Article XVII of the Home Rule Charter requires that a resolution
be adopted by the Board submitting the proposed amendment to the
qualified electors .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado:
Section 1. At the next general election to be held on
November 7, 1978, there shall be submitted to the qualified electors
of the County of Weld, State of Colorado, for their approval or
rejection the following amendment to the Home Rule Charter for
Weld County, Colorado, to-wit:
Paragraph (5) of Section 5-3 of Article V of the Home Rule
Charter for Weld County, Colorado, is amended to read:
(5) In the event of conflict between the Pnard
and any other county officer, such county
officer shall be represented by the-Weld
@aunty-Bistr#et-Atterney A SPECIAL COUNSEL.
Section 2 . Each elector voting at said election and desirous
of voting for or against said amendment shall cast his vote as
provided by law either "Yes" or "No" on the proposition: "An
amendment to paragraph (5) of Section 5-3 of Article V of the
Home Rule Charter for Weld County, Colorado deleting the require-
ment that in the event of conflict between the Board of County

Commissioners and any other County Officer, such county officer
shall be represented by the Weld County District Attorney and
substituting the requirement that such County Officer be
represented by a special counsel. "
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 13th day of
September , A.D. , 1978 .
