SUBJECT: AmUSR-1075, R. M. Hiner Construction Company, Inc. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: The main access to the facility is from North 23rd Avenue, which is maintained by other. An entrance located at the northeast corner of the site accesses to a private road owned and maintained by Weld County that serves the Weld County grader training course, Weld County gravel pits, Weld County offices, and the County jail. Due to mining safety and jail security issues, use of this road for access to the recreational lake and Hiner pit shall be limited to emergency responder access only. Use of the northeast access may be approved at the County's sole discretion under very limited circumstances with prior written notice to the County. • The applicant needs to address how the proposed USR recreational activities are compatible with the active mining and MSHA regulations. MSHA regulations require that people entering a working mine site be equipped with the proper personal protective equipment such as steel toed boots, safety glasses, hardhats, and safety vests. Portions of this parcel are located within the FEMA mapped Zone A 100-Year floodplain and the floodway. Weld County Code prohibits the construction of buildings within the floodway. Any structures or grading in the floodplain would require a Flood Hazard Development Permit (FHDP). Due to the hazardous nature of the floodplain, potential for loss of life, and potential for damage to public facilities such as bridges, campsites and overnight parking cannot be located in the FEMA 100-year floodplain or the floodway. Portable boat docks must be anchored per an engineered design because the lakes are in the floodplain and, in a flood, the boat docks could move downstream and block flows (e.g. if they become entangled in a bridge). REQUIREMENTS: 1. Utilize the existing accesses to the site from North 23rd Ave. The access off of the County's privately maintained road is to be used for emergency and incidental access only.No new accesses will be granted. 2. As requested at the pre-application meeting and 7-day review, please revise the floodplain labels on the site plan to reference the 2003 Army Corps of Engineers Cache La Poudre River Floodplain Study that has been accepted by FEMA. The note delineating the flcodplain on the site plan references FHDP-615 which is for shop located in the Idaho Creek floodplain located near Longmont, CO. 3. Please add the following development standards to the Plat: • a. There shall be no campsites or overnight parking located in the FEMA-mapped 100-year floodplain or in the flcodway due to the hazardous nature of the floodplain and the potential for loss of life. • b. There shall be no campsites or overnight parking located between the Cache La Poudre River and the lakes due to the potential for riverbank erosion that occurs during a flooding event. c. Portable boat docks must be anchored per an engineered design. A flood hazard development permit must be obtained prior to the installation of the boat docks. d. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. e. WARNING: LOT MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Parcel # 080531000063 may not be able to obtain building permits to construct structures. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Maps #8082660-0628C dated September 28, 1982 and Map Panel #080266-1529E dated June 10, 2005, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code and all applicable FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. f. MEMORANDUM TO: KIM OGLE, PLANNING SERVICES • SUBJECT: MUSR 10 SFROM: MARY T, ENVIRONMENTAL HEALTH COLORADO DATE: APRIL 11, 2011 Environmental Health Services has reviewed this proposal for an asphalt and concrete batch plan, aggregate mining operation, an oil field business, and a recreational facility to include water skiing lakes and campsites along with commercial hunting. Water is supplied by North Weld County Water District. This Department requests documentation that the existing tap is sufficient for the commercial operations. Portable toilets will be provided for the recreational facility. The use of portable toilets for the recreational facility was approved per USR-1075 that was recorded on November 27, 1995. Employees and drivers must have access to drinking and sanitary facilities. According to our records there are three (3) existing septic permits for the property: Permit SP- . 9700216 for a 3 bedroom modular home; Permit G19950221 for a 2 bedroom house/office; and G19879065 for a 2 bedroom mobile home and office, A restroom must be made available for employee use. If one of the existing septic systems on the property is to be utilized, then the existing septic system must be evaluated by a Colorado Registered Engineer to determine if adequate for the proposed load. Portable toilets and bottled water may be utilized at the working face of the mine. There will be two community fire pits for the west camping site. In accordance with the Colorado Air Quality Control Commission's Open Burning Regulation No. 9, fires used for noncommercial cooking of food, or for recreational purposes are exempt from the requirement of obtaining an open burning permit. This facility shall adhere to the maximum permissible noise levels allowed in the light industrial zone district of 70 db(A), as per Development Standard #6 of USR-1075. In addition, berms, conveyors and shroud covers could be installed to limit noise impacts. A minimal noise plan is required for this amendment. A dust abatement plan is required. The plan should include control measures such as, application of water, reducing vehicle speeds, compaction of road surfaces, berms and covering or watering loaded haul trucks. The source of water shall be included in the dust abatement plan. • • A waste handling plan is required and should include the name, address and phone number of the waste removal and disposal companies. The plan should indicate how any waste associated with the facility is contained and disposed of. The amount and type of fluids that will be on site is also required. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the • Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 4. In the event the applicant intends to utilize the existing septic system at the home, for employee use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 5. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if applicable. 6. In accordance with the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations. • 9 • 7. The Division requires that an odor abatement and response plan be submitted prior to operation of the facility. This plan shall be implemented at the request of the health department in the event that odor levels detected off site of the facility meet or exceed the odor limit as specified by the Colorado Revised Statues. The plan shall also be implemented in the event that the Health Department receives a significant number of odor complaints and in the judgement of the Director of Public Health, there exists an odor condition requiring abatement. 8. Submit documentation from North Weld County Water District indicating that the existing tap is sufficient for the commercial operations. 9. The applicant shall submit a noise abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 10.The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). • 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • 3 • 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the light industrial zone district of 70 db(A), as per Development Standard #6 of USR-1075. 8. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility at all times. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. • 10. Portable toilets will be allowed for the recreational area, per Development Standard #7 of USR-1075. Records of maintenance and proper disposal shall be retained on a seasonal basis. 11. RV units that have self-contained sewage disposal, shall dispose of sewage at an approved off-site facility. 12.A permanent, adequate water supply shall be provided for drinking and sanitary purposes (North Weld County Water District). 13.The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 14.All pesticides, fertilizer, and other potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 15. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. • 4 • 16.The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 17.The operation shall comply with all applicable oil and gas operations regulated by the Colorado Oil and Gas Conservation Commission. 18.The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation Mining and Safety. 19.The operation shall comply with the Mine Safety and Health Act. (MSHA) 20. The operation shall comply with the Occupational Safety and Health Act. (OSHA) 21.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. • Additionally, please note the following: 1. The applicant should be made aware that the lake water may not meet all water quality standards for natural swimming areas as defined by the Colorado Department of Public Health and Environment. The Division has reviewed the application and offers the following comments: • The Reclamation Permit was issued for the Greeley Pit in 1977 and the site is permitted for 170 acres. To date, no portion of the mine site has been released from reclamation responsibility. The approved post-mining land use for the site is recreation, which allows the site to be utilized for water skiing and camping. The simultaneous use of the site as an active mining operation and for recreation purposes is not under the Division's jurisdiction. Any restrictions on concurrent land uses would need to be addressed at the County level. The proposed changes to the Site Specific Development Plan and the Amended Special Review Permit do not conflict with the Division's interests. However, any changes made to the Mining and Reclamation Plan must be approved by the Division through a Technical Revision. The changes would include the addition of an asphalt and concrete batch plant, relocation of existing gas lines/wells,reconfiguration of the ponds, and the addition of campsites and boat ramps around the north pond. The site consists of approximately 127 acres that will include an asphalt and concrete batch plant, oil field business, and recreational facility including camp sites and water skiing lake. The referral package included the site plan (3/3/11) by KBN Engineers, questionnaire(undated), and questionnaire • addendum (3/3/11) by KBN Engineers. Portable toilets are indicated on the site plans, so pit toilets or septic systems are not expected. The referral does not indicate any permanent structures will be built at the site. No geologic report was included in the referral. The site is located on a relatively flat surface on the north side of the Cache La Poudre River, and portions of the site are included in the 100-year flood plain. Although the mining area is within the flood plain boundary,the proposed camping sites are outside of the flood plain boundary and the application indicates that only day-use activities will be permitted within the flood plain. The Graham Seep is located in the western portion of the site, and shallow groundwater should be expected throughout the site. No site-specific geologic information was provided for review. Regional maps of the area indicate the geologic deposits on the site are primarily alluvial sands, gravels and silts. Bedrock underlying the site is likely shale, which may have expansive properties. Depth to bedrock is not known. Based on the information provided and the proposed land use, CGS does not have outstanding concerns regarding the geologic conditions that may affect the development, as long as the restrictions regarding the flood plain are followed. Work in an aquatic site should be identified by the proponent of the project and be shown on a map identifying the Quarter Section, Township, Range and County or Latitude and Longitude, Decimal Degrees (datum NAD 83) and the dimensions of work in each aquatic site. Any loss of an aquatic site may require mitigation.
