RE: ACTION OF THE BOARD CONCERNING ZCV #1100018 AGAINST ADOLFO
GOMEZ, JR., FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Adolfo Gomez, Jr., ZCV #1100018, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Adolfo Gomez, Jr., property owner, was present at said hearing, and was
represented by Barbara Morgan, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until June 10, 2011, to allow adequate time for the property owner to
remove the noncommercial junkyard of all derelict vehicles and remaining miscellaneous debris,
and the property owner must also remove all remaining commercial vehicles that are being
stored on the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1100018 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Adolfo Gomez, Jr., to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until June 10, 2011, to allow adequate time for
the property owner to remove the noncommercial junkyard of all derelict vehicles and remaining
miscellaneous debris, and the property owner must also remove all remaining commercial
vehicles that are being stored on the property.

VIOLATION REMEDY:
As I indicated in my initial letter, please be advised the utilization of a camper/trailer-Recreational Vehicle as a
dwelling unit is not an allowed use unless the unit is situated at an approved camping facility. All
camper/trailers-Recreational Vehicles shall be disconnected from all utilities (i.e. electric, gas, water, etc), if
expanded, compacted and shall not be occupied at any given time on the property.
Additionally, there is a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and miscellaneous
debris. This is not an allowed use in the R-1 (Residential)Zone District, even if SCREENED.
Lastly, there appears to be COMMERCIAL VEHICLE storage on the property. All Commercial Vehicles shall
be removed from the property or you can visit with one of our On-Call Planners to determine if you are eligible to
apply for permits depending on your uses. We have a Planner on-call Monday - Friday from 7:30 AM to 4:30
PM. Please feel free to call 970-353-6100, Ext. 3540 and request the Planner on-call for the day.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County

04/05/2011 Phone call Adolfo Gomez(720-934-2693)called. He left a message indicating
he has a new mailing address and just received a letter. Peggy
Gregory& I called him back. I explained the zoning violations to
both Mr. Gomez and a Barbara Morgan (significant other). Barbara
explained that this past October/November he was diagnosed with
early onset Alzheimer's. Their new mailing address is 11808 Maiden
Way, Northglenn, Co 80233. His fax number is 303-280-2341.
Peggy& I agreed to fax all the letters to him. We also agreed to
push out the violation hearing to the May Violation Hearings.
